It is submitted that the industry has granted consent to operate of the Board under Water Act, 1974 vide no. CTOW/Renewal/LDH2/2021/16036588 and under Air (Prevention & Control of Pollution) Act, 1981 vide CTOA/Renewal/LDH2/2021/16036575, both were valid up to 30.06.2025.
Thereafter, the industry was given a personal hearing before the Senior Environmental Engineer, Zonal Office-l, Ludhiana on 07.07.2025 w.r.t. show cause notice for violation of provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, wherein, it was decided that:-
1. The industry shall apply for varied consent to operate under the Water Act, 1974 and Air Act, 1981 alongwith complete documents within 7 days.
2. The industry shall get its trade effluent lifted to the CETP operator regularly and maintain daily records of water consumption and effluent lifted.
3. The industry shall not discharge any trade effluent into sewer or through any unauthorized means.
4. The industry shall ensure the removal of any unused or unauthorized DG sets lacking stack height or pollution control provisions.
5. The industry shall maintain proper water metering at all process areas, including the vibrator section.
6. The industry shall improve and maintain good housekeeping conditions across the entire premises.
7. The Environmental Engineer, Regional Office-2, Ludhiana shall visit the industry to verify the latest status and submit status report/recommendations within 15 days.
In compliance of the hearing decisions, the site of the industry was visited by Er Tirth Singh, JEE of this office on 19.09.2025 ,observed that industry was in operation and engaged in the manufacturing process of auto parts. Pointwise compliance of hearing decisions held on 07.07.2024 before the Senior Environmental Engineer, Zonal Office-1, Ludhiana is as under:-
1. Industry has not applied for CTO under water act, 1974 and Air act, 1981.
2. During visit industry it was observed that industry has removed the acid pickling process from their unit. Hence industry cannot produce the record of trade effluent lifted and water consumption.
3. It was also observed that industry has not generating trade effluent.
4. Industry has not remove their DG set of unknown capacity which was placed without stack.
5. Industry has not provide any water metering at any process area because of not using a water in their process.
6. Housekeeping of industry is average, not very satisfactory.
7. At present industry has installed 36 No. of power presses, 15No. of Lathe 04 No. of Dhole in their premises.
Accordingly, the following directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 have been issued to the industry:-
1. That the industry shall not start any water or air polluting work without getting any prior consent/ permission from the Punjab Pollution Control Board.
2. That the industry shall obtain the registration under White category.
3. That the CETP operator is directed to revoke / cancel the agreement made with the industry and not to renew the same without permission of the Board.
Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 with requisite documents under green category. The industry has deposited Rs. 27100/- vide e-R No. 958004246 dated 23/12/2025 (Rs. 25200/- water, Rs. 1400/- NOC regularization fee & Rs. 500/- form fees) consent fee against the un-depreciated fixed assets of Rs. 87.79 Lacs as on 31/03/2025 as per CA certificate dated 13/06/2025, which is adequate upto 31.12.2030 under Water Act, 1974, as per Board's Office Order dated 29/10/2018 after deducting penalty charges 50 % and NOC regularization fee.
The industry was visited by the officer of the Board on 29.12.2025. During the visit, it was observed as under:
1. The industry was in operation during the visit and engaged in manufacturing of BB CUP, AXLE FOR BICYCLE /AUTO PARTS
2. The industry has installed 36 No. of power presses, 15No. of Lathe 01 No. of Dhole without any effluent generation source in their premises.
3. The industry has already removed the acid pickling process from their unit.
4. The industry has not installed any D.G set in its premises.
5. There is no generation of trade effluent from the process and only domestic effluent is discharged into sewer.
6. The industry has improved the housekeeping.
In the subject cited case, the industry has mentioned ground water extraction @ 3.0 KLD. Considering 25 working days per month, ground water extraction will be 75 KL/month, which is less than 300 KL/month.
It is therefore recommended that Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31/12/2030 with suitable conditions as per policy of the Board.
