File Note: It is submitted that the hotel was granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2021/15822920 dated 18.07.2021 valid till 19/6/2022 for construction of Hotel and Restaurant for 28 Rooms with disposal arrangements that domestic Effluent @ 15.0 KLD will be reuse in flushing after treatment through STP and partially discharge onto land for plantation/ irrigation/ horticulture within our premises (150 Sq. yard) subject to suitable conditions alongwith special conditions mentioned therein. The site of the project was visited by officers of the Board on 23/8/2024 and contacted Sh. Arjun Gupta, Manager. During visit, it was observed as under: 1) The hotel is having 28 Rooms and one Restaurant of sitting capacity approximately 25 no and same was in operation during the visit. 2) The hotel having one kitchen, but has not provided proper duct system to discharge the air emission generated from the kitchen. The hotel has not provided any oil and grease trap in the kitchen. 3) The hotel has installed two DG set of capacity 125 and 82 KVA respectively, with canopy and adequate stack height. The representative of the hotel informed that only 01 no. DG set of capacity 82 KVA is being operated. 4) The hotel has installed STP of capacity 15 KLD for the treatment of wastewater generated from the project. However, the same was not commissioned yet. 5) The wastewater generating from project is being lifted through mobile tankers and disposed off to unknown location. 6) The hotel has installed one washing machine of capacity 10 kg and one dryer and the effluent generated from the washing is being lifted through mobile tanker and disposed off to unknown location. 7) The solid waste was found not segregated and plastic waste was also found mixed with the same. The hotel has not provided mechanical composter for the treatment of wet-biodegradable solid waste. 8) The hotel has provided one borewell for abstraction of freshwater and no water meter provided with the same. 9) The construction work was found carrying out in the adjoining plot and about 70 % construction work has been completed. Further, as per structural conditions, it was appeared that the hotel is carrying out expansion of its existing hotel. However, the representative informed that the same was not constructed by them and after completion of construction work of the adjoining plot; they proposed to buy the plot in future. 10) The hotel is operating without obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and carrying out expansion in hotel without obtaining consent to establish (NOC) of the Board. The project promoter is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention and Control of Pollution) Act, 1981 as well as conditions mentioned in the consent to establish (NOC) earlier granted to it under the provisions of the said Acts and is operating its unit without obtaining consent to operate of the Board as required under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, thus, violating the provisions of the said Acts intentionally and deliberately. Accordingly, the project promoter was served show cause notice for revocation/ cancellation of consent to operate granted under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 vide Board's letter no. 4016-17 dated 5/11/2024 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on 14/11/2024, wherein, it was decided that the Environmental Engineer, Regional Office, SAS Nagar shall visit the site to verify the statement given by the industry during hearing, verify the compliances at site, process the consent applications and send its report with concrete recommendations within 7 days. The project promoter had applied for ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 on 24.11.2024. However, the said applications were returned to it being incomplete. The site of the project promoter was now visited by officer of this office and during visit, it was observed as under: 1. The hotel is having 28 no. Rooms & 01 No. Restaurant of sitting capacity approximately 25 no. and same was in operation during the visit. 2. The hotel has one no. kitchen and the hotel has not provided any oil and grease trap in the kitchen. 3. The hotel has installed 02 no. DG set of capacity 125 and 82 KVA respectively, with canopy and adequate stack height. The representative of the hotel informed that only 01 no. DG set of capacity 82 KVA is being operated. 4. The hotel has installed STP of capacity 15 KLD for the treatment of wastewater generated from the project. However, the same was not operational. 4. The wastewater generating from hotel is being lifted through mobile tankers and disposed off to unknown location. 5. The hotel has not provided any proper arrangements for disposal of wastewater. 6. The solid waste was found not segregated and plastic waste was also found mixed with the same. The hotel has not provided mechanical composter for the treatment of wet-biodegradable solid waste. 7. The hotel has provided 01. no. borewell for abstraction of freshwater and no water meter provided with the same. 8. The construction work was found carrying out in the adjoining plot and about 85-90% construction work has been completed. The pp has not yet obtained ‘consent to establish’ (NOC) expansion for the said part. 9. The hotel is operating without obtaining consent to operate under Water Act, 1974 and Air Act, 1981 and carrying out expansion in hotel without obtaining consent to establish (NOC) of the Board. Accordingly, the show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 issued to the project promoter vide Board's letter no. 3086 dated 23/07/2025 alongwith an opportunity to appear in person before the Senior Environmental Engineer (ZP-1) of the Board in his office at Vatavaran Bhawan, Head Office, Nabha Road, Patiala on 05/08/2025 at 11:00 am, wherein, it was decided that: 1. The project proponent shall deposit bank guarantee amounting to Rs. 1.0 lac as an assurance to comply with the environmental laws, within 7 days in Regional Office, SAS Nagar. 