Earlier History Under Air Act, 1981
The BKO falls under the orange category. The brick kiln was earlier granted 'Consent to Operate' under Air (Prevention & Control of Pollution) Act, vide no. CTOA/Renewal/LDH1/2023/24235492 dated 12.01.2021 valid upto 30.09.2029 for manufacturing of Bricks & Tiles @ 5000000 Nmber/Year.
Present under Water Act, 1974
Now the brick kiln has applied fresh of 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1976 for manufacturing of Bricks & Tiles @ 5000000 Nmber/Year.
1. The Brick Kiln is an existing unit Since March, 1981.
2. The kiln has provided induced draft technology with Zig-Zag firing.
3. Earlier record shows that the brick kiln has submitted completion certificate issued by CSIR-CBRI, Roorkee dated 27.09.2023.
4. The brick kiln has submitted DTP, Ludhiana letter no. 739 dated 11.03.2014 as per which the subject cited brick kiln is allowed to continue operation at the existing location till the Master Plan, Ludhiana, (2007-2031).
5. As per the CA certificate the total cost of the project is 24.61 lac. The subject cited brick kiln has deposited adequate consent fee i.e. Rs. 32900/-under Water Act, 1974 vide R.no. 56811695 (Rs. 18500/-) and vide r no. 504143454 (14400/-) dated 21.11.2023 and 02.12.2025 same is valid up to 31.12.2029.
To verify the application the unit was visited by the officer of this on 29.12.2025 and it was observed as under:-
1. The Brick Kiln was in operation and was using pulverized coal as fuel in its operations.
2. There is only generation of domestic effluent @ 0.8 KLD and same is discharged onto land for plantation after septic tank.
3. The BKO has provided the display board in compliance to Hon’ble National Green Tribunal (NGT) order dated 25.02.2025 in OA no. 359/2022 in the matter of Rafhat Naeem Siddiqui Vs state of UP & Ors.
4. The Brick Kiln is complying with the Code of Practice Prescribed for Brick Kilns.
5. The industry has already submitted reply to the clarification regarding mining license as per order of Hon’ble High court of Patna order in CWJC 11181 OF 2011 DATE 07.03.2024.
Keeping in view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to Brick Kiln upto 30.09.2029 with usual conditions and special conditions that:-
1. The BKO will comply with all the code of practice prescribed by the Board for Brick kilns all times.
