Following clarifications were sought from RO 1. Vide STP Ludhiana letter no. 1430 dated 13.08.2008, Change of land of land use was granted to the industry M/s Shree Balaji Industries to operate in 714.55 Sq. yds. in khasra no. 6//13/1, situated in village Gobindgarh (H.B.No.243) Tehsil & District Ludhiana for industrial purpose. As such RO first has to report about the earlier operating industry at this site i.e. M/s Shree Balaji Industries, its process and consent status for this site……. 2. RO has to report site suitability for the current electroplating industry at this site as per existing notified master plan of the Ludhaina…… 3. The industry has submitted notary attested rent agreement of the site with owner of the land, which is required to be registered agreement signed by the executive magistrate/Tehsildaar and shall contain exact details of the site i.e. exact khasra no. of the site along with plot details……………….
The point wise compliance of observations as submitted by RO is as under:- 1. It is intimated that M/s Shree Balaji Industries, Vill-gobindgarh Near Phase-vii, Focal Point, Ludhiana was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH4/2021/15190609 dated 23.03.2021, valid upto 30.06.2024 and under the Air Act, 1981 vide no. CTOA/Renewal/LDH4/2021/15190687 dated 23.03.2021, valid up to 30.06.2024. The industry was engaged in process of nickel, chrome plating. 2. The industry has submitted certificate issued by the DTP. Ludhiana having memo no. 3644 dated DTP(L) M2A dated 28.12.2007. The details of same has already been mentioned in the agenda note. The industry has also submitted the CLU certificate issued by STP vide memo no. 1430 STP(L)/TW/2A dated 13.08.2008 intimating that the CLU of 714.55 Sq.Yds in khasra no. 6//13/1 which is situated in village Gobindgarh (H.B.No. 243) Tehsil and Distt. Ludhiana for industrial purpose has been considered. Permission is being given as per govt. instruction issued vide letter no. 5085-5105-CTP (Pb)/SP-432(Gen.) dated 09.06.2008 to use the said and for industrial purpose. The site is suitable for such type of unit. 3. The industry has submitted registered sale deeds for the following Khasra numbers: 9//2, 14, 6//17/2, 18/2, 23, 19, 9//16/1, 10//20/2, 9//15/1, 10//11/2, 6//13/1, and 9//3. Further, the industry has submitted a rent agreement as proof of ownership/possession. ……………..
From the perusal of reply, it can be inferred that the industry has not submitted site suitability for the current new electroplating industry at this site as per existing notified master plan of the Ludhaina and has not submitted registered agreement as required………….
As such CTO application of the industry cannot be processed ahead without above compliance , it is therefore recommended that CTO application of the industry be refused please ……….
