It is intimated that the industry is small scale red category unit and earlier the industry was granted CTE under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/LDH4/2024/2465585 dated 24.01.2024 which was valid upto 23.01.2025.
Thereafter, a complaint was received in this office regarding water pollution caused by the industry in the area. Accordingly, the industry was visited by officer of this office on 14.01.2025 and observed as under: - 1. The industry was in operation. 2. The industry is engaged collection of contaminated containers. 3. The industry has stored lot of contaminated containers in open and unlined surface. The industry is in process to provide the shed in the premises so that the stored containers can be covered. 4. The industry has provided 01 cutter and grinder to cut and grind the waste plastic contaminated containers. 5. The industry has provided an underground storage tank which is approx. 50% full during the visit. The spillage of chemicals were found near the said tank, which indicated that the industry may do washing of contaminated containers. The industry has provided ETP components but same is not yet commissioned as the connectivity of ETP has not yet been done. Thus, the industry may dispose off the untreated effluent through unauthorized manner. 6. Further, the representative of the industry informed that they are engaged in only collection and storage of containers at the site. Washing has been done at their other unit which is authorized form the Board under name and style of G.N Enterprises, Tajpur, Road, Ludhiana. The representative also informed that the effluent stored in storage tank is due to washing of vehicles. 7. The industry has commissioned without obtained CTO under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and authorization under HWM Rules, 2016 and not installed any ETP till date. 8. No D.G set installed by the industry. The report of the same has been sent to competent authority through e-noting no. 27724771.
Again, the industry was visited by the officer of this office on 21.02.2025 and observed as under: -
1. The industry was not in operation as the electric connection of the industry was disconnected. During visit, seals were intact. 2. The industry is engaged in reprocessing/recycling of waste plastic i.e. drums and cans including washing of contaminated containers. 3. The industry has provided 01 cutter and grinder to cut and grind the waste plastic contaminated containers. 4. The industry has provided a ETP with evaporator for treatment of effluent generated from washing process of capacity 05 KLD. The ETP consists collection tank oil & grease tap Flash mixture with chemical mixing unit secondary tube settler multigrade sand filter activated carbon filter evaporation unit. 5. The representative of the industry informed that major drums are not required washing as it contains only eatable items etc. which are wrapped by plastic bags. He further informed that such drums shall be directly cut & grinded i.e., without washing. 6. The representative informed that contaminated containers which requires washing are less in number, thus total effluent generation shall not be more than 05 KLD. 7. The industry has provided 01 pump with 03 nozzles for washing of contaminated containers. 8. The industry has provided new water meter at source of fresh supply of water, outlet of ETP and effluent available for evaporation. 9. The industry has provided an arrangement for reuse of treated effluent in the process. 10. The industry has provided a shed to cover the contaminated containers to avoid rain water intrusion. 11. The industry has started the work of lining of floor. However, the representative of the industry informed that it shall be done after restoration of electric connection because there is requirement of water for said purpose and the taps had been sealed by the Board. Currently the industry is outsourcing a water tanker for said purpose. 12. The industry has provided an energy meter with the ETP. The industry was guided to maintain the record of water meter and energy meter. 13. The industry has provided separate hazardous waste room for storage of hazardous waste generated. 14. The industry has provided septic tank for disposal of domestic effluent. The industry has also identified area inside the premises for plantation. The representative informed that they shall develop plantation area for utilization of domestic effluent after septic tank before come into operation. 15. The industry has submitted a letter from DTP, Ludhiana vide no. 2792 DTP(L) M2A dated 20.11.2023 mentioning that the site falls in LPA, Ahmedgarh. The Master Plan of the same is not yet prepared. 16. The industry has also submitted that they shall comply with the SOPs framed for such type of units. 17. No D.G set installed by the industry. 18. The compliance of SoPs framed for such type of unit is attached herewith.
Thereafter, the competent authority of the Board has issued closure direction u/s 33-A of the Water Act, 1974 and u/s 5 of the EPA, 1986 and to seal the polluting machinery of the industry. The PSPCL authorities were also directed to disconnect the electric supply of the industry.
Accordingly, the polluting machinery of the industry has been sealed on 05.02.2025 by the officer of this office and electric connection of the industry has also been disconnected by the PSPCL authorities vide TDCO no. 09/2009 dated 05.02.2025.
Thereafter the industry has applied for consent to operate under the Water Act, 1974 and Air Act, 1981, which was granted to the industry upto 10.10.2025 alongwith temporary disconnection of the electric supply upto 10.10.2025.
Now the industry has applied for consent to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS for manufacturing of Recycling/Reprocessing of Plastic Waste @ 2000 Numbers/Day.
The industry has already deposited Rs. 18900/- vide R. No. 290202834 dated 11.02.2025 as water consent fee and Rs. 18900/- vide R. No. 924853367 dated 11.02.2025 which is adequate upto 31.12.2029 against the gross value fixed assets of Rs. 41.67 lacs as C.A certificate dated 11.12.2025.
Now, the industry was visited by the officer of this office on 23.12.2025 and observed as under: -
1. The industry was not in operation.
2. The industry is engaged in reprocessing/recycling of waste plastic i.e. drums and cans including washing of contaminated containers.
3. The industry has provided 01 cutter and grinder to cut and grind the waste plastic contaminated containers.
4. The industry has provided a ETP with evaporator for treatment of effluent generated from washing process of capacity 05 KLD. The ETP consists collection tank oil & grease tap Flash mixture with chemical mixing unit secondary tube settler multigrade sand filter activated carbon filter evaporation unit.
5. The industry has provided 01 pump with 03 nozzles for washing of contaminated containers.
6. The industry has provided new water meter at source of fresh supply of water, outlet of ETP and effluent available for evaporation.
7. The industry has provided a shed to cover the contaminated containers to avoid rain water intrusion.
8. The industry has provided an energy meter with the ETP.
9. The industry has provided separate hazardous waste room for storage of hazardous waste generated.
10. The industry has provided septic tank for disposal of domestic effluent. The industry has also identified area inside the premises for plantation. The representative informed that they shall develop plantation area for utilization of domestic effluent after septic tank before come into operation.
11. It is intimated that the industry had not been operation since its restoration of electric connection due to no availability of orders. The water meter and electric meter were also standing still at the reading of 0 indicating no washing has been done on the premises.
12. The industry has submitted a letter from DTP, Ludhiana vide no. 2792 DTP(L) M2A dated 20.11.2023 mentioning that the site falls in LPA, Ahmedgarh. The Master Plan of the same is not yet prepared.
13. The industry has also submitted that they shall comply with the SOPs framed for such type of units.
14. No D.G set installed by the industry.
As such, the industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of the above, it is recommended as under: -
1. Direction u/s 33-A of the Water Act, 1974 be issued for temporarily restoration of electric connection for six months.
2. CTO under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be granted for six months subject to usual conditions and special conditions as under: -
a. The industry shall always comply with the SOPs framed for such type of units.
b. The industry shall develop adequate plantation area for utilization of domestic effluent after septic tank as per site plan within one month.
c. The industry shall line the floor and provide slope so that effluent generated from floor washing shall be collected in the collection tank within one month.
d. The industry shall maintain the record of water meters and energy meter regularly.
e. The industry shall comply with the conditions mentioned in DTP letter no. 2792 dated 20.11.2023.
f. The industry shall comply with the requirements in accordance with the Public Liability Insurance Act, 1991 as amended, if applicable.
