File Note: It is submitted that the industry is a Small Scale, Orange Category rice sheller unit, which has previously obtained valid Consent to Operate under the Water Act, 1974 and the Air Act, 1981 vide Nos. CTOW/Varied/MKS/2022/19630401 and CTOA/Varied/MKS/2022/19630348 dated 26.08.2022. The said consents are valid up to 30.09.2027 for the production of Raw Rice/Sorted Rice @ 1 TPH with dryer. The unit is located in the revenue estate of Village Malout, Tehsil Malout, District Sri Muktsar Sahib, having a total land area of 07 Kanals 10 Marlas bearing Khasra Nos. 59//10/2 (2-10) and 11/1 (5-0), subject to the conditions stipulated therein. □ Further, the applied varied applications of the rice sheller, i.e. Consent to Operate under the Water Act, 1974 and the Air Act, 1981 for enhancement of production capacity from 1 TPH to 3 TPH, and Consent to Establish (NOC) for expansion of land area from a total revenue area of 07 Kanals 10 Marlas to 26 Kanals 06 Marlas, were returned due to submission of insufficient documents. □ Now, the industry has again applied for obtaining varied Consent to Operate from the Board under the Water Act, 1974 and the Air Act, 1981 under the Small Scale, Orange Category for enhancement of production capacity of Raw Rice/Sorted Rice from 1 TPH to 3 TPH by using paddy as raw material @ 4.5 TPH. The industry has also proposed addition of land so as to make its total site area 26 Kanals 06 Marlas, bearing Khewat Nos. 581, 582, 583 and 584; Khatoni Nos. 701, 702, 703 and 704; and Khasra Nos. 59//11/2 (3-0), 12/1 (5-8), 59//10/1 (2-17), 59//9 (7-11), 59//10/2 (2-10) and 11/1 (5-0), in its existing rice sheller plant. □ Details of the case are as under: - 1. The industry was earlier granted Consent to Operate by the Board in the name of Sh. Munish Gupta, Proprietor, who expired on 08.11.2024. A copy of the death certificate has been submitted by the industry. Subsequently, the legal heirs of late Sh. Munish Gupta sold the land measuring 07 Kanals 10 Marlas to M/s Shiva Rice & General Mills, situated at Village Malout, Tehsil Malout, District Sri Muktsar Sahib. In support of the same, the industry has submitted a copy of the land registration certificate vide No. 2025-26/52/1/2593 dated 08.08.2025. 2. Further, the industry has submitted a copy of the land registration certificate of 18 Kanals 15 Marlas vide no. 2025-26/52/1/2592 dated 08.08.2025 on the name of the firm i.e. M/s Shiva Rice & General Mills, purchased from legal heirs of the late Sh. Munish Gupta. 3. Further, during previous CTE application, the industry had submitted an undertaking given by Sh. Aryan Gupta son & legal successor of late Sh. Munish Gupta stating that a rice sheller having total land of 26 Kanals 06 Marlas bearing Khewat No. 581, 582, 583, 584, Khatauni No. 701, 702, 703, 704, Khasra No. 59//11(8-0), 12/1(5-8), 10/1(2-17), 9(7-11), 10/2(2-10) including its Plant, Building & Machinery has been sold to Sh. Sunil Kumar Bansal, Partner of M/s Shiva Rice & General Mills, Vill. Malout. 4. The unit is presently being operated as a partnership firm under the name and style of M/s Shiva Rice & General Mills, with Sh. Sunil Kumar Bansal and Smt. Mamta Rani Bansal as partners, for which a copy of the Partnership Deed has been submitted by the industry. 5. The during CTE application, the industry has also submitted a land classification report from the DTP office, Sri Muktsar Sahib vide letter no. 1031 dated 12.09.2025, for addition in land area of existing rice sheller having land area 07 Kanals 10 Marlas bearing Khasra No, 59//10/2(2-10), 11/1(5-0) by 18 Kanals 16 Marlas bearing Khasra No. 59//11/2(3-0), 12/1(5-8), 10/1(2-17), 9(7-11) to make total land of rice sheller 26 Kanals 06 Marlas. which is reproduced as under: - 1) ਸਾਈਟ ਕਿਸੇ ਫੋਕਲ ਪੁਆਇੰਟ ਜਾਂ Designated Industrial Zone ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ ਹੈ। 2) ਸਾਈਟ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ, ਮਲੋਟ ਦੀ ਹਦੂਦ ਅੰਦਰ ਪੈਂਦੀ ਹੈ ਜਿਸ ਦਾ ਮਾਸਟਰ ਪਲੈਨ ਅਜੇ ਤਿਆਰ ਕੀਤਾ ਜਾਣਾ ਹੈ। ਭਾਵ ਹਾਲ ਦੀ ਘੜੀ ਇਸ ਰਕਬੇ/ਏਰੀਆ ਦਾ ਲੈਂਡ ਯੂਜ ਜੌਨ ਨਿਰਧਾਰਤ ਨਹੀਂ ਹੈ, ਇਸ ਤੋਂ ਇਲਾਵਾ ਸਾਈਟ ਨਗਰ ਕੌਂਸਲ ਮਲੋਟ ਦੀ ਹਦੂਦ ਤੋਂ 1.8 ਕਿਲੋਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਪੈਂਦੀ ਹੈ। 