File Note: It is intimated that the industry is small scale red category dyeing unit and was granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH3/2023/20773658 dated 27/02/2023 valid upto 26/02/2024 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDH3/2023/20788151 dated 05/04/2023 valid upto 04/04/2024 for Dyeing Of Polyester Cloth @ 9000 Kgs/day alongwith discharge of trade effluent @ 260 KLD & domestic effluent @ 01 KLD into conveyance system of CETP 50 MLD with operation of one boiler of capacity 03 TPH with Cyclone Separator as APCD. Thereafter the industry had obtained auto renewal ‘Consent to Operate’ under the Water Act, 1974 and the Air Act, 1981 vide no. CTO/Renewal/LDH3/2024/25143809 dated 01.04.2024 & CTO/Renewal/LDH3/2024/25143838 dated 01.04.2024, both are valid upto 01.04.2027. Now the industry has applied for fresh ‘Consent to Operate’ under the Air (Prevention & Control of Pollution) Act, 1981 for Dyeing Of Polyester Cloth @ 9000 Kgs/day alongwith operation of one boiler of capacity 03 TPH with Cyclone Separator as APCD. The industry had already deposited consent fee of Rs. 32,400/- vide UTR No. 267305918 dated 14.07.2022, and Rs. 10800/- vide receipt no. 824265001 dated 01/04/2024 which is adequate upto 30.06.2030 under Air (Prevention & Control of Pollution) Act, 1981. The industry was visited by AEE of this office on 01.01.2026 and observed as under: 1. The industry was in operation and was engaged in the process of dyeing of fabric. 2. The industry has installed boiler based on FBC of capacity 03 TPH capacity and has provided cyclone as APCD with adequate stack. The industry was using agro waste (i.e. patta kutti) as fuel in its boiler. 3. Industry has installed CCTV cameras at fuel deeding point and at the stack. 4. Industry has provided mechanized fuel feeding system. 5. Industry has provided shed for storage of fuel and ash. 6. Industry has installed a DG set of capacity 250 KVA with adequate stack height. 7. Earlier, the Industry has installed only cyclone as APCD now the industry has also installed a wet scrubber followed by the cyclone. 8. Industry has provided rotary valve with the cyclone and same was operational during visit 9. Earlier the electric connection of the industry was disconnected due to the reason that it had stored the unauthorized fuel i.e. poultry waste (littering of birds) and same was being used in the boiler. Thereafter, the electric connection of the industry was restored temporarily upto 03.02.2023. After restoration the industry was visited 03 times while the officer of the Board i.e. on 17.10.2022, 16.01.2023 & 07.03.2023. During all 03 visits, no unauthorized fuel was found inside the unit. Thereafter, the electric connection of the unit has been restored permanently. Earlier, the industry was visited surprisingly on 25/09/2025, in which a stack sample has also been taken and as per the results received from the Air laboratory the industry has failed to achieve prescribed standards. As per the results received from the Air laboratory the parameters were beyond the prescribed limits {PM= 265(mg/Nm3) against the prescribed limit of PM=250 (mg/Nm3) }, thereafter Notice to issue directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 was issued to the industry with an opportunity of personnel hearing on 19/12/2025 before the competent authority of the Board, the proceedings of which are approved in which it is decided that:- 1. The industry shall submit a bank guarantee of Rs. 1 lakh as an assurance not to emit black smoke and achieve the prescribed standards, for a minimum period of 02 years. 2. The industry shall take following measures, within 15 days and to ensure that there is no black smoke from its stack: a) The industry shall upgrade the treatment system and operate its APCD regularly and efficiently so as to achieve the prescribed standards as mandated by the MoEF & CC, Govt. of India vide notification dated 16.05.2023. b) The industry shall provide energy meter with the APCD and maintain record of the same. c) The industry shall ensure mechanized feeding of fuel is carried out in all time to come. d) The industry shall ensure that only authorized fuel is utilized in the boiler furnace. The industry shall make all the efforts to avoid wetting of fuel including proper storage/ covers while storing in its premises. e) The industry shall make a comprehensive proposal for fly ash utilization in scientific manner and shall explore the possibilities for its reuse by the brick kilns owners, road filling by NHAI / PWD / other departments, cement industry and other establishments and submit the same to the Board, within one month. f) The industry shall maintain daily record of fly ash disposal and submit the same in the Regional Office by every 5th of the month. 3. It was made clear to the industry, in case, the industry is again found emitting black smoke, strict action including closure shall be initiated against the industry u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981. 4. Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry to verify the contentions of the industry and process the consent application on merit. Keeping in view of above, it is recommended that show cause notice without hearing for refusal of the ‘Consent to operate’ under the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the unit with an opportunity to submitting the compliance of the decisions of the personal hearing given to it on 19.12.2025 within 7 days.
