As discussed with your goodself, it is submitted that with reference to the Board’s Letter No. 16681-96 dated 03.08.2022, the CTP letter dated 04.09.2021, and the memo dated 21.06.2022 in which mentioning under the heading namely, Industry in the Mix Land Use Zone. “All orange and red category of industries along with other activities permissible in mix land use zone shall be allowed along the highway/major roads beyond 4 kilometers from the municipal limits of Amritsar, Jalandhar and Ludhiana Corporation, 3 kilometers from the limits of other Corporation and Class A town limits, and 2 kilometers from other towns."
The Board has also commented that as per notification dated 24.09.2021 and relevant part of the same is as under: -
“ਇਸ ਲਈ ਇਸ ਵਿੱਚ ਦਰਜ ਵੱਖ-ਵੱਖ ਉਦਯੋਗਿਕ ਇਕਾਈਆਂ (Red, Orange and Green) ਦੀ Permissibility ਸੰਬੰਧੀ ਕਲਾਜ਼ ਮੰਨਣੀ ਬਣਦੀ ਹੈ, ਭਾਵ ਮਿਤੀ 24.09.2021 ਨੂੰ ਜਾਰੀ ਕੀਤੀ ਗਈ ਨੋਟੀਫਿਕੇਸ਼ਨ ਵਿੱਚ ਦਰਜ ਕੀਤੇ ਅਨੁਸਾਰ Mix Land Use Zone ਅੰਦਰ ਦਰਜ ਸਹਤਾ ਸਹਿਤ Red Category industry ਆਗਿਆ ਯੋਗ ਹੈ। “
Sir, it is pertinent to mentioned here that the industry falls in mix land use and the distance from the near by Municipal Council is more than 4 km. Also, industry has submitted request letter that the baby boiler of capacity 500 kg is for limited use only.
Keeping in view of above, it is recommended that varied consent to operate under Air (Prevention and Control of Pollution) Act, 1981 may be granted to the industry for six months with special condition that the industry shall submit a DTP certificate mentioning as to whether the installation of baby boiler is allowed in the existing unit in the said industrial zone.
