File Note: The kiln was granted consent to operate vide no. CTO/Renewal/MNS/2024/27105918 dt. 08.10.2024, with validity upto 08.10.2029 under the Water Act, 1974, vide no. CTO/Renewal/MNS/2024/27056186 dt. 29.07.2024, with validity upto 29.07.2029 under the Air Act, 1981 for operation of brick kiln with natural draft technology to manufacture bricks & tiles @ 35,000 nos./day, subject to the conditions mentioned therein. Now, the industry has applied for varied consent to operate under the Water Act, 1974 and Air Act, 1981 for manufacturing of bricks/tiles @ 35,000 bricks per day by using sand clay @ 120 Metric Tonnes per day under orange category. The industry has changed the ownership of the industry from partnership to proprietorship and has submitted the following documents for the same: - 1. The industry has submitted a copy of Dissolution deed vide eStamp no. IN-PB49969019617515X dated 01.07.2025 stating that Sh. Sukhwant Singh, Sh. Kewal Singh and Sh. Harjinder Pal Singh expressed their desire to retire from the partnership firm by mutual consent and they retired from the partnership firm with the close of business on 30th June, 2025 i.e. w.e.f. 01/07/2025 and the business of firm has been taken over by Sh. Ujagar Singh as soleproprietor of the firm. 2. The industry has submitted a copy of Sale deed dated 04.11.2025 on the name of Shri Ujagar Singh. The industry has now submitted a CA certificate reflecting the updated value of fixed assets as Rs. 59.07 Lakhs as on 18.11.2025. The industry already has consents to operate valid upto 29.07.2029. Accordingly, the brick kiln was visited by the AEE of this office on 23.12.2025 and it was observed as under: 1) The kiln was not in operation during visit due to off season. 2) The kiln has converted its kiln to zig-zag technology as per design of CSIR- Central Building Research Institute, Roorkee. The CBRI, Roorkee has issued completion certificate dated 28.09.2019. 3) The brick kiln is to use crushed coal as a fuel in the kiln with small spoon and feeding practice as per the recommendations of CSIR-Central Building Research Institute, Roorkee. 4) The industry has not use the 20% of pellets in replace to the coal as per orders of Hon’ble supreme Court. 5) The kiln has not provided a ladder and a platform with the stack for collection of emission sample. 6) The kiln has not installed the display of a notice board, as per the Hon'ble National Green Tribunal's order dated 25.02.2025 in O.A. No. 359/2022 titled Rafhat Naeem Siddiqui vs State of U.P. & Ors. 7) The kiln has stabilized the periphery road / movement area. 8) The kiln has provided adequate plantation all along its boundary. 9) The domestic effluent generated is disposed onto land for plantation after passing through septic tank. Thereafter, the BKO has submitted photographs as proof of providing a sampling platform for emission sampling and has also installed the display board in compliance with the Hon’ble National Green Tribunal’s order dated 25.02.2025 passed in O.A. No. 359/2022 titled Rafhat Naeem Siddiqui vs. State of U.P. & Ors. However, the industry has not submitted any compliance regarding the use of 20% pellets as a replacement for coal. Keeping in view of above, it is recommended that the show cause notice regarding the refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 may be issued to the industry.
