It is submitted that the industry a small scale green category unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renew/LDH2/2023/23615948 dated 29/09/2023 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renew/LDH2/2023/23615946 dated 29/09/2023 both valid upto 31/12/2025 for manufacturing of Expeller Spare Parts @ 25 No.s/day.
Now, the industry has increased its production capacity from Expeller Spare Parts @ 25 No.s/day to 27 No.s/day as well as raw material from MS Round @ 500 Kgs/day to @ 600 Kgs/day by increasing the working hours.
Accordingly, it has applied for varied 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along-with requisite documents through OCMMS. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 4.03 Lacs as on 31/03/2025 as per CA Certificate dated 23/12/2025, which is adequate upto 31/12/2030 as per Board's Office Order dated 29/10/2018.
Accordingly, the industry was visited by the AEE of this office on 31/12/2025. During the visit, it was observed as under:
1. The industry was in operation during visit.
2. It is engaged in manufacturing of Expeller Spare Parts @ 27 No.s/day by using raw material as MS Round @ 600 Kgs/day.
3. The industry has installed 02 lathe machines, 01 shaper machine, 02 drill machine, 01 cutting machine and 01 hacksaw.
4. There is no generation of trade effluent & domestic effluent is being discharged into sewer.
5. The industry has not installed any DG set.
6. The industry has submitted building plan approved from competent person Er. Santokh approved under Factories Act, 1948.
7. The industry was complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The site of the industry falls in Industrial Mix Zone as per Approved Master Plan of Ludhiana (2007-31) as per DTP, Ludhiana letter No. 2729/DTP(L)M2A dated 07.12.2022 submitted with the consent application.
In light of Clarification given by the DTP, Ludhiana, the industries located in Industrial mix Zone, which has now become conformity zone as per Govt. notification. In light of this notification/clarification board has decided to Grant the further consents as per policy of the Board as conveyed vide this office letter No. 610-12 dated 31.08.2023.
In the subject cited case, the industry has mentioned ground water extraction @ 1.0 KLD. Considering 25 working days per month, ground water extraction will be 25 KL/month, which is less than 300 KL/month.
It is therefore recommended that varied 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 10.09.2026 (as the industry falls in mixed land use area and it is permitted by Deptt. of Housing & Urban Development vide letter no. 08/05/2023-4HI/2208 dated 06.10.2023 to run the existing industries till 10.09.2026) with suitable conditions as per policy of the Board:
1. The industry shall shift its industrial unit in designated industrial area/zone in compliance of sitting guidelines of notified Master Plan, Ludhiana.
2. The industry shall comply with the Noise (Pollution and Control) Rules, 2000 at all time.
