File Note: Discussed and resubmitted as under: The industry is a large red category sugar mill unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FZL/2025/28398577 dated 22.04.2025 with validity up to 30.09.2025 and the under the Air Act, 1981 vide no. CTOA/Renewal/FZL/2025/28398615 dated 22.04.2025 with validity upto 30.09.2025 for production of White commercial sugar @ 125 TPD as main product and Bagasse @ 280 TPD, Molasses @ 50 TPD & press mud @ 36 TPD as byproducts using sugarcane @ 1250 TPD as raw material alongwith discharge of treated trade effluent @ 300 KLD onto land for plantation, subject to certain conditions mentioned therein alongwith the following specific conditions: - (1) The industry will ensure continuous operation of ETP even during the non-crushing season for the adequate maintenance of required biomass in compliance to the directions of the Central Pollution Control Board (CPCB) and shall operate the ETP efficiently to achieve the prescribed standards at all times........ (2) The industry shall develop adequate land area under plantation with proper distribution system before the operation of next crushing season 2025-26, so as to utilize its entire treated trade/domestic effluent and shall further ensure no stagnation / indiscriminate disposal of its effluent....... (3) The industry shall maintain good house-keeping in and around the ETP and shall ensure regular operation/calibration of OCEMS installed at the outlet of the ETP........... (4) The industry will ensure to replace the existing wet scrubbers (APCDs) with the new ones and shall provide adequate sampling arrangement with porthole at the stack for emission sampling before the operation of next crushing season 2025-26......... (5) The project proponent shall devise the ways & means to minimize the generation of all kind of wastes through REDUCE, REUSE and RECYCLE activities. The generated waste, if any, shall be properly handled and managed as per the provisions of the Municipal Solid Waste Rules 2016 in an environmentally sound manner.......... (6) The Project proponent (PP) may also develop the vermicomposting/composting to manage the biodegradable solid waste. PP shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies........ (7) The Project proponent shall ensure that there are no usages of plastic carry bags and single use plastic / thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises...........(8) The Project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic ............(9) PP shall carry out awareness and activities for the themes / action points identified under Mission LiFE (Lifestyle for the Environment) by Ministry of Environment, Forests and Climate Change given at the website (http://missionlife-moefcc.nic.in)........ Now, the industry has applied for varied consent to operate under the Water Act, 1974 and the Air Act, 1981 for the production of White commercial sugar @ 125 TPD as main product and Bagasse @ 280 TPD, Molasses @ 50 TPD and Press Mud @ 36 TPD as by products using sugarcane @ 1250 TPD as raw material, alongwith discharge of treated trade effluent @ 300 KLD onto land for plantation.......... The details of the case are as under: (i) The industry has deposited Rs. 42,000/- vide UTR / Ref. No.UTIBN62025111146489937 dated 11.11.2025 and Rs. 42000/- vide UTR / Ref. No. UTIBN62025111146490817 dated 11.11.2025 as consent to operate fee under the Water Act, 1974 and Air Act, 1981, respectively against the certificate of CA dated 08.10.2025 showing the value of fixed assets of Rs. 1819.28 lakhs and value of plant and machinery as 1261.45 lakhs, as on 31.03.2025. The consent fee deposited by the industry is adequate up to 30.09.2026 under both Acts (by adjusting the NOC regularization fee of Rs 7200 for increase in gross fixed assets approx 87.76 lacs).......... (ii) The industry has applied for varied consent to operate under the Water Act, 1974 and Air Act, 1981 due to increase in value of plant and machinery (mainly due to repair costs). However, there is no change in production capacity of the industry......... (iii) The industry has submitted a certificate from MC Fazilka vide no. 2042 dated 29.10.2025 which specifies that the industry lies outside the MC limits.......... (iv) The industry has submitted compliance report of previous consent conditions under Water Act, 1974 and Air Act, 1981 in annotated form and industry is complying with all the main conditions except the condition which is produced verbatim “ 4. The industry will ensure to replace the existing wet scrubbers (APCDs) with the new ones and shall provide adequate sampling arrangement with porthole at the stack for emission sampling before the operation of next crushing season 2025-26” and the industry has not replaced the existing wet scrubbers.……… ….(v) Previously, water samples were collected by officer of the Board on 02.01.2025 and as per Board’s Water lab analysis report, the concentration of pH, TSS, COD, BOD, MLSS and MLVSS was 8.2, 50 mg/l, 106 mg/l, 18 mg/l, 3290 mg/l and 2470 mg/l, respectively i.e. within permissible limits of the prescribed standards for such units....... (vi) The industry has also submitted report of air sampling done by Eco Paryavaran Laboratories & Consultants Pvt. Ltd. on 25.02.2025 and values of parameters were, Sulphur Dioxide: BDL (5), carbon monoxide: 137 mg/Nm3, Particulate Matter (at 12% CO2 Corr): 105 mg/Nm3, Oxides of Nitrogen: 58 mg/Nm3........ The industry was visited by the EE and AEE of this office on 17.12.2025 and it was observed as under: (i) The industry was found to be in operation at the time of visit.......... (ii) ETP installed by the industry was operational. The ETP comprises an Collection tank , Oil and Grease trap, Equalization tank, Primary Clarifier, Aeration tanks, Secondary Clarifier tank, Outlet Chamber and Sludge Drying beds........ (iii) A flow meter has been installed at the outlet of the ETP which indicated a totalized flow of 4362.53 m³ and an flow reading of 10.059 m³/hour, during the time of visit. A separate energy meter has also been provided for the ETP. The industry is maintaining record of treated effluent generated from the ETP. The industry has also installed CCTV cameras at the ETP which were in proper working condition......... (iv) Water samples were collected from outlet of ETP on 17.12.2025 and sent to the Board’s lab for analysis, for which results are awaited.......... (v) The industry has developed plantation over an area of approximately 04 acres for disposal of treated trade effluent.......... (vi) The industry has installed two boilers, each of 20 TPH capacity, using bagasse as fuel. Both boilers were found operational and equipped with wet scrubbers as APCD, along with adequate stack heights and proper sampling arrangements. However, the water was not being recirculated through the pit, at the time of visit. Air samples were collected from porthole of the stack of wet scrubber on 17.12.2025 and sent to Board’s lab for analysis and results are awaited........... (vii) The industry has installed a DG set of 166 kVA capacity, provided with canopy and adequate stack height..........In view of the above, it is clear that industry is complying with the provisions of the Water Act, 1974 but violating the provisions of the Air Act, 1981 and previous consent conditions. Hence, if approved, it is recommended that varied Consent to Operate may be granted to the industry under the Water Act, 1974 and SCN may be issued to the industry under Air Act, 1981 for the above violations, please.
