File Note: Kindly peruse the note of AEE dated 22.12.2025 & 31.12.2025………. • It is submitted that the educational institute was earlier granted Consents to Operate under the Water Act, 1974 and the Air Act, 1981 on 06.03.2025, for operating Educational Institute for 200 persons (students including staff), which were valid up to 31.12.2025……………… • The institute has now made addition of 02 rooms and has applied for obtaining varied Consents to Operate under the Water Act, 1974 and the Air Act, 1981……………… • The applicant has submitted an undertaking dated 12.11.2025, stating that the earlier built-up area of the institute was 2377.29 sq. mt., and due to student requirements, two additional classrooms have been constructed, resulting in an incremental built-up area of 376.82 sq. mt., without any change in machinery. Thus, the total built-up area comes out to be 2754.11 sq. mt., which is less than 20,000 sq. mt.; and moreover, as per PPCB guidelines vide no. SEE (HQ-2)/F.no. 10/2025/10336-354 dated 19.03.2025, Building & Construction projects < 20,000 sq.mt. lies in Green Category and does not fall under the purview of the EIA Notification, 2006…………………………. • The applicant has also submitted a CA Certificate reflecting a Fixed Capital Investment of ₹194.19 lakh, with the value of plant and machinery being ₹2.50 lakh during FY 2025–26. Accordingly, the applicant has deposited consent fee of Rs. 46,200/- through online vide Ref. no. AXSK253450001045 dated 11.12.2025 under Water Act, 1974 and Rs. 46,200/- through online vide Ref. no. AXSK253450001050 dated 11.12.2025 under the Air Act, 1981 for the fixed assets of Rs. 194.19 Lacs. After accounting the NOC regularization fees of Rs. 2200/- in connection with the increased capital investment, the consent fees deposited by the educational institute under the provisions of the Water Act, 1974 & the Air Act, 1981, are valid up to 31.12.2032………………………… • To verify the contents of the application, the educational institute was visited by AEE of RO Sri Muktsar Sahib on 26.11.2025 and was observed as under:- 1. The institute was found operational at the time of inspection and offers admissions in +1, +2, B.A., and B.Com courses………………. 2. Two additional rooms have been constructed for classroom purposes and no addition of plant & machinery was observed at the time of inspection…………………… 3. A green belt of 5 m width has been developed on the side facing the nearby air-polluting industry (Brick Kiln), which is located at a distance of more than 100 m from the institute………………… 4. Three compost pits have been constructed for the management of biodegradable solid waste in accordance with the Solid Waste Management Rules, 2016…………… 5. Two septic tanks have been provided for the treatment of domestic effluent, with arrangements to discharge the treated wastewater onto land for plantation purposes…………….. 6. The green belt provided by the educational institute is adequate to handle effluent from the septic tank………….. 7. The institute has provided solar panel of capacity 07 kVA for generating electricity within its premises. • RO has reported that the educational institute is complying with the provisions of the Water Act, 1974, Air Act, 1981 and conditions of previous consents. RO has recommended for grant of varied Consents to Operate under the Water Act, 1974 and the Air Act, upto 31.12.2032 with suitable conditions………… • It is pertinent to mention here that the institute has obtained change of land use for an Educational Institute (Degree College) from the Directorate of Town & Country Planning, Punjab, vide Memo No. 659/CTP(Pb)/SP-432(MUKT) dated 10.02.2020………………… • The institute has also approved its building plan from Chief Town Planner Punjab vide no. 1296/SM-156 dt. 07.05.2020…….. Keeping in view of above and recommendations of R.O., if approved, the institute may be granted varied Consent to operate under the provisions of the Water Act, 1974 & the Air Act, 1981 upto 30.09.2026 with following special conditions :- 1. The project proponent shall get its revised building plan approved from Competent Authority and shall submit in the Board, within 03 months………… 2. The project proponent is bound to comply with all terms and conditions imposed by Directorate of Town & Country Planning, Punjab, vide Memo No. 659/CTP(Pb)/SP-432(MUKT) dated 10.02.2020………………… 3. The project proponent is bound to comply with the zoning regulations of Master Plan as and when notified……….. 4. PPCB shall not be liable for any loss incurred in case site of the institute falls under non-conforming zone as per notified Master Plan………… 5. The project proponent shall operate all the pollution control devices regularly and efficiently so as to achieve the prescribed standards………….. 6. The project proponent shall obtain permission from Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it……………. 7. The project proponent shall install water meter at fresh water supply and shall maintain record on daily basis…………. 8. The project proponent shall not install any DG set without obtaining written prior permission of the Board…………. 9. The consent to operate is being granted from pollution angle only. The project proponent shall obtain necessary statutory permission from the other concerned department, as applicable…………… 10. The project proponent shall ensure that there is no pollution/nuisance in the vicinity with the operation of the educational institute…………. 11. The project proponent shall neither increase its land area without obtaining prior permission from the Board………… 12. The institute shall ensure to manage its solid waste in compliance to the Solid Waste Management Rules, 2016 at all times…………… 13. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic……….. 14. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the educational institute………….
