Respected Sir, kindly peruse the note of AEE, wherein it has been mentioned that the competent Authority i.e. Custodian of Master Plan (MC khanna) has submitted vide its letter under reference that “The unit is in operation at the present site since 1994-95 before the notification of Master Plan, Khanna (2010- 31) and Municipal Council, Khanna has given approval vide order no. 33 dated 19.10.2020 to adjust the unit and the building plan has approved by the Director of Factories vide registration no. 4002 dated 07.07.1995. Accordingly, the MC khanna has send its recommendations to the concerned department i.e Department of Gram and Nagar Panchayat Chandigarh vide its letter dated 15.10.2025 and to Additional Deputy Commissioner (UD) Ludhiana vide its letter dated 08.09.2025 for designation of said area as Industrial.
Accordingly, the Senior Law Officer of the Board has opined as under:-
“In view of the above facts and circumstances of the case, recommendation of the Municipal Council, Khanna to the Department of Town and Country Planning Punjab for declaration of the area in question as industrial zone, I am of the opinion that NOC for modernization / expansion may be granted to M/s Hygienic Foods, Near Chaudhary Service Station, Malerkotla Road, Khanna with suitable conditions and with the condition that the NOC will be subject to the declaration of the area as Industrial / spot zoning of the industrial unit by the Department of Town and Country Planning, Punjab. Further condition may be imposed that the industry will not increase its area in any manner and there shall be no increase in pollution load. The investment made by the industry shall be on its own risk and cost. The project proponent has to comply with the conditions of the Master Plan / the Department of Town and Country Planning Punjab”
