• It is submitted that the agency alongwith service station was in operation without obtaining NOC / consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981…………………
• Accordingly, various opportunities of personal hearings were given to the PP before the Competent Authority. Recently the PP was given an opportunity of personal hearing before Chief Environmental Engineer (B) of the Board on 26.08.2025, wherein it was decided as under:-
1. The agency shall remove all the violations observed by the officer of the Board during visit. to the agency on 11.07.2025, within one month……………..
2. The agency shall submit a bank guarantee of Rs. 5.0 lacs (minimum validity for a period of one year) within one week as an assurance for not to operate the washing section of the agency without providing adequate treatment facility & obtaining consents of the Board and to comply with the provisions of Water Act, 1974 & Air Act, 1981, the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and / or any other environmental law applicable to it from time to time…………….
3. The agency shall not operate the washing section without providing adequate treatment facility & obtaining consents of the Board…………….
4. The Regional Office, Bathinda shall seal the washing section of the agency, immediately…………….
5. The agency shall provide dedicated room for storage of hazardous waste with lock & key arrangement and provide danger sign board outside the room………….
6. The agency shall maintain category wise proper record of hazardous waste generation & its disposal…………..
7. The agency shall apply for obtaining consents to operate under Water Act, 1974 & Air Act, 1981 and authorization under Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016, within 15 days………………
8. During hearing, it has been made clear to the representatives of the agency that in case of non-compliance of decisions of the hearing within stipulated period or if any violation(s) observed under the provisions of the Water Act, 1974 & Air Act, 1981 and Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 in future, further action as deemed fit shall be initiated by the Board under the said Acts/Rules without any further notice/opportunity.……………
• In compliance of decision no. 4, washing section of the industry was sealed by RO, Bathinda on 08.10.2025………………………
• Now the agency has applied for fresh consents to operate under the Water Act, 1974 & Air Act, 1981 for repair & washing of cars @ 10 number/day for disposal of treated effluent @8.5 KLD onto land for Plantation……………….
• The agency has submitted site suitability certificate from MC, Bathinda vide no. 828/MTP dt. 08.11.2024 according to which, as per notified master plan of Bathinda, the site falls in warehousing/Godowns/Logistics (Industrial) area, where Light Motor Vehicle (LMV) Automobile Showroom and Their Workshops Including Painting and Washing are allowed to establish. Hence, as per letter dated 08.11.2024, the site is suitable for establishment of agency alongwith workshop………….
• The agency has submitted approved site plan from MC, Bathinda…….
• In compliance of hearing decision, the agency has also submitted bank guarantee of Rs. 5 Lakh vide no. 5014425BG0Y00073 dt. 20.11.2025 which is valid upto 20.11.2026.
• The agency was visited by AEE of RO, BTI on 17.12.2025 and it was observed as under:-
1. The unit is an authorized agency as well as service station of Volkswagon cars……..
2. The showroom was in operation during the visit. However, the washing section was not in operation due to seals provided by the Board. The seals in washing section were found as intact……….
3. The agency has installed ETP for treatment of trade effluent generated from washing section. All the components of ETP were in line but ETP was not in operation as the washing section was lying sealed……….
4. The agency has made an arrangement to discharge the treated effluent onto land for plantation backside the agency premises. The plantation provided by the agency is principally adequate to manage the quantum of discharge i.e. 8.5 KLD………
5. The agency has provided dedicated room for storage of hazardous waste with lock & key arrangement and provide danger sign board outside the room………
6. The agency has one paint booth with inbuilt filters……..
7. The agency has installed one DG set of capacity 125 KVA with canopy and adequate stack height……..
• RO has reported that the agency is now complying with the provisions of the Water Act, 1974 and Air Act, 1981 and recommended for grant of consents to operate and de-sealing of washing section……….….
Keeping in view of above and recommendations of RO, if approved, following actions may be taken please;
• RO may be allowed to de-seal the washing section of the agency……….
• Consents to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the agency upto 30.09.2026 for repair & washing of cars @ 10 number/day for disposal of treated effluent @8.5 KLD onto land for plantation with suitable conditions: -
1. The service station apply for authorization under HOWM Rules, 2016, within 7 days……….
2. The service station shall operate the ETP regularly & efficiently so as to achieve the prescribed standards………
3. The service station shall provide water meter at inlet as well as outlet of ETP and shall provide separate energy meter with ETP………….
4. The service station shall maintain record of ETP operation w.r.t. water & energy meter readings, chemical consumption etc………….
5. The service station shall keep the plantation area in healthy condition at all times for disposal of treated trade as well as domestic effluent ……………
6. The service station shall obtain permission from Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it …………….
7. The service station shall install water meter at fresh water supply and shall maintain its record on daily basis………….
8. The consent to operate is granted by the Board from the pollution angle only. The service station is bound to obtain necessary statutory clearances from other concerned departments, as required……………
9. The service station shall ensure that there is no pollution/nuisance in the vicinity with operation of the unit……………
10. The agency shall provide dedicated room for storage of hazardous waste with lock & key arrangement and provide danger sign board outside the room as per hazardous waste as per provisions of Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016……………..
11. The agency shall make an agreement(s) with authorized recycler(s) for disposal of hazardous wastes…………..
12. The agency shall maintain category wise proper record of hazardous waste generation & its disposal…………
13. The Environmental Engineer, Regional Office, Bathinda shall collect the effluent sample from ETP after operation of the washing section and shall submit report with conclusive recommendations in the matter……….
