It is submitted that brick kiln is a Small Scale / Orange Category existing unit. It has already been obtained the Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 vide No. CTOA/Renewal/LDH2/2022/17742028 dated 12/01/2022 valid upto 30/09/2027 for manufacturing of Brick/Tiles @ 40000 Numbers/Day.
Now, the brick Kiln has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Brick/Tiles @ 40000 Numbers/Day using Coal, Clay and Sand as fuel alongwith required documents & Fee as under:-
1. The Brick Kiln is an existing unit Since Jan, 1997.
2. The Brick Kiln has submitted the site plan, manufacturing process and copy of feasibility report.
3. The kiln has provided an induced draft technology with Zig-Zag firing.
4. The brick kiln has submitted completion certificate of dated 02.03.2021 issued by CSIR-Central Building Research Institute, Roorkee.
5. The value of Fixed assets of the Brick Kiln is Rs. 13.16 Lacs as on 31.03.2025.
6. The Brick Kiln has deposited Rs. 36000/- vide UTR No.385209710 dated 28.12.2025 which is adequate upto 30.09.2030 after deducting penalty of 700%.
7. The BKO has submitted DTP certificate vide no. 961 dated 19.03.2013.
To verify the facts, the site of the Brick Kiln was visited by the undersigned on 02.01.2026. During visit it was observed as under: -
1. The Brick Kiln was not in operation.
2. It has provided Porthole and platform with stair to collect the sample of stack emissions.
3. The unit is using only crush coal as a fuel and no unauthorized fuel is being used.
4. The brick kiln has stabilized the movement area of vehicles with brick/keri pacca road.
5. The brick kiln has planted trees along the periphery of the kiln in an area approx.0.25 acres.
6. There is only generation of domestic effluent and same is discharged onto land for plantation after septic tank.
7. The BKO has provided the display board in compliance to Hon’ble National Green Tribunal (NGT) order dated 25.02.2025 in OA no. 359/2022 in the matter of Rafhat Naeem Siddiqui Vs state of UP & Ors.
8. The Brick Kiln is complying with the Code of Practice Prescribed for Brick Kilns.
Keeping in view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to Brick Kiln upto upto 30.09.2030 with usual conditions and special conditions that: -
1. The BKO will comply with all the code of practice prescribed by the Board for Brick kilns all times.
2. The BKO shall use small spoon for feeding of fuel.
3. The BKO shall use only crushed coal and paddy straw pellets as per notification issued by the Govt. as fuel in the brick kiln.
4. The BKO shall comply with all the directions issued by the MoEF/CPCB/Govt./PPCB from time to time.
