It is submitted that the project is small scale green category unit. Earlier, the project proponent was granted consent to establish/ NOC under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/LDH4/2017/5414993 dated 08.05.2017, valid upto 07.05.2018 for the discharge of trade effluent @ 4.0 KLD and domestic effluent @ 4 KLD onto land for plantation after treatment through oil skimmer followed by STP. The hotel was visited by officer of the Board on 05.12.2023 and it was observed that the hotel has provided 10 rooms, 01 banquet hall, 01 restaurant and 01 bar. During visit a function was undergoing in the banquet hall. The project proponent has installed STP for treatment of wastewater generated. The STP was not in operation at the time of visit. The STP was found in defunct condition. The project proponent has provided a flexible pipe in the collection tank through which the untreated effluent is being discharged through moveable tankers as informed by the representative. 3. The project proponent has not provided bio composter/compost pits. The representative informed that the wet waste is being lifted to the piggery farms. 4. No rain water harvesting system provided. 5. No water meter provided at source of supply of fresh water. 6. The representative informed that they have no sewer connection. 7. The project proponent has provided one DG set of capacity 84 KVA and same was equipped with canopy. The project proponent was running its unit without obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 of the Board and thus is violating the provisions of said Acts. Accordingly, show cause notice for violation of the provisions of Water Act, 1974 and Air Act, 1981 was issued to the project proponent with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-2, Ludhiana on 02.01.2024. Wherein it was decided that: 1. The project proponent shall submit a bank guarantee of Rs. 50,000/- in Regional Office-4, Ludhiana as an assurance to comply with the Environmental Laws, within 15 days. 2. The project proponent shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, within 15 days. 3. The project proponent shall maintain and operate its STP regularly and efficiently, so as to achieve the effluent standards of the Board. 4. ………………………..
In compliance of hearing decision, the hotel was again visited by the officer of the Board on 26.07.2024 and it was observed as under:- 1. The STP was not in operation at the time of visit. The STP was found in defunct condition. 3. The project proponent has not provided bio composter/compost pits. The representative informed that the wet waste is being lifted to the piggery farms. 4. No rain water harvesting system provided. 5. No water meter provided at source of supply of fresh water. 6. The representative informed that they have no sewer connection. 7. The project proponent has provided 01 D.G set of capacity 84 KVA and same was equipped with canopy. 8. The project proponent has not yet submitted BG as decided during hearing dated 02.01.2024 despite of repeated reminders. 9. The project proponent has failed to get of consent to operate under Air Act, 1981 and Water Act, 1974. The project proponent was not complying with the provisions of Water Act, 1974, Air Act, 1981 and decisions of personal hearing dated 02.01.2024………………
Notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 was issued to the project proponent with an opportunity of personal hearing before Chief Environmental Engineer, Ludhiana on 16.089.2024. Sh. Jaswinder Singh, Proprietor of the hotel attended the hearing. After hearing the proprietor of the project and officers of the Board, the Chief Environmental Engineer of the Board decided as under: 1. The hotel shall submit a Bank Guarantee of Rs. 2 Lacs as an assurance to comply with the provisions of environmental laws. 2. The industry shall apply, within 07 days, for obtaining consents under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 3. Environmental Engineer, Regional Office-4, Ludhiana shall visit the hotel after 07 days to verify the compliances of environmental laws and send recommendations accordingly. Thereafter the hotel was issued directions u/s 33-A of the Water Act, 1974 for disconnection of electric supply alongwith sealing of D.G. set installed by the hotel. In compliance of above, the PSPCL authorities has disconnected the electric supply of the industry vide TDCO no. 030/85284 dated 13.03.2025………………………..
Now the industry has applied for consent to operate under the Water Act, 1974 through OCMMS for discharge of domestic effluent @ 03 KLD and Trade effluent @ 5.0 KLD onto land for plantation after treatment through STP. The hotel was visited by the officer of this office on 20.11.2025 and it was observed as under:- 1. The hotel was not in operation during the visit due to disconnection of electric supply. 2. The project proponent has provided 17 rooms, 01 banquet hall and 02 Kitty Hall. 3. The project proponent has installed STP for treatment of wastewater generated. 4. The project proponent has provided bio composter/compost pits. 5. The project proponent has now provided rain water harvesting system.
6.The hotel was provided plantation area @ 0.2 acre (830.3 sqm), which is adequate for discharge of effluent @ 8 KLD. 7. As per record the hotel has submitted CLU vide memo no. 3849/CTP(Pb)SP-432-L dated 05.08.2016 of area 0.323 acre (Khasra no. 38//4/2 (6-4), 7/1(1-2)). As per CLU the site is for industrial Purpose (Hotel). 8. The hotel has installed energy meter and flow meter on the STP and was advice to the maintain the proper record of consumption and discharge of treated waste water. 9. No previous record of waste water was present as the hotel was not in operation due to disconnection of electric supply.
10. The project proponent has provided 02 D.G set of capacity 82.5 KVA and same was equipped with canopy, which were sealed and seals are found intact during the visit. 11. The hotel has submitted the Bank guarantee of Rs. 2 lacs, which is valid upto 16.04.2026 as an assurance to comply with the provisions of environmental laws. 12. The hotel is now complying with the provisions of the Water Act, 1974 and Air Act, 1981 and SOP for such type of units………. Consent to operate under the Water Act, 1974 has been principally approved by the EE RO for short period of six months. ………..In view of above it is recommended that Electric connection of the hotel may be restored for short term period i.e. six months.
