As per the Order No. 3/6/07/STE(4)/2274 dated 25.07.2008 issued by the State Govt./ Punjab Pollution Control Board relating to siting of establishment of residential colonies, commercial establishments like shopping mall, multiplex, wherein,
i) All residential colonies, commercial establishments like shopping malls multiplexes etc. shall maintain a minimum distance of 250 metres from the hazardous (Maximum Accident Hazard).
ii) Minimum buffer of 15 meter green belt of broadly tree should be provided by the colonizer towards the air polluting industries boundaries.
Further, as per the amendment Order no. 3/6/07/STE(4)/3770 dated 30.10.2009, the State Govt. clarified that the Mater Plan is the final legal solution to planned development and hence the master plans be prepared in a time bound manner on priority. Where statutory master plan has been notified under the Punjab Regional and Town Planning and Development Act, 1995 (Amended) 2006; mix land use or any other development /construction which come up as per the earmarked zone, in case of new residential, commercial there is no need to keep any additional distance from the existing industry from the environment point of view because these factors have already been considered while earmarking the use of land for different categories in the master plan, as per Notification no. 6312, dated 11.08.2009 issued by Department of Housing & Urban Development.
Now, the site of the said residential colony is located in the residential zone of the notified Master plan, Sangrur. Moreover, there is no Maximum Accident Hazard (MAH industry) within 250 mtr radius of the site of residential colony and no air polluting industry within 100 mtr radius of the site of residential colony.
As such, the site of the residential colony is suitable for its establishment and development.
