It is submitted that the industry is a small-scale Orange Category unit. The brick kiln falls under Category 5.1 as per the new CPCB guidelines vide letter no. CP-18/1/2023-IPC-VI-HO-CPCB-HO dated 12.02.2025. The unit is operating under the name and style of M/s Somnath Laksh Goyal, Village Khandewal, Tehsil Lehragagga, District Sangrur.
Earlier, the unit has obtained consent to establish under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SGR/2025/29846205 dated 03.10.2025 having validity upto 02.10.2026, for manufacturing of Bricks & Tiles @ 25000 Numbers/Day by using clay & Soil @ 70 Metric Tonnes/Day subject to certain conditions as mentioned therein.
Proposal by industry:
Now, the BKO has applied for obtaining fresh Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Bricks & Tiles @ 25,000 Numbers/Day by using Clay & Soil @ 70 Metric Tonnes/Day as raw material and for discharge of domestic effluent @ 0.6 KLD onto land for plantation after passing through septic tank under orange category along with requisite documents.
Fee Details:
The industry has deposited total Rs. 29,000/- vide online Receipt No. 362614685 dated 21.12.2025 under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and Rs. 29,000/- vide online Receipt No. 599005778 dated 21.12.2025 under the provisions of the Air (Prevention and Control of Pollution) Act, 1981. The consent fee deposited by the industry is adequate up to 30.09.2035 under the both acts against the investment of Rs. 47.02 lakh as on 12.12.2025 as per CA certificate submitted by it.
Date of Commissioning:
The BKO has submitted the receipt issued by PSPCL for the fee paid towards the installation of an electricity connection, dated 01.12.2025 and same is considered as date of commissioning..
Completion Certificate:
The BKO has obtained design adequacy-cum-completion certificate from CBRI, Roorkee after conversion to induced draft technology of brick kiln constructed on the basis of high draft technology and completion certificate dated 21.11.2025 issued by CSIR-CBRI, Roorkee.
Site Plan:
The BKO has submitted site plan approved vide dated 23.10.2025 by Er. Lokinder Bansal, Competent Person, Approved under Punjab Factory Act.
Food Supply Certificate:
The BKO has submitted certificate issued by District Controller, Food Supply, Sangrur vide no. SNG/BK/757 dated 10.12.2025 valid upto 31.03.2026.
Board’s Notification:
It is further submitted that vide letter no. SEE(HQ-2)/2018/6383 dated 26/02/2018, the Board has also authorized M/s Team Energy Systems, 286-287, Ecotech-Extn, Near Kasna, Greater Noida-201306 (U.P.) to provide the CBRI developed High Draft Zig-Zag technology to the brick kilns in Punjab subject to the condition that the completion-cum-adequacy certificate shall be issued by CBRI, Roorkee for the purpose of issuance of consent to operate under the Air Act, 1981 by the Board to such brick kilns.
Visit:
Accordingly, the industry was visited by the undersigned of this office on 30.12.2025 and it was observed as under:
1. The kiln was not in operation during visit.
2. The kiln has adopted high draft technology with zig zag pattern of brick laying, for the manufacturing of bricks and has submitted completion certificate issued to it by CSIR-CBRI, Roorkee after conversion to induced draft technology of brick kiln constructed on the basis of high draft technology and completion certificate dated 21.11.2025 issued by CSIR-CBRI, Roorkee.
3. The kiln has stabilized the periphery road / movement area with Keri so as to suppress the dust emission generated during the vehicle movement.
4. The kiln has provided septic tank for the treatment of domestic effluent and after that same is being discharged onto land for plantation.
5. No unauthorized fuel was observed present at the site of the kiln.
6. The pulverized coal was found lying covered in the premises to use the same as fuel in the kiln.
7. The kiln has provided plantation along the boundary wall.
Punjab Pollution Control Board vide office order SEE(HQ-2)/2018/606 dated 18.12.2018 has issued directions as under:
1. The brick kilns which have adopted induced / high draft zig-zag technology certified by Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board are allowed to operate their brick kilns in the State of Punjab. (Category – I)
2. The brick kilns which have adopted induced / high draft zig-zag technology but yet to obtain the completion / adequacy certificate from Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board OR t whom the provisional certificate has been given by the technology provider for making corrective measures, are allowed to operate their brick kilns in the State of Punjab, (Category – II).
