Sir, it is submitted that the industry is an existing industrial unit operating since 1994–95, i.e., prior to the notification of the Master Plan, Khanna (2010–31). Although the site presently falls in a residential zone under the Master Plan, multiple statutory authorities i.e. Municipal Council, Khanna and District Town Planner; have acknowledged that the unit qualifies as a pre-existing (non-conforming) industry. The surrounding land use is industrial/semi-industrial, with no residential colony nearby. The unit is liable to be adjusted in the Master Plan “as it is”, and the area has been recommended for declaration as an industrial zone (spot zoning). Master Plan, Khanna was notified by GOVERNMENT OF PUNJAĐ’, DEPARTMENT OF TOWN AND COUNTRY PLANNING, Chandigarh vide Notification No. 1037/CTP(Pb)/SK-50 dated 11.02.2011. It is further submitted that the industry proposed activity constitutes modernization/change in product mix but the proposal of the industry has been rejected by the Competent Authority till declaration as an industrial zone (spot zoning).
In view of the above, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 may be renewed upto 30.09.2026 with usual conditions and with special conditions:
1. The industry shall not operate its proposed activities without prior permission of the Board.
2. The industry shall neither increase in land area nor increase in pollution load.
3. The industry shall comply with all the conditions/siting guidelines of Master Plan and Town & Country planning, Punjab.