3) ਸਾਈਟ ਨੈਸ਼ਨਲ ਹਾਈਵੈ 354 ਤੋਂ ਲਗਭਗ 475 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਪੈਂਦੀ ਹੈ। ਇਸ ਦਫਤਰ ਦੀ ਰਿਪੋਰਟ ਅਨੁਸਾਰ ਸਾਈਟ ਵਿੱਚ ਵਾਧਾ ਇਸ ਸ਼ਰਤ ਤੇ ਕੀਤਾ ਜਾ ਸਕਦਾ ਹੈ ਕਿ ਨੈਸ਼ਨਲ ਹਾਈਵੈ ਦੇ 500 ਮੀਟਰ ਘੇਰੇ ਅੰਦਰ ਪੈਂਦੇ ਰਕਬੇ ਨੂੰ ਸਿਰਫ ਸਟੋਰੇਜ ਪਰਪਜ ਵਾਸਤੇ ਹੀ ਵਰਤਿਆ ਜਾ ਸਕਦਾ ਹੈ, ਜਿਸ ਸਬੰਧੀ ਪ੍ਰਾਰਥੀ/ਫਰਮ ਵੱਲੋਂ ਸਵੈ-ਘੋਸ਼ਣਾ ਪੱਤਰ ਇਸ ਦਫਤਰ ਵਿਖੇ ਪੇਸ਼ ਕੀਤਾ ਗਿਆ ਹੈ। 6. In compliance to the condition imposed by the office of the DTP office, Sri Muktsar Sahib as stated above, the industry has submitted an approved Building Plan issued by the competent authority, wherein it has been clearly mentioned that the expanded plot area of 18 Kanals 16 Marlas shall be used exclusively for paddy storage purposes. 7. The industry has submitted a report of the Tehsildar, Malout dated 13.08.2025 & 10.09.2025 mentioning ownership of total land area of 26 Kanals 06 Marlas bearing Khewat No. 581, 582, 583, 584, Khatauni No. 701, 702, 703, 704, Khasra No. 59//11/2 (3-0), 12/1(5-8), 59//10/1(2-17), 59//9(7-11), 59//10/2 (2-10), 11/1(5-0) on the name of M/s Shiva Rice & General Mills, Vill. Malout. 8. The industry has also submitted certificate from the Municipal Council, Malout vide no. 2338 dated 26.08.2025, as per which the site of the industry falls outside the MC limits. Certificate from the MC is reproduced as under: - ਤਸਦੀਕ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਬਿਨੈਕਾਰ ਦੀ ਰਕਬਾ 26 ਕਨਾਲ 6 ਮਰਲੇ ਖਸਰਾ ਨੰ. 59/11/2(3-0), 12/1(5-8), 10/1(2-17), 9(7-11), 10/2(2-10), 11/1(5-0) ਮਲਵਾਲਾ ਰੋੜ, ਪਿੰਡ ਮਲੋਟ, ਤਹਿਸੀਲ ਮਲੋਟ, ਜਿਲ੍ਹਾ ਸ਼੍ਰੀ ਮੁਕਤਸਰ ਸਾਹਿਬ ਮੁਤਾਬਿਕ ਜਮਾਂਬੰਦੀ ਸਾਲ 2019-2020 ਅਨੁਸਾਰ ਇਹ ਰਕਬਾ ਪਿੰਡ ਮਲੋਟ, ਮਲਵਾਲਾ ਰੋੜ ਤੇ ਸਥਿਤ ਹੈ। ਜੋ ਕਿ ਨਗਰ ਕੋਂਸਲ ਦੀ ਮੋਜੂਦਾ ਹਦੂਦ ਤੋ ਬਾਹਰ ਹੈ। ਹੱਦ ਤੋ ਬਾਹਰ ਦਾ ਸਰਟੀਫਿਕੇਟ ਜਾਰੀ ਕੀਤਾ ਜਾਂਦਾ ਹੈ। (ਬਿਨੈਕਾਰ – ਮਮਤਾ ਰਾਨੀ ਬਾਂਸਲ ਪਤਨੀ ਸੁਨੀਲ ਕੁਮਾਰ ਬਾਂਸਲ, ਵਾਸੀ ਜਿਲ੍ਹਾ ਬਠਿੰਡਾ) 9. The industry has submitted a CA certificate indicating the total fixed asset value as ₹281.09 lakhs, including plant and machinery valued at ₹132.20 lakhs. Accordingly, the industry has submitted fee details as deposited under previous applications as stated above ₹42000/- each via online under the Water Act, 1974 & the Air Act, 1981 vide UTR/Reference No. PSIBN52025090377024150 & PSIBN52025090377024115 both dated 03.09.2025. Further, the industry has also deposited NOC regularization fees of ₹5600/- vide UTR/Reference No. PSIBN52025090377024166 dated 03.09.2025 and ₹5200/- R. No. 608375921 dated 15.09.2025. After accounting the fees deposited by the industry, the fee is adequate up to 31.12.2029 for both the Acts. 10. The industry has submitted an undertaking that the industry has installed required separate cyclone separators as APCD at Milling section and Paddy Cleaning Section of Dryer in compliance with emission standards of 750 mg/Nm3 as applicable by PPCB as per notification no. 10/200/2020/STE(5)/223516 dated 05th Aug, 2021 as per the increase capacity of 3 TPH of Raw Rice/ Sorted Rice with dryer by using Paddy @ 4.5 TPH. □ To verify the contents of the application as well as siting guidelines, the site was visited by the officer of this office on 30.12.2025 and it was observed as under: - 1. The industry was found engaged in repositioning of plant & machinery of the existing unit within its premises and the plant was under maintenance. 2. The industry has installed cyclone separators as APCDs with paddy pre-cleaner section and shelling section, separately. Both the APCDs were found in operational condition, with adequate stack height and sampling arrangement facilities. 3. The industry has provided brick wall of 10' height with adequate length at husk-emitting area, however, the wind screen of 5' height is yet to be provided over the said wall. 4. The industry has provided sapling as plantation along the boundary wall of the rice sheller. 5. The industry has constructed septic tank for treatment of domestic effluent with provision of discharge of effluent onto land for plantation. 6. The industry has provided brick paved on movement area of the vehicles to control the vehicular dust emissions. 