File Note:  It is submitted that the project is a Residential Township namely Eldeco Estate One at Village-Rajpura, Hussainpura and Bhatian, Ludhiana was issued SCN and the decisions of personal hearing before the Chairperson of the Board on 12.01.2022, were as under:- 1. The consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 applied by the promoter company be refused due to violation of the provisions of the Environmental Clearance obtained by the project proponent from SEIAA, Punjab as well as other as due to other violations. 2. The bank guarantee of Rs. 20 lacs already submitted by the project proponent as an assurance to comply with the provisions of environmental laws be got en-cashed. 3. The project proponent shall deposit the Environmental Compensation of Rs. 1,30,50,000/- earlier imposed by the Board already conveyed to the project proponent vide order no. 330 dated 25.07.2024, within 07 days, failing which the matter shall be referred to the Revenue Authorities for recovery of the same. 4. The project proponent shall not connect its effluent to the MC sewer and other mode of disposal which violates Environmental Clearance conditions till the revised Environmental Clearance and NOC of the Board is obtained. 5. The following directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to the project proponent and concerned Departments: a. The Revenue Authorities / Registrar of Land be directed not to register any sale deed related to any plot/flat/house/shop/any other component of this project with immediate effect and the entries to this effect shall also be made in the revenue record/jamabandi. b. The GLADA Authorities shall be directed to not issue partial completion / completion certificate to the project and shall not sanction any new building plans in the residential colony for any plot/flat/house/shop/any other component of this project. c. The Punjab State Power Corporation Limited Authorities be directed not to issue any new electric connection related to any plot/flat/house/shop/any other component of this project with immediate effect. 6. The Environmental Engineer, Regional Office-3, Ludhiana shall submit the compliance report w.r.t decision of the personal hearing as per time schedule. EE, RO shall provide the current status of legal action to be taken against the project proponent and its directors for violation of conditions of environmental clearance and provisions of Water Act, 1974 as already approved during hearing dated 07.07.2022. Accordingly, the consent to operate applied by the promoter company were refused under the Water (Prevention & Control of Pollution) Act, 1974 Vide No. OCMMS/CTO(Water)/2025/006971 dated 21.07.2025 and under the Air (Prevention & Control of Pollution) Act, 1981 Vide No. OCMMS/CTO(Air)/2025/006972 dated 21.07.2025. The necessary directions were issued to the PSPCL Authorities vide no PPCB/SEE/ZO-2/LDH/2025/ 4518-19 dated 21.07.2025 as under: “That Authorities concerned shall not issue any new electric connection related to any plot/flat/house/shop/any other component of this project with immediate effect.” Directions were issued to the Revenue Authorities vide no PPCB/SEE/ZO-2/LDH/2025/ 4522 dated 21.07.2025 as under: “That Authorities concerned shall not register any sale deed related to any plot/flat/house/shop/any other component of this project with immediate effect and the entries to this effect shall also be made in the revenue record/jamabandi .” Directions were issued to the GLADA Authorities vide no PPCB/SEE/ZO-2/LDH/2025/ 4525 dated 21.07.2025as under: “That the Authorities concerned shall not issue partial completion/completion certificate to the project and shall not any new building plans in the residential colony for any plot/flat/house/shop/any other component of this project.” The project proponent has filed Appeal No. 17 of 2025 (I.A. Nos. 148/2025 & 140/2025) before the Hon'ble NGT against the Environmental Compensation imposed by the Board. The Hon'ble NGT passed order dated 15.10.2025 is as under: “Pressing the prayer for stay made in the IA No. 565/2025, learned Counsel for the Appellant submits that by invoking the bank guarantee a sum of Rs. 20 lakhs has been recovered. She submits that the Appellant is ready to deposit further sum of Rs. 30 lakhs and on deposit of the same, the impugned order be stayed.” “By the impugned order, environmental compensation of Rs. 1,30,50,000/- has been imposed. If the Appellant deposits 50% of the said amount including the amount already deposited, the Respondent will not take coercive action in pursuance to the impugned order till the next date of hearing.” The total Environmental Compensation imposed to the project proponent is