File Note: It is submitted that the project proponent was earlier granted fresh “Consent to Establish” (NOC) under the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/PBIP/SAS/2023/2311872113 dated 19.12.2023 having validity upto 19.11.2024, subject to certain conditions as mentioned therein and some of the following additional conditions that: 4. The promoter company shall develop a 15m wide green belt of broad leaf trees towards the poultry farms, so as to attenuate the odour issue from the said farms. The promoter company shall also get the green belt earmarked in the layout plan of the project, to be approved by the competent authority. 5. The project proponent shall get its layout plan approved from the competent authority under the PUPDB Rules, 2021 (& further amendments issued thereto) within 3 months & submit compliance to the Board, without fail. Further, the project proponent shall earmark the site for the location / installation of STP as well as solid waste management facility / area and the green buffer of 15 m width incorporated in the conceptual layout plan to be got approved from the competent authority 10. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose @ 192 KLD and shall develop adequate green area (2779 sqm) for discharge of the treated effluent after STP @ 15 KLD and the remaining treated effluent shall be utilized onto proposed area to be developed into plantation area as per Karnal Technology (3036 sqm of green area and 5060 sqm of green belt), as proposed by it. 11. The land proposed by the project proponent for development of plantation area as per Karnal technology for utilization of its treated effluent after STP shall be developed inconsonance to the development of the project and the said land shall not be used for any other purpose. The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if any. Thereafter, the consent to establish (NOC) was granted to the project proponent vide no. CTE/Fresh/PBIP/SAS/2023/2311872113 dated 19/12/2023, valid upto 19/11/2024, is hereby extended upto 18/11/2025 with the same conditions as mentioned therein alongwith the additional special condition that the project proponent will develop 15 m green belt in the land bearing Khasra no. 8 (4-0), 9 (4-0), 10 (4-13) and Khasra no. 1572/7 (3-4), 1573/7 (0-16) towards the nearby poultry farm adjoining to the project site, in lieu of the special condition no. 4 & 5 mentioned in consent to establish (NOC) earlier granted to it. Further, as per the policy of the Board dated 30.04.2013: "Every entrepreneur is expected to complete the construction of industrial unit/ project and the installation of the pollution control equipment's within the validity period of the N.O.C. But in case the industry/ project promoter fails to implement the project within the validity period of the N.O.C, then, the industry/project promoter will be required to get the NOC revalidated. For this purpose, the industry is required to submit the progress made regarding the installation of Pollution control devices viz-a-viz main project to the concerned Regional Office of the Board. Such request shall be acceded to only if the progress made by the industry regarding installation of pollution control devices is commensurate with the main project both in physical as well as financial terms." It is submitted that, before considering any further request of the project proponent regarding revalidation / extension of the Consent to Establish (NOC), it is necessary to ascertain the present status of compliance of the specific conditions imposed in the previously granted CTE(s), particularly in view of the Board’s Policy dated 30.04.2013 regarding revalidation of NOC, which stipulates that the physical and financial progress of the project must be commensurate with the installation / provision of pollution control systems. If approved; the application be sent back to the Regional Office with to furnish clarification on the following points: 1. Whether the project proponent has submitted the revised / final layout plan duly approved by the competent authority under the PUPDB Rules, incorporating the earmarked 15-metre-wide green buffer / green belt towards the poultry farms, as required under the special conditions of the earlier CTE and subsequent extension? 2. Whether the 15-metre green belt along the side of the poultry farms, as specified to be developed over the land falling in Khasra No. 8 (4-0), 9 (4-0), 10 (4-13), 1572/7 (3-4), 1573/7 (0-16), has actually been developed at site? 3. Whether the plantation area proposed to be developed as per Karnal Technology for utilization of treated effluent after STP has been identified, stabilized and developed in consonance with the stage of physical development of the project and whether the said land remains exclusively earmarked for this purpose? 4. Whether construction of residential units / houses has commenced at site. In case the construction activity has begun, whether the required plantation areas (including green belt and Karnal Technology plantation) will be fully established and functional prior to or concurrently with occupation / commissioning of dwelling units? 5. In case the plantation development is still pending, whether a realistic timeline and implementation plan exists? 6. The RO is further required to certify whether the overall physical and financial progress of the project is commensurate with the progress made toward provision / installation of environmental safeguard measures, including STP, treated effluent reuse system, plantation areas and solid waste management facilities, strictly as required under the conditions of CTE.
