File Note: Kindly peruse the report of RO………. • It is submitted that the project proponent has applied for obtaining consent to establish/NOC for establishment of HPCL housing complex in an area of 2 Acres……………….. • The project proponent has proposed to construct one G+12 floor tower consisting of 48 flats and one club house inside the entire premises………………… • The PP has submitted letter from BDA vide letter no. 7016 dt. 07.12.2015 regarding allotment of land at Urban estate, Phase 3 for the construction of housing complex………. • The PP has submitted copy of the approved layout plan signed by District Town Planner Bathinda as per which total proposed built-up area is 13,227.693 sqm, hence is not covered under EIA notification 2006…………. • The project proponent has proposed to install STP of capacity 40 KLD for the treatment of proposed domestic effluent @ 31 KLD. The project proponent has proposed to utilize part of the treated effluent for flushing through dual plumbing, some treated effluent into green area and remaining treated effluent shall be discharged into MC sewer………….. • The project proponent has submitted copy of permission obtained from EXECUTIVE ENGINEER, W/S & SANITATION DIVISION NO.3, BATHINDA vide letter no. 7603 dated 04.11.2025 for sewerage connection for HPCL Rental Housing Site at Urban Estate Phase 3, (Part 2) Bathinda (Punjab)…………… • The site of the project was visited by AEE of this office on 12.11.2025 and it was observed as under: - 1. The site is a vacant plot with already constructed boundary walls; no construction activity is started at site………. 2. There is no air pollution industry in 100-meter radius, MAH within 250-meter radius of the proposed colony……………………….. • RO has reported that site is suitable for the establishment of residential project and has recommended for grant of consent to establish (NOC) for 2 years……… • It is further submitted that the PP has not submitted classification of land as per notified Master Plan of Bathinda. The project proponent has also not submitted any document / permission from the concerned department regarding surplus capacity of terminal STP to handle the wastewater of colony. Accordingly, the PP was issued show cause notice for refusal of consent to establish (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981, to submit reply within 7 days………. • The PP has submitted reply on 26.12.2025 which has been examined by RO and it has been reported that :- 1. As per letter no. 1916 dated 19.12.2025, issued by DTP(P), Bathinda, the site of project falls in residential zone (RD1) as per notified Master Plan, Bathinda. Hence, the site is suitable for establishment of residential complex…………… 2. The PP has not yet submitted permission from the concerned department regarding surplus capacity of terminal STP to handle the wastewater of colony. However, the project proponent has proposed to utilize the entire treated wastewater within the premises…………………. 3. As per proposal, total wastewater generation will be 31 KLD and the project proponent has proposed to install STP of capacity 40 KLD………….. 4. 12 KLD treated effluent will be reused for flushing through dual plumbing and 19 KLD treated effluent will be used for plantation (as per Karnal Technology) in approximate 1200 sq.m area inside the premises……………… • RO has reported that the revised proposal regarding effluent treatment & disposal is principally adequate and has recommended for grant of NOC for 02 years…………… • It is further added that the site is suitable as per DTP certificate and the PP has already approved its layout plan from Competent Authority. As per approved layout plan, total built-up area of the project is 13,227.693 sqm, hence the project is not covered under the ambit of EIA notification 2006. Moreover, the PP has submitted revised proposal regarding effluent treatment & disposal, which is principally adequate …………. Keeping in view of above and recommendations of RO, if approved Consent to establish (NOC) may be granted to the PP for construction of housing complex in an area of 2 acres for disposal of treated effluent @ 31 KLD (utilization for flushing @ 12 KLD and for plantation @19 KLD) with validity for 02 years, with following special conditions: - 1. The Project Proponent shall not increase the built-up area more than 20,000 square meter in any case. The project proponent is bound to obtain prior environmental clearance under EIA notification dated 14.09.2006 in case the built-up area of the project increases 20,000 sq. meters………….. 2. The Consent to Establish (NOC) is being granted for the development of the residential project in 2 Acres land allotted by BDA vide letter no. 7016 dt. 07.12.2015 at Urban estate, Phase 3, Bathinda…………… 3. The project proponent is bound to comply with all terms & conditions imposed by BDA Bathinda ………….. 4. The project proponent shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it……….. 5. The project proponent shall install water meter at source of fresh water supply and shall maintain its record on daily basis…………… 6. The project proponent shall install STP of adequate capacity as proposed, for treatment of domestic effluent……… 7. The project proponent shall utilize all the treated effluent inside the premises for flushing through double plumbing, construction work, roadside sprinkling, gardening, plantation etc…………….. 8. The project proponent shall not use fresh water in the green area/ plantation area and will make adequate arrangements by providing permanent pipe network to reuse the treated effluent for watering of green areas in the project premises…………… 9. The project proponent will ensure that the municipal solid waste generated from the complex is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016……….…. 10. The project proponent shall develop the vermi-composting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies…….. 11. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic……….. 12. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises………. 13. This consent to establish is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required……………..
