File Note: It is submitted that the industry was granted ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2025/28216017 dated 04/04/202, having validity upto 03/04/2026 for manufacturing of Partition/Ceiling Panel @ 100 Numbers/Day and Metal Door @ 30 Numbers/Day as products with special conditions mentioned therein. Now, the industry has been applied for ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, along with requisite document. The industry has deposited Rs. 54500/- vide R no. 694269542 dated 20.12.2025 under the Water (Prevention & Control of Pollution) Act, 1974, Rs. 54500/- vide R. no. 688559605 dated 20.12.2025 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate for 31.12.2030, against the fixed assets of Rs. 4.42 cr. as on 30.11.2025. Water Pollution No trade effluent is being generated and domestic effluent @ 0.7 KLD shall be generated from the unit, which will be discharged onto land for plantation within premises after passing through septic tank. Air Pollution The industry has proposed to install 01 no. DG set of capacity 100 KVA, which is equipped with canopy and stack of adequate height, which is yet to be installed. The industry has installed 01 no. powder coating section, which is provided with cyclone separator and filter recovery unit as APCD. Visit: Accordingly, the industry was visited by undersigned on 25.12.2025 and during visit, it was observed as under: 1. The industry was in operation and engaged in the business of Partition/Ceiling Panel and Metal Door. 2. The industry has installed one no. of powder coating line equipped with cyclone separator and filter recovery unit as APCD. 3. The industry has installed one no. of oven based on gas for curing of powder coat. 4. The industry has also installed bending and shearing machines for cutting of metal parts. 5. One no. of assembly line is installed for filling of insulation material into the partition panels. 6. No trade effluent generating process is included in the industry. 7. The domestic effluent is treated onto septic tank and treated wastewater is disposed onto plantation within the premises. 8. One no. of DG of unknown capacity was temporarily installed in the premises, which is equipped with canopy. The representative informed that the DG set of capacity 100 KVA as informed in ‘consent to establish’ (NOC) is yet to be installed. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, it is recommended that the industry granted ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.12.2030 with usual conditions & with following special conditions: 1. The industry shall not carry out any activity in its premises, which can change the category of unit from Orange to Red, under any circumstances. 2. The industry shall not generate and discharge any kind of trade effluent from its process. The industry shall discharge only domestic effluent onto land for plantation within premises, after passing through septic tank. 3. The industry shall reuse the waste insulation material within its process entirely and no insulation material waste should be carried out of the industry for disposal without the approval from the Board. 4. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and shall dispose the hazardous waste generated as per rules. 5. This ‘consent to operate’ is being granted to the industry on the basis of land use classification letter uploaded by the industry alongwith the online application. The industry shall establish its unit only in the said Khasra nos. mentioned in rent deed and shall comply with the guidelines/bylaws/stipulations of the Department of Town and Country Planning, at all times. 6. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard. 7. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 8. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 9. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 10. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information/undertaking submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document/undertaking is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 11. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