7. The representative of the industry stated that the expanded plot area measuring 18 Kanals 16 Marlas, bearing Khasra Nos. 59//11/2 (3-0), 12/1 (5-8), 10/1 (2-17) and 9 (7-11), shall be used only and exclusively for paddy storage purposes. In this regard, an undertaking dated 29.12.2025 (Copy enclosed) has been submitted by the industry, wherein it has been stated that the enhancement of the rice sheller capacity from 1 TPH to 3 TPH is being carried out within the existing unit premises, i.e. on land measuring 07 Kanals 10 Marlas bearing Khasra Nos. 59//10/2 (2-10) and 11/1 (5-0). □ From above, the industry is complying with the provisions of the Water Act, 1974 and the Air Act, 1981 to operate the rice sheller. □ Keeping in view of the above, it is recommended that, if approved, the varied Consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for manufacturing of raw rice with dryer @ 3 TPH by using paddy @ 4.5 TPH as raw material, for a period up to 30.09.2029, subject to the suitable conditions along with following specific conditions as under: - 1) This consent is valid only for manufacturing of Raw rice /sorted rice with dryer @ 3 TPH. 2) This consent is valid only to operate rice sheller for site area, measuring 07 Kanals 10 Marlas bearing Khasra Nos. 59//10/2 (2-10) and 11/1 (5-0), Village Malout, Tehsil Malout, Distt. Sri Muktsar Sahib and expanded plot area measuring 18 Kanals 16 Marlas, bearing Khasra Nos. 59//11/2 (3-0), 12/1 (5-8), 10/1 (2-17) and 9 (7-11), shall be used only and exclusively for paddy storage purposes. 3) The industry will get its stack emissions samples analyzed from Board's lab within 2 months, positively. 4) The industry will discharge only treated domestic effluent onto land for plantation / green belt. 5) The industry shall not increase its existing land area without prior permission of the Board. 6) The industry shall not increase its production capacity without the prior written permission/NOC of the Board. 7) The industry shall obtain renewal of Consents to operate under the Water Act, 1974 & the Air Act, 1981 prior to one month before its expiry. 8) The industry shall provide a layer of wind screen of at least 5' height above the wall and made a wall of adequate height within one month and submit compliance to this office. 9) The industry shall comply with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide order dated 15.10.2013 as follows: i) All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories. ii) The industry should plant thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the rice sheller/ Saila plant. iii) All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through a stack of height 3 meters above roof of the building. iv) The management and handling of rice husk in the rice shelling units/ Saila plants should be done as under: (a) All the rice shelling units/ Saila plants shall provide paved/brick roads/cement concrete roads / metalled roads inside their premises for movement of vehicles, so as to prevent the generation of dust. (b) (i) The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10' high or 3.5' higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should be at least 35' on each side of the rice husk discharge pipe. (ii) The industry shall provide a layer of wind screen of mild steel or some other similar material of at least 5' height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of airborne particulate from storage, handling and loading/unloading areas of rice husk. (iii) The minimum diameter at the outlet of discharge pipe of rice husk be kept as 15'', which can be maintained by extending the existing discharge pipe with the help of a conical shaped pipe of at least 3'length. (iv) Wherever, height of rice husk is 3' or more, the industry shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70 gm/m2 weight having 40-45 hole/inch2 to prevent wind blowing of stored husk. (c) During transportation of rice husk through vehicles, it shall be covered from all sides with tarpaulin to prevent blowing of husk by winds.  Competency: Environmental Engineer
