Discussed, while processing the case, it has been observed that:
1. Presently, the site of the industry falls in residential zone of Master Plan Khanna.
2. As per section 79 of PRTPD Act, 1995, any activity not conforming with Master Plan, cannot be allowed to be carried out in non-designated zone beyond the limit of 15 years if not extended by the Govt. In case of Khanna, the same has not been extended by the Govt.
3. The Master Plan of Khanna was notified on 07.02.2011 which will remain in force upto 07.02.2031. However, the activity not confirming to Master Plan can be allowed to operate at existing site only for fifteen years i.e. upto 07.02.2026 which is just one month away.
4. As per Boards policy, no new industry of any category shall be allowed in the approved residential area of any town/city of the State of Punjab and no red/orange category of industry shall be given consent to establish within M.C. limits except in the designated industrial area/zone.
5. In present case, neither the site of the industry falls within mixed land use zone nor in designated industrial zone within MC limits as the spot zoning or adjustment of the unit on the basis of report of MC Khanna has not been done by DTP, Ludhiana.
6. The industry is already in process of installing the new boiler of capacity 3000 Kg/hr to be run on PNG by replacing existing boiler of 500 kg/h running on wood pellets which means the steam requirement capacity has been enhanced almost 6 times.
In light of the above, if approved, the applications of renewal of consents to operate under both Acts may be returned in original at this stage with the request to get the site of the industry notified as industrial zone so as to enable the Board to proceed further in the matter.