3. The consent to operate to above brick kiln owners / brick kiln shall be granted with the following special condition: -
a) Regular consent shall be granted to Category – I brick kilns and consent for shorter period of one year with condition to submit the final completion / adequacy certificate within three months shall be granted to Category-II brick kilns as mentioned above.
b) The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order.
c) The consent is subject to the performance evaluation of new technology adopted by the brick kilns.
Accordingly, the brick Kiln is complying with code of practice prescribed by CPCB vide its letter no. 15770 dated 29.01.2019 and under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981.
Recommendations :
Keeping in view of the above, it is recommended that fresh Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Bricks & Tiles @ 25,000 Numbers/Day by using Clay & Soil @ 70 Metric Tonnes/Day as raw material for discharge of domestic effluent @ 0.6 KLD onto Land for Plantation after passing through septic tank under orange category may be granted upto 30.09.2035 under the both acts, subject to the suitable conditions along with following special condition that:
1. The brick kiln shall display a notice board containing following details at a prominent vigil place within the premises of every brick kiln and submit compliance report immediately:
a) Name of the Brick Kiln with geo-coordinates, Phone Number
b) Type of design of the Brick Kiln-zig-zag/trench/etc.
c) Place of soil mining with geo-coordinates and quantity mined in a Year
d) Total area of brick kiln and brick production/year
e) Green Belt area
f) Groundwater permission
g) Date of issuance of CTE/CTO by SPCBS/PCCs
h) In-charge Regional Office of SPCBs/PCCs
i) Date of last stack monitoring
2. The brick kiln shall comply with the office memorandum issued by MoEF&CC vide O.M no. F.No. IA3-3/45/2021-IAU (E 165219) dated 09.08.2024, as amended from time to time, highlighting the judgement dated 07.03.2024 passed by the Hon'ble High Court of Patna in CWJC no. 11181 of 2021 in the matter titled as Abhay Kumar Vs Union of India & Ors, wherein inter-alia under clause 13 of Appendix IX of the notification dated 28.03.2020 issued by MoEF&CC providing an exemption from the requirement of obtaining Environmental Clearance to such category of cases that are specifically declared by the State Government under legislation or rules as non-mining activity, has been set aside.
3. The brick kiln will comply with the orders of the Hon'ble Punjab & Haryana High Court, Chandigarh from time to time regarding usage of minimum 20% paddy straw pellets as fuel in the brick kiln along with coal.
4. The industry shall comply with the Code of Practice framed for Brick Kilns. The Brick Kiln will ensure the implementation of recommended operating practices as per the feasibility report (SPL 20/1328)
5. The industry will obtain the Environmental Clearance under EIA notification dated 14.09.2006 for mining of brick clay to be used as raw material for the manufacture of bricks.
6. The industry shall comply with the provisions of notification no. S.O. 763(E) dated 14.9.1999 as amended vide notification no. S.O.979 (E) dated 27.8.2003 and its subsequent amendments issued by the Ministry of Environment & Forests, Government of India, New Delhi.
7. The industry shall adopt the code of practice prescribed by CPCB vide its letter no. 15770 dated 29.01.2019 as under;
i. All the moving area around the main Brick Kiln should be paved with the bricks to minimize the fugitive dust emissions from the Brick Kiln operations.
ii. No dust to accumulate all around the Brick kiln.
8. The industry shall comply with the code of practice laid down for brick kilns vide Board's notification no. Admn/A-2/F.No. 178/98/3 dated 02.09.1998 and amended from time to time:
i. Approach road within the premises of brick kiln area should be Pucca / stabilized with brick bats.
ii. They should use crushed coal for better burning efficiency.
iii. Height of chimney stack should be at least 30 Mtrs.
9. The industry shall comply with the recommendations of technology provider as approved by the Board for operating practices to minimize the pollution at source level.
10. The industry shall stack its raw brick for baking in zig-zag pattern as recommended by the technology provider as approved by the Board.
11. The industry shall clean the air pollution control system at regular intervals.
12. The industry shall get its Firemen and Mistries trained from technology provider as approved by the Board for better feeding and firing so as to reduce the pollution.
13. The industry shall get its emissions analyzed from laboratory approved by the Board / Board’s approved lab/NABL approved laboratory twice in a year/kiln season and shall submit the analysis report to the Board.
14. The industry shall put up display board indicating environment data at the main entrance gate.
15. The BKO shall also obtain NOC/permission from the other Govt. Department, if need be.
16. The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc, and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.
