File Note: RO has reported that the project proponent has applied for obtaining consent to establish (NOC) under orange category for commercial shops @ 59, Food Court @ 1, Entertainment & Gamming Zone @ 1, Studio apartment @ 13, Restaurant & Dining @ 2 alongwith requisite documents. The project proponent has deposited Rs. 22100/- vide UTR no. 821677018 dated 03.05.2025 as consent to establish (NOC) fee and application form fee. The fee deposited by the PP is adequate for one year against the total proposed cost of the project Rs. 1460.00 lacs. The PP has submitted approved layout plan from STP Jalandhar dated 26.11.2024, project report, feasibility report. The project proponent has attached layout plan approved for 59 shops with 29 shops on ground floor and 30 shops on first floor alongwith 13 no. studio apartments only, whereas the additional 02 no. restaurant and dining, 01 no. food court and 01 no. entertainment and gaming is not a part of approved layout plan. The project proponent has submitted LOI for setting up commercial colony “ North Wood” (Area 3.025 acres) situated at village Chak Mander (H.B no. 10) Tehsil Banga, Distt SBS Nagar issued by Chief Administrator, Glada, Ludhiana vide no.12 dated 03.01.2025. The project proponent has submitted partnership deed executed on 11.10.2023. The PP has submitted feasibility report regarding installation of STP of capacity 50 KLD based on MBBR Technology. The total water requirement of the project will be 30 KLD. Total wastewater generation of the project will be 26 KLD and treated wastewater generation will be 25 KLD. The PP has considered water consumption for the studio apartments as 40 LPCD considering 02 person per apartment, which is not appropriate as per national building code. After treatment the treated waste water will be discharged onto land for plantation, however, PP has not clarified the season wise disposal details and neither mentioned about the plantation area details in the application form. The approved map attached by PP only mentions about providing planting 40 no. trees within the project, which will not be adequate for the utilization of 25 KLD of treated effluent. The PP has proposed dual plumbing as an alternate arrangement for the utilization of around 40% of effluent i.e. 10 KLD, whereas has not proposed ultra filtration of RO in the feasibility report. The PP has proposed that remaining 60% effluent (15 KLD) will be disposed of onto land for plantation in an area of 0.5 acre in the feasibility report, however, as per green area chart, the green area is only 1237 sq.mtr, which is not adequate as per various seasons considering summer, winter and rainy season. The maximum treated waste water that can be utilized during rainy season is less than 1 KLD and 6.5 KLD during the summer season. The PP has proposed composter for the in-situ management of the solid waste (Bio degradable and non bio degradable). The proposed site of the project was visited by RO on 22.12.2025 and during visit and contacted Sh. Rahul Bajaj (partner) and it was observed as under: 1. The project is a commercial SCO’s project with 29 no. SCOs on ground floor with 02 no. drive through. 2. The construction activity of 22 no SCO’s 1st floor slab has been completed. The foundation work of remaining 7 no. SCO’s is under process. 3. The project proponent has not provided any occupancy of project as of now. 4. The project proponent has provided collection tank of RCC provided with 20ft by 14ft dimensions. However no treatment component provided. 5. The collection tank being utilized by the labour residing at site with temporary hutments around 40-50 in number. The effluent from collection tank is being disposed off to an unknown location. 6. No High Tension wires are crossing the site. in view of above the PP is violating the various provisions of the Water Act, 1974 and Air Act, 1981. if approved, Show cause notice without hearing for refusal of consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be issued to the project proponent with an opportunity to file the objections within 7-days.
