Kindly peruse the report/ recommendations sent by EE RO Patiala.
Certain observations were raised by this office, and now RO has replied to the same which may kindly be perused.
In view of report/ recommendations sent by EE,RO Patiala, if approved, following actions may be taken:
A. the project proponent may be granted consent to establish under the Water Act, 1974 and Air act 1981, for development of a project consisting of 69 no. residential plots, 12 nos. Commercial Plots and 12 Nos. EWS Plots having area of 41 Kanal 11.77 Marle (5.1986 Acres), subject to suitable conditions, conditions as imposed by the regional office and following additional conditions:
1. The project proponent shall provide 15m wide green belt consisting of broad leaf trees, along the entire length of the project, towards the air polluting industry located within a radius of 100 m from the proposed site of the project.
2. The project proponent shall not carry out any activity, which is covered under the ambit of EIA notification dated 14.09.2006.
3. The project proponent shall use only treated wastewater for flushing purpose in its project by providing dual plumbing system and shall not use any freshwater for the said purpose.
4. The project proponent shall not generate wastewater more than the quantity mentioned in this consent letter, under any circumstances.
5. The project proponent shall develop 7 Kanal 8 Marla land of land area adjoining to the site of the project as per Karnal technology, for which the project component has submitted agreement along with the online application form, for utilization of treated wastewater on land for plantation.
6. The project proponent shall keep the adequate plantation area developed for disposal of treated wastewater inside its premises, at all times.
7. The promoter company shall ensure that the total built up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise the project as such is covered under category 8(b) of the schedule appended to the EIA notification and project proponent of the area development project is required to obtain the environmental clearance, failure which, the promoter company shall be liable for action for the violation of EIA notification dated 14/09/2006.
8. The promoter company shall ensure that the total built up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failure which, the promoter company/builder shall be liable for action for the violation of EIA notification dated14/09/2006.
9. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
10. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
11. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
12. The adequacy/ efficacy of the pollution control arrangements & disposal scheme shall be the sole responsibility of the project proponent and the pp shall be bound to implement/ upgrade its pollution control & disposal arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
13. The pp shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/ choe/ nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
14. The project has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances/ permissions from all other concerned departments.
15. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/ or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
16. The consent is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form and during hearing. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
17. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/ or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
B. EE, RO, Patiala may be asked to visit the poultry farm established near the site of the project and ensure that the same is not made operational at the site without obtaining consent to operate from the Board and following environmental guidelines issued for such units, at all times.
