File Note: It is submitted that the industry is an Orange category rice sheller and was granted Consent to Establish (NOC) vide No. CTE/Fresh/FZL/2024/25190399 dated 27.05.2024, valid upto 26.05.2025. Thereafter, the industry was granted consent to operate under Water Act, 1974 and Air Act, 1981 vide CTOW/Fresh/FZL/2024/26983545 and CTOA/Fresh/FZL/2024/26983540, both dated 28.10.2024 and valid till 30.09.2029, for manufacturing of parboiled / steamed /raw rice @ 96 TPD with dryer and Sorted Rice @ 96 TPD, using Paddy @ 144 TPD ,subject to special conditions as: 1. The industry shall maintain its ETP in line every time along with all mechanical fittings, filter media and flow meter at outlet of ETP during non-operation of parboiling plant and will maintain proper record regarding operation of ETP during operation of parboiling plant vis-à-vis generation of trade effluent……………2. The industry will submit prior schedule for operation of parboiling section to produce saila rice and ensure stabilization of the effluent treatment plant well before the re-commissioning of parboiling section so as to ensure proper treatment of trade effluent from the said section for achieving the standards prescribed by the Board for such type of industries/ discharges…………..3. The industry shall get its effluent / emission samples analyzed from the Board’s lab / approved lab. of the Board within a period of one month after re- commissioning of the industry for operation of parboiling plant………….. 4. The industry shall provide separate energy meter with the ETP and flow meter at the source of fresh water supply…………. .5. The industry shall ensure to maintain its plantation area and shall also ensure no stagnation in it at any time…………. 6. The industry will ensure to depute technical person (s) for maintaining / stabilization / operation of ETP…………. 7. The industry shall ensure to operate its effluent / air pollution control devices regularly and in efficient manner so as to achieve the prescribed standards for all the times. ………….8. The industry shall comply with the code of practice notified by Punjab Govt., Deptt. of Science, Technology & Environment vide its notification no. 10/48/2004-STE (4) /932 dated 15/10/2013 for such type of units………… 9. The industry shall maintain regular record regarding the lifting of fuel ash generated during the operation of boiler, from its premises.…………10. The project proponent be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 79 alongwith other provisions of PRTPD Act, 1995, in case the site falls in non-confirming land use zone after the notification of master plan and no claim shall be demanded by the applicant from the Board. ………..11. The industry shall not install any machinery and also not to indulge any industrial activity within 20 meters of the land area bearing khasra no. 17//9/2 (2-18) from where the high- tension wire is passing from the site…….. The industry has now applied for varied Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for the manufacturing of Parboiled / Steamed / Raw Rice with Drier @ 96 TPD, Steamed / Raw Rice with drier @ 48 TPD and Sorted Rice @ 144 TPD, using Paddy @ 216 TPD, Unsorted Rice @ 144 TPD as raw materials and by products as Rice Husk @ 45 TPD, Rice Bran @16 TPD, Khudi Husk @10 TPD. The details of the case are as under: (i) The industry has submitted a CA’s certificate dated 31.10.2025, having the value of total fixed assets of the unit as ₹2423.09 lakhs, with the value of plant and machinery at ₹1187.43 lakhs…………. (ii) The industry had deposited Rs. 1,20,000/- vide UTR/Ref. No.134410122 dated 24.09.2024 under the Water Act, 1974 and Rs. 1,20,000/- vide UTR/ Ref. No.520951689 dated 24.09.2024 under Air Act, 1981. Further, industry has deposited Rs 48,000 vide receipt no. 635221326 dated 15.12.2025 under the Water Act, 1981 and Rs 66,000 vide receipt no. 969253293 dated 15.12.2025 under the Air Act, 1981 (including Rs 18000 as NOC regularisation fee against the increase of Rs 556.10 lakhs in value of total assets). Thus, as per the Board’s circular dated 29.10.2018, the consent fees deposited by the industry under both Acts are adequate up to 30.09.2030………… (iii) The industry has applied for varied Consents to Operate as there is increase in value of its plant and machinery and building component. Moreover, the industry has submitted letter from DTP Fazilka vide no. 97DTP(FZK)/RS-1 dated 09.02.2024, the remarks of which are produced verbatim “1. ਸਾਈਟ ਤਿਆਰੀ ਅਧੀਨ ਮਾਸਟਰ ਪਲੈਨ ਫਾਜ਼ਿਲਕਾ ਦੇ ਪੀ.ਐੱਲ.ਯੂ ਅਨੁਸਾਰ ਉਦਯੋਗਿਕ ਜ਼ੋਨ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। 2. ਸਾਈਟ ਨਗਰ ਕੌਂਸਲ ਫਾਜ਼ਿਲਕਾ ਦੀ ਹਦੂਦ ਤੋਂ ਲਗਭਗ 3.5 ਕਿਲੋਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਪੈਂਦੀ ਹੈ ।” Hence, the site is suitable for expansion…….. The industry was visited by the undersigned on 20.12.2025 and it was observed that: (i) The industry is a parboiled/steamed rice production unit and was not in operation during the visit, but found to be in operationable state …………… (ii). The industry has installed boiler of capacity 9 TPH with multicyclone separator as APCD and same has been provided with stack of adequate height and sampling arrangement.……………(iii). The industry has installed one additional paddy pre-cleaner, thereby increasing the total number of paddy precleaners to two, however, cyclone separator was provided as APCD with only one of the paddy pre-cleaners………..(iv). The industry earlier had one existing shelling line and has now installed one additional shelling line; consequently, now the industry has two shelling lines. However, no cyclone was connected to the existing shelling line and one cyclone was found lying near the newly installed shelling section but had not been fitted. ………… (v). The industry has provided pipe for taking rice husk from husk discharge point to boiler feeding point and mechanical feeding system has been provided with furnace of boiler. …..…………(vi) The industry has installed ETP of capacity 96 KLD with the components collection-cum-neutralization tank, equalization-cum- anaerobic filter, aeration tank, secondary clarifier, sludge drying beds for the treatment of trade effluent to be generated from the parboiled section. The industry has provided flow meter at the outlet of ETP. However, the ETP was not found to be in satisfactory condition and required cleaning.……….. (vii). The industry has developed a plantation area of approx 02 acres for the disposal of treated trade effluent in accordance with Karnal technology, situated adjoining to and outside the industrial premises in two pockets, comprising 1.5 acres in one pocket and 0.5 acre in the other. (viii). The industry has provided room type enclosure with roof of adequate size for storage of fuel ash. However, the ash was found outside the enclosure which was prone to wind blowing…………. (ix). The industry has provided brick paving within its premises.. ……… (xi). The industry has provided septic tank for treatment of domestic effluent and has provided adequate planation for the disposal of same. (xii). The industry has installed one additional sortex machine in addition to the existing sortex machine, thereby increasing the total number of sortex machines to two...........Note: Detailed new agenda note could not be generated due to server error and the issue has been communicated to the computer section through email (new inspection report attached). However, due to some unknown error, old agenda note got attached. From above, it is clear that the unit is not complying with the code of practice stipulated for such units, previous consent conditions and also not complying with provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. Hence, if approved, it is recommended that SCN under the provisions of the Water Act, 1974 & the Air Act, 1981 may be issued to the industry for above violations, please.