Rs. 1,30,50,000/- in which the bank guarantee bearing no. 027GT02242950009 dated 21.10.2024 valid upto 02.10.2025 of Rs. 20 lacs submitted by the project proponent has been encashed vide this office letter no. 2821 dated 25.07.2025 and the remaining 50% amount of total Environmental Compensation imposed i.e. Total Rs. 1,30,50,000/2 = Rs. 65,25,000 – Rs. 20,00,000= Rs. 45,25,000 was deposited by the project proponent vide R/No. 74/5376 dated 10.11.2025, in compliance of the order passed by Hon’ble National Green Tribunal, New Delhi dated 15.10.2025. As per the order passed by Hon'ble NGT dated 15.10.2025 on the Appeal No. 17 of 2025 (I.A. Nos. 148/2025 & 140/2025) that,”the Respondent will not take coercive action in pursuance to the impugned order till the next date of hearing.” The copy of the Hon’ble NGT is attached for kind perusal please.  The total water balance for all three seasons after expansion was as under: - • Total water requirement=1823 KLD which includes fresh water @927 KLD & treated waste water @896 KLD in summer season. • Total water requirement=1685 KLD which includes fresh water @927 KLD & treated waste water @758 KLD in winter season. • Total water requirement=1636 KLD which includes fresh water @927 KLD & treated waste water @709 KLD in monsoon season. • Wastewatergenerati0n=1223KLD • STP capacity 1470 KLD  For disposal of treated waste water, as per previous visit dated 19.03.2025, the estimated discharge of colony was 415.6 KLD after flushing through dual plumbing system. But as per current status of occupancy, the residential colony out of total 743 units (Villas-158, Floors-222, Plots-346, SCO-14, Industrial Plots-02, Institutional Plots-01), 505 (Villas-138, Floors-162, Plots-199, SCO-06) have been occupied by the residents. Accordingly, the waste water generations comes to approximately 275 KLD (Calculations = 505 x 5 x 135 = 340875 @ 80% = 272700 =272.7 KLD say 275 KLD). The residential colony has 04 acres 06 kanals land as per Karnal technology and this land can handle 4.75 acre x 60 KLD/acre = 285 KLD discharge. The record of STP for the last three months is attached herewith as desired please. As per the record of outlet of STP of the housing colony an average waste water generation is below 285 KLD. The plantation area developed by the colony is adequate for disposal of the same.  It is submitted that as per the EC condition the additional plantation area of 4 Acre and 20 Acre was proposed for the disposal of surplus water. However, at present the generation of effluent from the project is below 285 KLD and for the disposal of the same it has already developed the green area inside the project and plantation area outside the project in an area of 4 Acres as already detailed in previous note. Hence the plantation area is adequate in light of present effluent generation of the project. However as per EC condition the project proponent will be bound to develop the additional plantation area of 20 Acres for the disposal of surplus water as and when its effluent generation will increase with increase in the occupancy of the project.  Compliance of the Environmental Clearance submitted by the project proponent is also attached herewith.  The last effluent samples are also found within the limits and the project is presently complying.  Further, in compliance of Hon’ble NGT order mentioned above, separate E-note bearing No. 30843395 has been already processed to kept in abeyance the following directions issued by the Board to the concerned authorities till the next date of hearing i.e. on 19.01.2026, please:- 1. Directions issued to the PSPCL Authorities vide no PPCB/SEE/ZO-2/LDH/2025/ 4518-19 dated 21.07.2025. 2. Directions issued to the Revenue Authorities vide no PPCB/SEE/ZO-2/LDH/2025/ 4522 dated 21.07.2025. 3. Directions issued to the GLADA Authorities vide no PPCB/SEE/ZO-2/LDH/2025/ 4525 dated 21.07.2025. In view of the above, it is recommended the short time consent to operate be granted to the housing colony for one year with following conditions:- 1. The housing colony will provide adequate manpower for regular operation of its STPs for treatment of domestic effluent. 2. The housing colony will dedicatedly maintain the plantation area for disposal of domestic effluent and ensure that there should be no stagnation. 3. The project proponent shall be bound to develop the additional plantation area of 20 Acres for the disposal of surplus water as and when its effluent generation will increase as per the EC condition and shall obtain the prior NOC/Consent from the Board. 4. The housing colony will provide adequate manpower for compliance of solid waste management rules. Competency: Worthy Chairperson of the Board.
