File Note: It is intimated that the project proponent has applied for obtaining ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for establishment of a new Residential colony having 375 no. affordable housing plots, EWS Plots @ 48 Numbers/day, Commercial shops @ 10 no. and Community Centre (Having 2596.35 sq. yard) in an area of 17.66 acres, alongwith requisite documents and fees. The project proponent has deposited Rs. 36500/- vide R. no. 89440709 dated 17.12.2025 including application form fee, against the cost of the project of Rs. 26.75 Cr. (as per project report and application form). The NOC fees deposited by the project proponent is adequate for 01 year. Suitability of Site: The project proponent has submitted a copy of approved layout plan digital signed by Competent Authority Sh. Tejpreet Singh Wasu. Also, the project proponent has submitted a copy of License to develop a project/colony issued by Office to The Competent Authority (Under PAPRA Act,1995)- Cum Additional Deputy Commissioner (Urban Development), SAS Nagar vide letter no. LDC/CA-ADC(UD)/2024/41 dated 20.06.2025 for developing land into Affordable Residential Plotted Colony name and style of “Aura Nest” on an area of 85 Bigha 10 Biswa 07 Biswasi or (17.669 Acre) at Village Dandrala, Tehsil Derabassi, Distt. SAS Nagar, saleable area in the colony shall be 48354.63 sq. yds, (57.46%), having validity upto 19.06.2030, which confirms the compliance of project site to zoning regulation as per Master Plan. Water Pollution: The project proponent has proposed for establishment of a new Residential colony having 375 no. affordable housing plots, EWS Plots @ 48 Numbers/day, Commercial shops @ 10 no. and Community Centre (Having 2596.35 sq. yard) in an area of 17.66 acres. The population estimation, wastewater calculation and water balance submitted by the project proponent is as under: As per the proposal, the project will be disposing 236.1 KLD of treated wastewater onto MC sewer, which is available at the distance of around 400 mtr from the site. The project proponent has submitted a copy of Municipal Council, Derabassi vide no. 2108 dated 21.07.2025 is reproduced as under: As such, the project has obtained the approval from the MC Derabassi and further submitted that the project will lay the sewer line till the connecting point of MC sewer incase the sewer connectivity is not available to the project at the time of ‘Consent to Operate’. Air Pollution: The industry has proposed to install one no. DG of capacity 250 KVA, which is provided with canopy and adequate stack height. Applicability of EIA notification dated 14.09.2006: The project proponent has proposed to develop for establishment of a new Residential colony having 375 no. affordable housing plots, EWS Plots @ 48 Numbers/day, Commercial shops @ 10 no. and Community Centre (Having 2596.35 sq. yard) in an area of 17.66 acres, which is less than 50 hectares, as such, the project is not covered under schedule 8 (b) of the EIA notification dated 2006. Visit: The site of the project was visited by undersigned on 25.12.2025 and during visit, it was observed that: 1. No building construction has yet been started at the site. 2. The project proponent has initiated the work of construction of internal roads. Pavement of roads is not initiated yet. The laying of sewer pipelines is under progress. 3. There is one industry i.e. AV Forging within the 100 mtr limit of the project, which is engaged in zinc plating, which is air polluting nature. 4. There are further industries such as Pranav Doors, SG Solar and Road Safety, Anju Industries, which are engineering and fabrication units containing no air polluting stack. 5. There is no MAH industry within a radius of 250 mtr. from the proposed site of the project. Thus, the site is suitable as per notification dated 25.07.2008 as amended on 30.10.2009. 6. Further, the project falls in the industrial mix land use within the limits of MC Derabassi. As per Master Plan of the Derabassi, residential projects are allowable in industrial mix land use. Recommendations: In view of above, if may approved, ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, may be granted to the project proponent for one year with usual conditions & with following special conditions: 1. This NOC is valid for establishment of a for establishment of a new Residential colony having 375 no. affordable housing plots, EWS Plots @ 48 Numbers/day, Commercial shops @ 10 no. and Community Centre having 2596.35 sq. yard in an area of 17.66 acres). 2. The project shall provide green belt towards the air polluting industries falling within the 100 mtr of the site as per notification no. 3/6/07-STE (4)/2274 dated 25.07.2008 as amended vide no. 3/6/07-STE (4)/3770 on 30.10.2009. 3. The project is bound to lay the sewer line till the MC sewer incase MC sewer is not available at door or provide the adequate disposal area as per Karnal Technology at the time of obtaining ‘Consent to Operate’. 4. The project proponent shall ensure to install an STP of capacity of 700 KLD and will dispose the treated wastewater into mentioned disposal modes only. 5. The project proponent shall reuse treated wastewater for flushing purpose by providing dual plumbing system in the project and shall use only treated wastewater for the said purpose. The project proponent shall impose a condition in this regard in all the allotment letters/registries to be done in the project. 6. The project proponent shall not carry out construction activity by its self and shall only sell plots to respective owners. 7. The project proponent shall not carry out any activity which is covered under the ambit of EIA notification dated 2006. 8. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water. 9. The project proponent shall not allow any occupancy at its project, without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 10. The project proponent shall be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974, only after accessing the arrangements for disposal of treated effluent at that point of time. PPCB shall not be responsible for any loss (including financial) to the project proponent in this regard, howsoever. 11. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis. 12. The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 13. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem on the nearby residential area. 14. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 15. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 16. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 17. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 18. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form. 19. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 20. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 21. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 22. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris. 23. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 24. The project proponent has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 25. The adequacy/ efficacy of the pollution control arrangements and disposal arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 26. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 27. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 28. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
