It is submitted that Project Proponent was earlier granted ‘consent to establish’ (NOC) from the Board under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/BAR/2023/21823029 dated 25.07.2023 for establishment of Colony having approved Residential Township in 9.911 acre (107 Residential Plots + 28 no. commercial shops + 01 religious building) under the name & style of M/s Ganpati Enclave, Opposite D Mart, Handiaya Road, Barnala with the discharge of domestic effluent @ 72.0 KLD treated in the Common STP with M/s Ganpati Enclave (Extension 1) with validity upto 24/07/2024.
The project proponent had submitted feasibility report vide its last NOC application (21823029), wherein the project proponent has proposed to install combined STP for treatment of wastewater generated from M/s Ganpati Enclave & M/s Ganpati Enclave (Ext-1) of capacity250±10% KLD consisting of Bar Screen, Collection tank cum equalization tank, Primary clarifier, Aeration tank, Secondary clarifier, Multi-grade pressure depthfilter and sludge drying beds.
The PP had proposed to generate 193 KLD of wastewater from M/s Ganpati Enclave (Ext. -1) and 72 KLD from M/s Ganpati Enclave. The entire wastewater of township to the tune of 265 KLD after the treatment through 300KLD Common STP will be utilized onto land for plantation measuring 6500 sqm in the green area / green belts alongside road &pavements in the premises of Ganpati Enclave and 13000 sqm in the green area/ green belts alongside road & pavements in the premises of Ganpati Enclave(Ext.-1).
The project proponent had proposed to convert kitchen waste and green waste into compost through vermi-composting at site. Further, it had also proposed to sold out recyclable waste to authorized recycling units and other waste will beget lifted through MC, Barnala.
The project proponent had submitted an affidavit dated 08.07.2023 stated that :-
1.That we will install common STP for treatment of 265 KLD effluent(proposed) to be generated from residential colonies namely- M/s Ganpati Enclave and M/s Ganpati Enclave Ext. 1 (Promoter & Developed by Ganpati Builders and Developers) located at opposite D Mart,Handiaya Road, Barnala.
2. That we will develop 4.90 acre of green area in above said residential colonies and treated effluent of 30-50 KLD generated after STP will be used for plantation purposes in that green area. The treated effluent wil lalso be used in construction activities of the colonies
3. That at present, MC sewer is not available at the site of colony. But, we have obtained permission from EO, MC, Barnala vide no. 411/B dated06/10/2022, that the colonies can discharge its treated effluent into MC sewer as and when MC sewer would install in the area, subject to certain condition as mentioned in said permission
4. That for the utilization/disposal of surplus treated effluent, we will make arrangements to provide sewerage line from the colony upto MC sewer at our own cost after obtaining prior permission from the concerned Department, when the discharge of colony increases from 50 KLD; in case, MC sewer will not available. Or We will be bound to develop plantation area as per Karnal Technology to utilized the entire treated effluent of qty. 265 KLD.
It is pertinent to mention that the above wastewater generation quantity has been calculated by considering 05 persons per residential plot
Thereafter, the project had granted revised CTE vide no. CTE/Fresh/BAR/2024/24822407 dated 18.03.2024 for the Residential Plots @ 109 Number/Day, Commercial Plots @ 28 Number/Day and Religious Building @ 1 Number/Day in an area 9.911 acre, for discharge of domestic effluent @ 72.0 KLD treated in the Common STP with M/s Ganpati Enclave (Extension 1) with validity upto 24/07/2024, with special conditions mentioned therein.
Then, the project proponent had auto-renewed the same vide no. CTE/Renewal/BAR/2024/26873234 dated 17.09.2024, which was valid upto 17.09.2025.
Afterward, the project proponent had applied for Consent to Operate under Water Act, 1974 and Air Act, 1981 28464443 & 28464292 dated 21.05.2025, 24712290 & 24713650 dated 09.06.2025 and 30221449 & 30221420 dated 27.10.2025, for full occupancy of 109 residential, 28 commercial plots and 01 religious building but during visit there were only 07 houses constructed out of which 06 are occupied and 25 are under construction, the same were returned with request to apply partial consent with present occupancy.
Now, the project proponent has applied for consent to operate under the Water Act, 1974 & Air Act, 1981 for the Residential Plots @ 109 Number/Day, Commercial Plots @ 28 Number/Day and Religious Building @ 1 Number/Day in an area 9.911 acre, for the generation of solid waste @ 200 Kg/Day same is disposed through MC, Barnala. And for discharge of domestic effluent @ 73.5.0 KLD treated in the Common STP with M/s Ganpati Enclave (Extension 1) the same is disposal in the green plantation area within the complex. The details of the case is as under:
1. The PP has deposited Rs. 11300/- (Rs. 10800/- under Water Act, and Rs. 500/- application form fee) vide receipt no. CNRBN52025051748160947 dated 17.05.2025 under the Water Act, 1974 and Rs. 11300/- (Rs. 10800/- under Air Act, and Rs. 500/- application form fee) vide receipt no. CNRBN52025051748198974 dated 17.05.2025 for the fixed assets Rs. 343.89 as per CA certificate dated 16.05.2025. The Project cost during CTE application was shown as 723.32 lacs by PP.
2. The project proponent has submitted a copy of approval for residential colony issued by the Local Govt., Punjab vide letter memo no. DTP/SS/No-2016-276 dated 04/02/2016 for the land measuring 9.911 acres.
3. The project proponent has submitted approved layout plan of the proposed colony approved by Executive Officer, Municipal Council, Barnala having an area of 9.91 acres.
