File Note: Subject: Application for obtaining 'consent to establish' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 – M/s Bhumbla Enterprises Village Nangran Kalmot, Tehsil Nangal District Rupnagar. In this regard, it is submitted that the industry has applied for 'consent to establish' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for establishment of Crushing, Screening & Washing of River Bed Material of capacity 10,000 CFT/day in village Nangran Kalmot, Tehsil Nangal District Rupnagar. The industry has deposited NOC fee of Rs. 4100/- along with application fees vide R. No. 465825714 dated 29.11.2025, against the proposed cost of project of Rs. 65.30 lacs. The NOC fee deposited by the industry is adequate for one year. The industry has submitted, Project report authenticated by CA, Site plan, Feasibility report, Distance certificate from Revenue authorities/ Tehsildar, Nangal, District Rupnagar, undertaking regarding authorized signatory, letter regarding legal source of raw material from Drainage cum Mining and Geology Division, Anandpur Sahib, Water Resources Department, Punjab, land lease document, and other requisite documents. Form IV Certificate of In principle Approval (Form-II) (New) The industry has submitted form IV vide PIN (Project Identification No. 251152430 application id. 2511890504 dated 20.11.2025 with validity upto 19.05.2029 for the following Acts. 1. Building plan, completion cum occupancy certificate issuance of new trade license under the Punjab Municipal Act, 1911 and the Punjab Municipal Corporation Act, 1976. 2. Building plan and change of land use under the Punjab Regional and Town planning and Development Act, 1995. 3. Provisional Fire no Objection Certificate and Fire no Objection Certificate under the Punjab Fire Prevention and Fire Safety Act, 2004. 4. Factory Building plan and Factory license under the Punjab Factory Rules, 1952. 5. Registration of shop or Establishment under Punjab Shops and Commercial Establishment Act, 1958. The industry has also submitted the Certificate regarding legal source of raw material from Drainage cum Mining and Geology Division, Anandpur Sahib, Water Resources Department, Punjab issued vide No. 10517/Crusher dated 09.12.2025 as per the latest Guidelines issued by the Mines & Geology Department vide order No. E-526419/WR-PROJ/12/2023-PJO/193 dated 15.07.2024. Accordingly, the proposed site was visited by the undersigned on 22.12.2025 and contacted Sh. Sunil Kumar (Representative of the industry). During visit, it was observed that:- • The proposed site is located in village –Nangran Kalmot, Tehsil Nangal District Rupnagar. • The site is in located nearby to M/s Satguru Stone Crusher, Village Nangran (Khera Kalmot), Tehsil Nangal, Distt. Ropar. • The industry is yet to start any construction work at the proposed site. • High tension wires were observed to be crossing the site near it's boundary. It is pertinent to mention here that as per the Govt. of Punjab (STE) Notification no. 3/35/3013- STE (4)/734 dated 30.07.2013 it is mentioned as below: “Stone crushers with crushing capacity up to 10,000 cft/day or with one set of machinery shall be located in a minimum area of 0.4 hectare or 1 acre and the stone crushers with crushing capacity more than 10,000 cft/day or with more than one set of machinery shall be located in a minimum area of 1.5 acre which should be owned by the stone crusher unit or by taking land on lease either owned by the Panchayats or in the private sector.” In this case, the applicant has submitted availability of area of land as 7334.927 (in square meters) i.e. approx. 1.8125 acres in the application form. From above, it is clear that the site is suitable for establishment of Crushing, Screening & Washing unit. In view of the above, if approved, the proposed industry may be granted 'consent to establish' for establishment of Crushing, Screening & Washing of River Bed Material of capacity 10,000 CFT/day for one year with the following additional conditions: 1. The industry will be entirely responsible for earmarking its boundary and installation of plant at the site for which distance certificate and site suitability certificate has been issued by the Revenue Authority and District Town planner respectively. 2. The industry shall obtain written permission w.r.t. capacity of raw material to the effect of 10,000 CFT/day from the mining department before obtaining Consent to Operate of the unit. 3. The industry shall shift the high tension wires outside from the premises of the industry before obtaining 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 from the Board and shall comply with all the guidelines in true letter and spirit. 4. The industry shall comply with the code of practice laid down by the Government of Punjab, Department of Science, Technology & Environment vide order no. 3/35/2013-STE (4)- 734 dated 30.07.2013 and guidelines issued by the CPCB in July, 2023 at all time. 5. The industry shall submit ambient air quality monitoring report from the Boards lab/ approved Boards lab. 6. The industry shall submit approved building plan from DFA/Competent Person and land use certificate from DTP/STP/CTP. 7. The industry shall submit approved layout plan from director of factory before 'CONSENT TO OPERATE' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 8. The industry is responsible for installing the plant at the proposed site for which distance certificate and land use classification has been submitted to DTP. 9. The industry shall provide properly designed sedimentation tank for recirculation of washing effluent. 10. The industry shall not operate its Crushing, Screening & Washing unit without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 11. The industry will not indulge itself into any kind of illegal mining activity & will procure its raw material from sources having authorization of the concerned Mining Department for mining purposes. 12. The unit shall maintain a stock register to justify the legitimate source of mining material, its availability, usage and sale etc. 13. The industry shall comply with the provisions of the Punjab Minor Mineral Concession Rules or any other rules framed there under the Mines and Mineral (Development & Regulation) Act, 1957. 14. The industry has been approved by the Board from pollution angle and does not give right of ownership. 15. The industry shall obtain the statutory clearances / permissions from all other concerned departments. 16. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 17. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received. 18. In case the industry is found involved in illegal mining at any stage or in any FIR or in any of the cases in the court of law, the 'consent to establish' shall be revoked/cancelled under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 without affording any opportunity of hearing. 19. The CTE/NOC is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form and submitted in the office. The Board would be at liberty to cancel the 'CONSENT TO ESTABLISH' /take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 20. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
