File Note: Kindly peruse the note of AEE dated 24.12.2025 & 31.12.2025…………. • It is submitted that the Project proponent was earlier granted Consent to Establish (NOC) on 03.11.2022 valid upto 02.11.2023 for development of Residential colony in the name of 'Ananda City' having 206 no. Residential Plots, 26 no. Commercial Plots, 55 no. EWS Plots & 01 no. Hotel for disposal of domestic effluent @ 145 KL/day onto land for plantation after treatment in STP, which was further extended upto 31.07.2025……………………… • Now, the Project proponent has applied for fresh consents to operate under the Water Act, 1974 & Air Act, 1981 through OCMMS on 23.12.2025……………… • The site of project was visited by AEE of RO, BTI on 23.12.2025 and it was observed as under: 1. The PP has developed roads, parks, parking spaces as well as STP in the colony………………………. 2. There are 206 no. Residential Plots, 26 no. Commercial Plots, 55 no. EWS Plots & 01 plot for hotel. However, only 25 Residential Plots and 15 Commercial Plots have been constructed & occupied. No construction activity has been started for proposed EWS plots as well as proposed hotel ……………….. 3. The project proponent has installed STP of capacity 200 KLD for treatment of domestic effluent being generated inside the premises. Treated effluent is partially reused for flushing and partial onto land for planation/green area inside the premises……….. 4. During visit, aeration of STP was operational but no effluent was being discharged from outlet of STP due to less effluent into collection tank of STP ………………….. 5. The PP has provided separate flow meters at outlet of STP leading to gardening as well as flushing. The PP is maintaining record of effluent treated as well as effluent reused for flushing & gardening………………….. 6. As per record maintained by PP, the present average discharge of colony is about 21 KLD. The average discharge for plantation is 15 KLD and for dual plumbing is about 6 KLD………………. 7. The PP has developed 6054 sq yards area as parks as per approved layout plan. Other than this dedicated green area, the PP has also provided plantation along all roads of the colony and has also provided outlets of treated effluent at various locations. The plantation / gardening area provided by the colony is adequate to manage the present discharge…………………… 8. The project proponent has constructed compost pits inside the colony for the management of wet waste and dry solid waste is being lifted to the authorized vendor of MCB……………………. 9. The PP has submitted copy of lay out plan approved by Senior Town Planner, Local Govt., Punjab. As per the approved building plan, saleable area of commercial plots including hotel is 5741.69 sq yards, saleable area of residential plots is 56264 sq yards and area reserved for EWS is 6045 sq yards, hence the entire saleable area is 68050 sq yards = 56898.5 sq meter. Hence, total built up area of entire project considering maximum FAR of 2.1 is 56898.5X2.1=119486.85 sq.meter, which is less than 1,50,000 sq meter. Hence, the project is not covered under the ambit of EIA notification 2006……………. 10. The project proponent has submitted copy of LOI issued by MC, Bathinda vide no. no. 02/2022 dt. 28.06.2022 for development of residential colony…………. 11. The PP is complying with the special conditions imposed while granting NOC to it……. • It is further submitted that the PP has already obtained CLU vide memo no. PB/CLU/BTI/BATHI/1167 dt. 2012.2021 from Department of Local Govt., Punjab for residential plots in an area of 101204 sq.meters (25 acres). As per said permission, the site falls in residential zone of notified master plan of Bathinda………….. • RO has reported that the project proponent is complying with the provisions of the Water Act, 1974 and Air Act, 1981 and recommended for grant of consents to operate under the Water Act, 1974 and Air Act, 1981. Keeping in view of above and recommendation of RO, if approved, partial consents to operate under Water Act, 1974 & Air Act, 1981 may be granted to the project proponent for a period upto 30.09.2030 for operation of 25 no. Residential houses and 15 no. Commercial shops with following special conditions that:- 1. The total built-up area of the project will not exceed 1,50,000 sq.m in any case. The project proponent shall be bound to obtain environmental clearance under EIA notification dated 14.09.2006 in case the built-up area of the project increases above 1,50,000 sq. meters.…….…………….. 2. The project proponent is bound to comply with the decisions of MOEF&CC w.r.t. clarification raised by the Board vide letter no. 10949 dated 09.05.2023…………………… 3. The Punjab Pollution Control Board is not responsible for any lose if the project covered under the ambient of EIA notification, 2006………………………… 4. The project proponent shall operate the STP regularly & efficiently so as to achieve the prescribed standards…………. 5. The project proponent shall install water meter and energy meter for STP and maintain record of STP operation on daily basis……….. 6. This consent to operate is being granted for operation of 25 residential houses and 15 commercial shops only. The project proponent shall obtain varied consent to operate if the occupancy in the colony increases from the consented occupancy ……………. 7. The Project Proponent shall make additional arrangements for disposal of treated effluent if the occupancy increases from the consented occupancy……….. 8. The Project Proponent shall develop the project as area development project and in no case the PP will develop the project as building construction project by making construction on the individual plots without prior permission from the Board……….. 9. The Project Proponent will not allow any shop owners to set-up any restaurant/ eateries/ food court in the project and shall be bound to make this condition as the part of the allotment letter/ sale deed to the owner of the individual plots…………… 10. In case any individual shop owner proposes to establish any restaurant/ eateries/ food court Project Proponent shall be liable to amend the Project proposal and shall obtain revised permissions from the Board to install STP of adequate capacity…………. 11. The project proponent shall utilize all treated effluent inside the premises for flushing through double plumbing, construction work, roadside sprinkling, gardening, plantation etc.… 12. The project proponent shall not use fresh water in the green area/ plantation area and will make adequate arrangements to reuse the treated effluent by providing permanent pipeline for discharge of treated effluent from outlet of STP to the plantation area…………… 13. The project proponent shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it………. 14. The project proponent shall provide water meter at fresh water supply and shall maintain its record on daily basis………… 15. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016……. 16. The project proponent shall also develop the vermi-composting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies…….. 17. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic……….. 18. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises………. 19. This consent to operate is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required……………..
