File Note: A. It is submitted that the industry is a small scale red category unit. B. Earlier the industry was running by the name of M/s Aura Auto Forge, E-355, phase-6 and the industry was a small scale red category industry and the industry was granted CTO under Water Act, 1974 & Air Act, 1981 which was valid upto 30.06.2020. Now, As per the list provided by CETP electroplating, the industry was not lifting its trade effluent to JBR CETP, Ludhiana. To verify the same, the industry was visited by the officer of this office on 27.08.2025 and it was found that the industry is now shifted to the adjacent plot (E-353, phase-6) and operations performed in the industry falls in green category. The industry was running without the valid consent of the board and accordingly, SCN with opportunity to reply within 7 days was issued to the industry. Further, new industry has set up as M/s Flying International, E-355, Phase-6, Focal Point, Ludhiana the observations made during the visit on 27.08.2025 are as under: 1. The industry was in operation and was running its unit on the new name of M/s Flying International. 2. The industry has installed 5 CNC machines, 4 (+3 standby) Mechanical presses, 1 welding machine and 2 cutters. The industry is also engaged in the process of phosphating of auto parts. 3. The industry has made agreement with M/s JBR Technologies Pvt. Ltd CETP, Focal Point, Ludhiana @ 2000 ltr/month for lifting of trade effluent by the name of M/s Flying International. 4. The industry has installed water meter in the work area and reading of the same was 56.00 kl during the visit. The industry is maintaining record of fresh water consumption as well as effluent lifting and the record was found in order. 5. The industry has installed a storage tank of capacity 2000 ltr capacity and around 1800 ltr was lying stored in the tank. 6. The industry is running its operation without the valid consent of the board. C. Accordingly, the industry was issued show cause notice for violation of the provisions of the Water Act, 1974 and Air Act, 1981 with opportunity of personal hearing before the SEE, ZO-2, Ludhiana on 16.10.2025, wherein it was decided as under:- 1. The industry shall prepare a revised lifting schedule with the CETP operator and to ensure that the lifting shall be made atleast 2-3 times in a month. 2. The industry shall install CCTV cameras with 30 days backup within 15 days, facing towards a) entry gate of processing shed b) flow meter provided on freshwater supply provided for processing activities c) effluent storage tanks d) any other suitable point deemed fit to ensure that whole of the water consumed is metered and whole of the trade effluent is lifted to CETP operator metered and whole of the trade effluent is lifted to CETP operator. The industry shall maintain in-house monitoring mechanism through mobile phone/ office screen for visualizing the above CCTV cameras so as to ensure that no intentional or unintentional lapse happens and no untreated effluent is bye-passed. 3. The industry shall ensure that there is no unauthorized mode of wastewater disposal. The industry shall ensure that there is only a single fresh water supply for the industry and meters shall be provided for the water being used for process. 4. The industry shall maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. 5. The record shall be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally and action as deemed fit shall be taken in accordance with law. 6. The industry shall apply for consents to operate under the Water Act, 1974 and the Air Act, 1981, within 15 days. 7. The Environmental Engineer, Regional Office-4, Ludhiana shall visit the industry to verify contentions of the industry, carry out audit of the waste water generation, submit compliances with respect to the decisions alongwith fresh recommendations and process consent applications on merit. D. In compliance of the above decisions the industry was visited by the officer of this office on 12.12.2025 and observations made during the visit are as under: 1. The industry was in operation during visit. 2. The industry was engaged in manufacturing of auto parts and also engaged in phosphating process. 3. The industry has installed 05 CNC machines, 07 mechanical press (3 stand by), 01 welding set, 02 cutters, 02 dhol, and 01 shot blast with APCD. 4. The industry has installed water meter for fresh water consumption, the reading during visit was 0063.8 KL. 5. The industry is maintaining the record of fresh water consumption and trade effluent lifted. The industry has consumed 12.95 KL of fresh water from June to the date of visit and lifted 12 KL (June: 2 KL, July: 2 KL, August: 2 KL, September: 2 KL, October: 2 KL, November: 2 KL) of trade effluent during this period to JBR CETP, Ludhiana. 2000 ltr was lying stored during the visit. The record was not in order. 6. The industry has installed 01 collection tanks of 2000 liters which was found completely full during visit. As such the industry is violating the provisions of Water Act, 1974 and Air Act, 1981 and is operating its unit without valid consents of the board. E. The report of the same has been sent through e-note no. 29658011 and further action is under process. F. Now, the industry has applied for Consent to Operate under the Water Act, 1974 and Air Act, 1981 through OCMMS for manufacturing of Auto Parts @ 1 TPD by installing 01 no. Shot blast machine alongwith bag filter as APCD and for discharge of domestic effluent @ 0.45 KLD into sewer and trade effluent @ 0.08 KLD lifted by the CETP operator. G. The industry has deposited CTO fee of amounting to Rs. 45500/- vide R.no. 40452455 dated 27.12.2025 under the Water Act, 1974 and Rs. 37800/- vide R.no. 40452455 dated 27.12.2025 under the Air Act, 1981, which is adequate upto 30.04.2029 against the gross fixed assets of Rs. 86.65 Lacs and plant & machinery of Rs. 59.55 Lacs as per CA certificate dated 17.06.2025. H. Now the industry was visited by the officer of this office on 30.12.2025 and it was observed as under:- 1. The industry was in operation during visit. 2. The industry was engaged in manufacturing of auto parts and also engaged in phosphating process. 3. The industry has installed 01 no. shot blast machine with inbuilt bag house filter as APCD. 4. The industry has installed 05 CNC machines, 07 mechanical press (3 stand by), 01 welding set, 02 cutters and 02 dhol. 5. The industry has installed water meter for fresh water consumption, the reading during visit was 65.01 KL. 6. The industry has made an agreement with the CETP operator (M/s JBR Technologies Pvt. Ltd., Phase-8, Focal Point, Ludhiana) @ 2000 Ltr/month for lifting of trade effluent. 7. The industry has installed 01 collection tanks of 4000 litters and approximately 3500 ltr. Of effluent was lying stored during visit. 8. The industry is maintaining the record of fresh water consumption and trade effluent lifted. As per record, the reading on 27.08.2025 was 56.00 KL and during visit 65.01 KL and opening balance was 1800 Ltr. As such, the industry has consumed 9.01 KL of fresh water and lifted out 10 KL of trade effluent during this period to JBR CETP, Ludhiana. The record was not in order. 9. The industry has submitted building plan approved by the Competent Person. 10. The industry has submitted Rent agreement as a proof of date of commissioning i.e. 01.02.2025. 11. The industry is located in designated industrial zone as per Master plan, Ludhiana i.e. Phase-6, Focal Point, Ludhiana. As such the site is suitable for such type of industry. 12. The industry has not installed CCTV cameras on the desired places as per the SOPs for such type of industry. As such the industry is violating the provisions of Water Act, 1974 and Air Act, 1981 and is not complying with the hearing decisions. Also, the industry is not complying with the SOPs made for such type of industry. In view of above, it is recommended that show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 may be issued to the industry with opportunity of personal hearing before the Competent Authority.
