A. It is submitted that the subject cited BKO is small scale Orange (2020-Brickfields (excluding fly ash brick manufacturing using lime process) category. The brick kiln was granted ‘Consent to Operate’ under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH4/2020/12917254 dated 10.07.2020, which were valid upto 30.06.2025 for operation of brick kiln based on IDBK technology to manufacture Bricks/tiles @ 5000000 Number/Day subject to certain conditions.
B. Now, the brick kiln has applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 through OCMMS for operation of brick kiln to manufacture Bricks and tiles @ 5000000 Number/Day.
C. The brick kiln has deposited consent fee Rs. 9106/- vide R No. 887583622 dated 01.12.2025 the Air Act, 1981, which is adequate upto 30.09.2029 (after deducting penalty).
D. Accordingly, the brick kiln was already visited by the officer of this office on 01.01.2026 and it was observed that: -
1. The brick kiln was in operation during visit.
2. The brick kiln has adopted induced draft zig-zag technology as per the completion drawing submitted by it.
3. The brick kiln was found using crushed coal during the visit.
4. The brick kiln has provided soakage pits for disposal of its domestic effluent.
5. The brick kiln has not provided adequate plantation area around the BKO.
6. There are no pathways inside the BKO for movement of labour and materials.
7. The BKO has not provided adequate sampling arrangement.
8. The BKO has not obtained consent to operate under Water Act, 1974 till date.
As such the brick kiln is not complying with the provisions of the Water Act, 1974 and Air Act, 1981 and also not complying with the code of practice for such type unit.
Keeping in view of the above, it is recommended as under that Consent to operate under the Air Act, 1981 be refused alongwith show cause notice for violation of provision of Water Act, 1974 may be issued to the industry.