2. The project proponent shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, within 15 days. 3. The Environmental Engineer, Regional Office, SAS Nagar shall visit the project after 15 days, to verify the submission of the representative of the project proponent made during the hearing, process the consent applications and send report along with recommendations accordingly. The hotel was visited by the undersigned on 22.09.2025. During the visit, it was observed as under: 1. The hotel is having 28 nos. Rooms & 01 No. Restaurant of sitting capacity approximately 25 no and same was in operation during the visit. 2. The hotel has installed STP of capacity 15 KLD for the treatment of wastewater generated from the project. However, the same was not operation during the visit. No record is being maintained regarding operation of STP. No inlet & outlet meter provided over it. 3. The hotel has not provided any oil and grease trap in the kitchen. 4. The wastewater generated from the project is being directly discharged into sewer without any treatment. 5. The hotel has provided 01. no. borewell for abstraction of freshwater and no water meter provided with the same. 6. The wastewater generating from hotel is being lifted through mobile tankers and disposed off to unknown location. 7. The hotel has installed 01 no. DG set of unknow capacity and has not provided adequate stack height with the same. 8. The hotel has not provided any proper arrangements for disposal of wastewater. 9. The project proponent has not provided any in-situ arrangement for the management of wet biodegradable solid waste generated from the project. The hotel has not provided mechanical composter for the treatment of wet-biodegradable solid waste. 10. The construction work of adjoining plot has been completed and finishing work of the same is under progress. The hotel has not yet obtained ‘consent to establish’ (NOC) expansion for the said part. 11. The hotel is operating without obtaining consent to operate under Water Act, 1974 and Air Act, 1981 and carrying out expansion in hotel without obtaining consent to establish (NOC) of the Board. The project proponent has submitted bank guarantee amounting to Rs. 1 lacs in compliance to the decision no. 1 of the personal hearing. In the meantime, the project proponent had applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 for hotel 28 no. rooms and 1 no. food court of capacity 25 persons having built up area 2000 sqm, through OCMMS. The project proponent was given personal hearing before the Senior Environmental Engineer of the Board on 26.11.2025, wherein, it was decided as under: 1. The project proponent shall ensure uninterrupted and efficient operation of the 15 KLD STP and maintain complete logbooks of flow, dosing, sludge handling and maintenance. Inlet and outlet meters shall be kept functional at all times and records shall be produced during inspections. Further, the surplus treated effluent shall be discharged onto land for plantation in the plantation area developed as per Karnal Technology. 2. The project proponent shall not carry out any activity in the adjoining purchased building, and no expansion or operational use of the said premises shall commence without first obtaining Consent to Establish (NOC) and Consent to Operate from the Board. 3. The Environmental Engineer, Regional Office, SAS Nagar shall conduct a surprise inspection within 7 days to verify the compliance claims made during the hearing, including the functioning of the STP, status of the DG set, water abstraction, wastewater disposal arrangements and solid-waste management system and submit a comprehensive report with conclusive recommendations to decide the CTO applications of the project. 4. Further action shall be taken after receipt of report from the Regional Office. To verify the compliance of the decisions of the personal hearing, the site was visited by the undersigned on 19.12.2025. During the visit, it was observed as under: 1. The hotel is having 28 nos. Rooms & 01 No. Restaurant of sitting capacity approximately 25 no and same was in operation during the visit. 2. The hotel has installed STP of capacity 15 KLD for the treatment of wastewater generated from the project and the same was in operation during the visit. The project proponent has started maintaining record regarding operation of STP. The project proponent has now provided inlet & outlet meter. 3. The hotel has now provided oil and grease trap in the kitchen section. 4. The project proponent is now utilizing the treated effluent into flushing purpose and onto land for plantation developed as per Karnal Technology. 5. The hotel has provided 01. no. borewell for abstraction of freshwater and water meter provided with the same. 6. The hotel has installed 01 no. DG set of capacity 125 KVA with canopy and adequate stack height. 7. The project proponent has now provided compost pits for the management of wet biodegradable Solid waste. 8. The project proponent has now stopped the construction activities at the site for expansion of the project. 