File Note: Kindly peruse the note of RO…………… • It is submitted that the project proponent has applied for consent to establish (NOC) for development of residential colony namely ‘D.R. Estates’ in an area of 24.30 acres bearing Khasra Nos. 545/2/1, 545/3, 548, 549, 567, 568/1, 568/2, 325//26, 11/1, 20, 21, 324//15, 16, 25, 341//1, 342//3/2, 4, 5, 6, 7/1, 7/2, 8, 13/1, 13/2, 14, 15, 17, 18, 19, 22, 23, 24, 371//1/2/2, 2/1, 2/2, 3/1/1, 3/1/2, 3/2, 8/1, 8/2, 9/1, 9/2, 12/1 situated at Old Fazilka Road, Area Village Abohar-1, Tehsil Abohar, Distt. Fazilka for development of residential colony comprising 290 residential plots and 01 EWS plot………….. • The project proponent has submitted a copy of Letter of Intent (LOI) bearing memo No. 2035 dated 09.06.2025 issued by the Competent Authority i.e. Commissioner, Municipal Corporation, Abohar granting a license for setting up colony “D.R. Estates” bearing Khasra Nos. 545/2/1, 545/3, 548, 549, 567, 568/1, 568/2, 325//26, 11/1, 20, 21, 324//15, 16, 25, 341//1, 342//3/2, 4, 5, 6, 7/1, 7/2, 8, 13/1, 13/2, 14, 15, 17, 18, 19, 22, 23, 24, 371//1/2/2, 2/1, 2/2, 3/1/1, 3/1/2, 3/2, 8/1, 8/2, 9/1, 9/2, 12/1 situated at Old Fazilka Road, Abohar, Village Abohar-1, Tehsil Abohar, Distt. Fazilka, The proposal is as per the layout plan approved by the Competent Authority vide Application No. PB/LOUT/FKA/ABОНА/933 dated 19.05.2025…………….. • As per approval layout plan, total saleable area for 290 residential plots is 51207.49 sq.m and area for 01 EWS plot is 4916.80 sqm. Hence, total area of 290 residential plots and 01 EWS plot is 56124.29 sq.m. Considering maximum FAR 2.1, total built-up area of the project is 117861 sq.m., which is less than 1,50,000 sq. m, hence it is not covered under provisions of the EIA Notification dated 14.09.2006…………… • It is added that SEIAA Punjab vide letter no 205 dated 15.04.2019 has clarified that the projects with land area less than 50 ha but built-up area more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the EIA Notification2006 as amended from time to time. In this regard, the Board vide letter no. 10949 dated 09.05.2023 has sought a clarification from the Joint Director MoEF&CC, Chandigarh and reply of clarification is awaited………….. • It is further added that total land area of project is less than 50 ha and built-up area is less than 1,50,000 sq.m. Hence, as per MOEF&CC notification dated 29.01.2025, the project is not covered under the ambit of EIA notification 2006 & its subsequent amendments…….. • As per feasibility report submitted by the project proponent, total waste water generation will be 470 KLD. The PP has proposed to install sewage treatment plant (STP) of capacity 500 KLD, which seems adequate………… • As per proposal of the project proponent, 140 KLD treated effluent will be used in flushing, 60 KLD will be disposed in green area (1.21 acres land for green park and roadside greenery within the premises) and remaining 270 KLD treated effluent will be discharged into MC sewer……… • The PP has submitted NOC issued by Municipal Corporation, Abohar vide no. 3793 dated 06.10.2025 for discharge of treated domestic effluent into the MC sewer....... • As per proposal, Solid Waste Generation from the Project will be 2610 kg/d, which will be segregated at the source as bio-degradable and non-bio-biodegradable waste as per the SWM rules. The PP has also proposed in-situ remediation of the bio-degradable waste generated from the colony and the non-biodegradable will be handed over to MC Authorities……….. • The proposed site of the project was visited by AEE of RO, Sri Muktsar Sahib on 02.01.2026 and it was observed that:- 1. The project site is located near Old Fazilka Road, Abohar, Village Abohar-1, Tehsil Abohar, Distt. Fazilka falling within the jurisdiction of Municipal Corporation, Abohar. .................... 2. There is no MAH unit within 250 meters of the project boundary. Additionally, no air-polluting industry exists within a 100-meter radius of the site. Similarly, there are no rice shellers or stone crushers within 500 meters and no cement plants, hot mix plants, or brick kilns fall within 300 meters of the project area............... • RO has reported that site is suitable for establishment of the residential colony and has recommended for grant of Consent to Establish (NOC)…………………….. Keeping in view of above & recommendations of RO, if approved, Consent to Establish (NOC) may be granted to the project proponent from pollution angle for a period of one year for development of Residential colony namely ‘D.R. Estates’ in an area of 24.30 acres at Old Fazilka Road, Area Village Abohar-1, Tehsil Abohar, Distt. Fazilka for development of residential colony comprising 290 residential plots and 01 EWS plot, subject to suitable conditions and following special conditions that: - 1. The project proponent shall ensure that the total built-up area of the project remains below 1,50,000 sq. m. In case the built-up area exceeds 1,50,000 sq. m or the built-up area of any individual plot exceeds 20,000 sq. m, the project proponent is bound to obtain Environmental Clearance as per the provisions of the EIA Notification dated 14.09.2006……. 2. The project proponent is bound to comply with the decisions of MOEF&CC w.r.t. clarification raised by the Board vide letter no. 10949 dated 09.05.2023……………… 3. The Punjab Pollution Control Board is not responsible for any lose if the project covered under the ambient of EIA notification, 2006………………………… 4. Consent to Establish (NOC) is being granted for the development of the residential colony in an area of 24.30 acres in only those khasra numbers for which it has obtained permission from the concerned authority………………………. 5. In case, any of the document submitted by the project proponent found forged or incorrect, the Consent to Establish shall be deemed cancelled and the Board shall not be responsible for any cost incurred by the project proponent in this regard........... 6. The PP will develop the project as area development project and in no case the PP will develop the project as Building construction project by making construction on the individual plots without prior permission from the Board……….. 7. The project proponent shall install the STP of adequate capacity as proposed, simultaneously with the commissioning of the project…………. 8. The project proponent shall develop plantation over an area of 1.21 acres within the project premises for the disposal and utilization of treated wastewater, as proposed, before the commissioning of the project…………. 9. The project proponent shall utilize maximum treated effluent inside the premises for flushing through double plumbing, construction work, roadside sprinkling etc, and only surplus treated effluent will be discharged into MC sewer leading to terminal STP after getting assessed spare capacity of STP from MC Abohar/ PWSSB and after obtaining permission from the concerned authorities…………….. 10. It is made clear to the project proponent that in case the STP provided by Municipal Council Abohar do not have adequate treatment capacity, then the project proponent will make its own arrangement to utilize entire treated wastewater………………… 11. The project proponent shall not use fresh water in the green area/ plantation area and will make adequate arrangements to reuse the treated effluent for watering of green areas in the project premises…………… 12. The project proponent shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it………. 13. It will be sole responsibility of the Project Promoter to provide adequate treatment and disposal of effluent at any stage……….. 14. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016……. 15. The project proponent shall also develop the vermi-composting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies…….. 16. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic……….. 17. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises………. 18. This consent to establish is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required……………..