4. The project proponent has submitted a self-affirmation that the they have installed Sewage Treatment Plant (STP) with a capacity of 650 KLD within the premises of Ganpati Enclave Extension-I. The domestic sewage generated from both Ganpati Enclave (estimated 73.5 KLD) and Ganpati Enclave Extension-I (approximately 531 KLD) is treated at this facility.
Moreover, during the scrutiny of CTO application it is observed as under:
1. The project proponent has not submitted agreement/permission/NOC from MC, Barnala for the disposal of solid waste generated from the premises.
2. The PP has not submitted details of water requirement, wastewater generation, and quantity breakdown of its utilization on Green Area/Dual Plumbing/Karnal Technology as per the current occupancy of residential houses, including reuse of treated wastewater.
3. The Project Proponent has not submitted the STP completion certificate, duly issued by the STP installation engineer / authorized technician, certifying successful installation and readiness for operation and capacity of STP.
4. As per special condition no. 03 mentioned in the CTE issued vide dated 18.03.2024, the project proponent shall provide dual plumbing system to re-use the treated water for flushing purposes. However, the PP has not submitted any layout/line diagram/document showing treated waste water distribution system for dual plumbing.
5. As per special condition no. 06 mentioned in the CTE issued vide dated 18.03.2024, the project proponent shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for the abstraction of ground water and submit the same to the Board before commissioning of the project. However, the PP has not submitted any document regarding this.
6. As per SEIAA norms, the estimation of population and water demand for M/s Ganpati Enclave has been worked out considering the following:
Residential plots:109 plots × 15 persons per plot × 135 LPCD
Commercial plots:28 plots × 2 persons per plot × 45 LPCD
Floating population:15% of total population at the rate of 15 LPCD
Accordingly, the total fresh water requirement works out to be approx. 227.055 KLD, and the wastewater generation, if taken as 80% of fresh water consumption, comes to approx. 181.64 KLD.
However, in the feasibility report submitted during the CTE application, only 5 persons per residential plot have been considered and the wastewater generation has been shown as 73.5 KLD, which is much lower than the requirement as per SEIAA norms.
To process the application, the site of the Colony was visited by AEE and JEE of this office on 06.01.2026 and it was observed as under: -
1. The residential colony is located on Handiaya Road, Barnala and falls within the Municipal Council (MC) limits.
2. During the site visit, it was observed that out of 109 residential plots, only 07 houses were constructed and occupied, while about 15-20 houses were under construction. No separate boundary wall or physical demarcation has been provided to distinguish Ganpati Enclave and Ganpati Enclave Extension-1.
3. As per the CTO application, fresh water consumption of 92 KLD has been considered for domestic purposes. However, during the visit, it was observed that no water meter has been installed on the fresh water supply pipeline/tubewell to maintain record of abstraction of groundwater.
4. Project Proponent has installed a common STP based upon MBBR Technology within the premises of M/s Ganpati Enclave (Extension-1) for treatment of wastewater generated from both colonies, i.e., Ganpati Enclave(Domestic effluent @ 72 KLD) and Ganpati Enclave (Ext-1) (Domestic effluent @ 531 KLD). During the visit, the STP was not in operation, and no operational records were being maintained.
5. As per the layout plan approved by the Executive Officer, MC Barnala, a separate STP was required to be installed within the premises of M/s Ganpati Enclave. However, no STP has been installed at the location shown in the approved layout plan. As per SEIAA norms, the calculated wastewater generation from M/s Ganpati Enclave is approximately 181.64 KLD. Accordingly, the Project Proponent is required to install an STP of at least 200± 20% KLD capacity at the location specified in the layout plan approved by EO, MC Barnala.
6. During the visit, the STP was not in operation. The representative of the colony informed that they will discharge waste water into nearby vacant plot when collection tank at the outlet of STP get fully filled.
7. The Project Proponent has not provided a dual plumbing system for reuse of treated wastewater for flushing purposes, as required under the special conditions of the NOC. Further, no distribution pipeline network has been provided for utilization of treated wastewater in the green belt / park areas of both colonies.
8. The Project Proponent has not developed any plantation area as per Karnal Technology. Instead, a plain plantation area of approximately 2.80 acres, located outside both colonies, was shown, wherein only small plants of about 1-1.5 feet height have been planted. Further, no pipeline network has been provided to convey treated effluent from the STP outlet to the said plantation area.
9. No municipal sewer line has been laid in the area by the MC, Barnala where both colonies have been developed.
10. Being a bulk solid waste generator, the Project Proponent has not provided any compost pits for in-house management of biodegradable solid waste generated from the premises of both colonies. Further, no service/community bins have been placed for collection and segregation of solid waste, despite such provision being mentioned in the feasibility report submitted during the CTE application. The project proponent is required to install mechanical composter for the management of solid waste.
11. The project proponent needs to apply for partial consent to operate under both Water Act, 1974 & Air Act, 1981 as per present domestic effluent discharge. (photographs attached for reference)
From the above, it is evident that the Project Proponent is not complying with provisions of the Water (Prevention and Control of Pollution) Act, 1974 & Air (Prevention and Control of Pollution) Act, 1981 as well as Solid Waste Management Rules, 2016.
In view of the above, it is recommended that:
1. The project proponent of M/s Ganpati Enclave needs to obtain fresh NOC/CTE as it requires to install separate STP as per layout plan approved by EO, MC, Barnala.
2. Action under the provisions of Water (Prevention and Control of Pollution) Act, 1974 & Air (Prevention and Control of Pollution) Act, 1981 may be initiated against the project, due to aforesaid reasons.