9. Photographs taken during the visit are as under: From the above, it is found that the project proponent is now complying with decisions of the personal hearing and removed the violations observed during the earlier visit. Accordingly, the project proponent was granted fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2025/29979061 dated 29.12.2025 valid upto 30.06.2026, subject to certain terms and conditions mentioned therein. Now, the project proponent has applied for obtaining fresh consent to operate under the provisions of the Air (Prevention & Control of Pollution) Act, 1981, alongwith requisite documents. The project proponent has deposited Rs. 61100/- vide R. No. 342030338 dated 16.04.2024 & Rs. 26100/- vide R. No. 433134211 dated 13.10.2025 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the project proponent is adequate upto 30.06.2026 after adjusting late fee/ penalty against the total cost of the project Rs. 265.15 lacs. The project proponent has submitted layout plan approved by the Competent Authority. The project proponent has submitted agreement regarding disposal of excess treated wastewater and the same is given below: The project proponent has submitted completion certificate regarding installation of STP of capacity 15 KLD issued by M/s Enviro Care Solution on 08.04.2024. From the above, it is found that the project proponent is now complying with decisions of the personal hearing as well as the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. In view of the above, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30.06.2026, subject to suitable conditions and following special conditions that: 1. The project proponent shall immediately apply for consent to establish (NOC) for expansion for the additional construction activities to be carried out at the site for expansion of the project. 2. The project proponent shall ensure compliance to the comprehensive guidelines for the regulation of noise/sound pollution caused by use loud speakers, public address system etc. issued vide Punjab Government, Deptt. of Science Technology & Environmental notification no. 3/100/2013-STP (4)/145 dated 26.2.2014. 3. The project proponent shall comply with the guidelines/mechanism prescribed by CPCB in compliance of NGT order dated 17.12.2019 as directed by the Board vide its office order no. 64 dated 02.02.2021. 4. The project proponent shall comply with the provisions of the Solid Waste Management Rules, 2016 for disposal of solid waste generated from the palace. 5. The project proponent shall comply with the provisions of Noise Pollution (Regulation & Control) Rules, 2000. 6. The project proponent shall comply with the guidelines of Punjab Water Regulation and Development Authority (PWRDA), issued for the abstraction of ground water from time to time. 7. The project proponent shall ensure that the solid waste is handled and disposed of properly. 8. The project proponent of the project shall not allow to play the DJ/ music system outside the hall and not beyond 10.00 PM in any case in compliance to directions issued by the Board vide no. 196 Dated 30.04.2018. 9. The project proponent shall ensure that no treated effluent is being discharged into sewer and any other unscientific mode. The entire treated effluent shall be utilized for flushing purposes and excess onto land for plantation in the area developed as per Karnal Technology. 10. The project proponent shall provide proper rain water harvesting system for recharging of ground water as per the guidelines mentioned in the manual published by the MoEF&CC for construction projects and shall report the compliance in this regard to the Board, thereafter. 11. The project proponent will provide a banner displaying that in compliance to the orders of the Supreme Court it will not use loud speakers between 10:00 pm to 06:00 am. 12. The marriage palace ensure provision of necessary hoods, ducting and adequate stack for dissipation of heat, fuel emissions & fugitive emissions at adequate height but not less than 9.0 mt from GL and 3 mt from Roof level. 13. The project proponent shall comply with the provisions of Solid Waste Management Rules, 2016 and the orders passed by the Hon’ble National Green Tribunal on 22.12.2016 in the case of O.A. 199 of 2014 titled as Almita H. Patil v/s Union of India & others, in true letter and spirit. 14. The project proponent shall ensure the compliance of ambient noise standards laid down by the Board vide notification no. 734 dated 06.12.1993 under the Air (Prevention & Control of Pollution) Act, 1981. 15. The project proponent shall not install any boiler/furnace without the prior written permission of the Board. 16. The project proponent is bound to comply with the Mechanism/ guidelines prescribed by the CPCB along with the modifications/ amendments if any made by the State Govt. in these siting guidelines. 17. The project proponent shall ensure segregation of the solid waste at source, facilitate collection of segregated waste in separate streams, handover recyclable material to either authorized waste pickers or authorized recyclers as prescribed in Solid Waste Management Rules, 2016. 18. The project proponent shall promote solar energy and various areas and such as illumination and water heating. 19. The project proponent shall encourage the use of invertors instead of DG sets. 20. The promoter company shall not consume any fuel except HSD for DG set, for burning purposes without the prior written permission of the Board. 21. The promoter company shall obtain Consent to Operate under the Air Act, 1981 within 15 days. 22. The promoter company shall apply for Authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 (HWM) immediately. 23. The project proponent shall not discharge any domestic effluent (treated or untreated) into choe / drain /river or in any inland surface water at any time or any other unauthorized place by any unauthorized means and shall explore the possibility of reduction of quantum of abstraction of ground water by reusing the treated wastewater in the various activities. 24. The industry shall ensure compliance of provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and or any other environment law applicable to him and rules, circulars issued by the Board from time to time. 25. In case of any violation action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated for closure of the project proponent without further notice. *Competency: Senior Environmental Engineer
