File Note: Kindly peruse the note of EE, ZO. On perusal of the facts mentioned therein and the reply received from the Regional Office, it is submitted that the industry is a small scale Red category unit. Earlier, directions under Section 33-A of the Water (Prevention and Control of Pollution) Act, 1974 were issued to the industry vide Memo No. 5486-87 dated 18.11.2025 for disconnection of electricity supply and sealing of the wet process and trade effluent generating activities. In compliance thereof, the wet process area of the industry was sealed during inspection, and the Punjab State Power Corporation Limited disconnected the electricity supply vide TDCO No. 93/103 dated 19.12.2025. Now, the industry has applied for fresh Consent to Operate under the Water Act, 1974 along with the requisite documents. As reported by the Regional Office, the industry was found complying with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has submitted a building plan duly approved by an Architect from the Director of Factories, Punjab. Regarding site suitability, the site of the industry falls in Industrial Area-C as per the relevant khasra numbers mentioned in the Gazette Notification. It is further submitted that vide Office Memorandum No. 428 dated 23.09.2025, the Board, among other decisions, has resolved that the Bank Guarantee may be returned and or permanent restoration may be allowed on compliance of specified violations or submission of requisite documents based on a single site visit, subject to the decision of the Competent Authority. Further, while processing the consent application No. 27057285 of M s Kalsi Sons Fabricators, the Worthy Chairman of the Board approved imposition of Environmental Compensation amounting to Rs. 1.0 lakh for small scale industries vide note dated 11.10.2024. As the industry has complied with the earlier violations, in view of the above facts and the Office Memorandum, it is recommended that Environmental Compensation amounting to Rs. 1.0 lakh may be imposed upon the industry, being a small scale unit, as approved by the Competent Authority in the case of M s Kalsi Sons Fabricators. Consent to Operate under the Water (Prevention and Control of Pollution) Act, 1974 may be granted up to 30.06.2027. Competency Senior Environmental Engineer. Punjab State Power Corporation Limited may be directed to permanently restore the electricity connection of the industry after deposition of the Environmental Compensation by the unit.
