It is submitted that the establishment was earlier visited by the officer of the Regional Office, Patiala on 13.06.2025. During visit, it was observed as under: -
1. The establishment was found in operation.
2. The establishment has provided 2 no. kitchens, one at first floor for restaurant purpose and another on second floor for preparing food of staff members.
3. The establishment has provided suction hood system at both the kitchens for LPG fired stoves.
4. The establishment has also provided 1 no. Gas fired Bhatti for baking of pizza & other bakery items, which is equipped with stack above roof level.
5. The establishment has not provided oil & grease trap for treatment of wastewater generated from washing of vegetable / raw material and from washing of utensils and the untreated wastewater was found being discharged directly into sewer.
6. The establishment has installed 1 no. D.G. set of capacity 120 KVA which is equipped with canopy and adequate stack height.
7. The establishment has provided water meter on the source of fresh water used for cooking of food and for domestic purpose. However, the record of the same has not been maintained.
8. The representative of the establishment informed that the solid waste, food waste including plastic waste is being lifted by a third-party vendor. But, no record of the same was maintained by the establishment.
The establishment is operating its unit without obtaining 'consent to establish' (NOC)/consent to operate of the Board as required under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The establishment is violating under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, intentionally & deliberately.
As such, notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 issued vide Board’s letter no. 2751 dated 08/07/2025 alongwith an opportunity to appear in person before the Chief Environmental Engineer (P) on 15/07/2025 (postponed to 16/07/2025).
However, neither any representative of the project proponent attended the hearing on the said date and time nor any reply has been received from the project proponent.
The matter has been considered by the Competent Authority of the Board and decided to afford another opportunity of personal hearing to the establishment before taking further action in the matter.
As such, notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 issued vide Board’s letter no. 5094 dated 14/10/2025 alongwith an opportunity to appear in person before the Chief Environmental Engineer (P) on 27/10/2025.
The representatives of the project proponent attended the hearing and submit a written reply which was taken on record. During hearing, he informed that they have now complied with the observations made by the visiting officer. He also informed that that the construction work of oil & grease trap has been started at the site. He further informed that they shall apply for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981, within one week.
After hearing the officers of the Board, representatives of the project proponent and material facts on the record, the Chief Environmental Engineer (P) decided as under: -
1. The project proponent shall comply with all the observations of the visiting officer within 15 days and shall comply with the environmental laws, at all times.
2. The project proponent shall apply for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981, within 15 days.
3. EE, RO, Patiala shall visit the site of the project, check the compliance of the Environmental Laws and process the consent application of the project on merits.
The proceedings were conveyed to the project proponent vide Board’s letter no. 5567 dated 31.10.2025 for compliance.
Now, the project proponent is a Restaurant with Dine-in, Takeaway and Delivery Services and has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention and Control of Pollution) Act, 1981 for establishment of project having Restaurant of capacity 76 Seats and for discharge of domestic effluent @ 8 KLD into sewer after passing through Oil and Grease trap under orange category along with requisite documents.
The project proponent has deposited online Rs. 42000/- vide online receipt no. 757580285 dated 08.12.2025 under the Water Act, 1974 and Rs. 42000/- vide online receipt no. 830027308 dated 08.12.2025 under the Air Act, 1981, which is adequate upto 31.12.2028 (after deducting 100% late fee for one year) against the fixed assets of Rs. 159.06 lakh as on 31/03/2025 as per CA certificate dated 06.11.2025 under orange category along with requisite documents submitted by the industry after deduction of penalty fee. As per electricity bill, the date of commissioning December, 2024.
Municipal Solid Waste is being recycled through authorized recycler and waste eatable food is being lifted by Municipal Corporation, Patiala.
Accordingly, the site was visited by the undersigned on 08.01.2026. During visit, it was observed that:
1. The establishment was found in operation.

5. The establishment has now provided oil & grease trap for treatment of wastewater generated from washing of vegetable / raw material and from washing of utensils and the untreated wastewater was found being discharged into sewer after passing through oil and grease trap.
6. The establishment has installed 1 no. D.G. set of capacity 120 KVA which is equipped with canopy and adequate stack height.
7. The establishment has provided water meter on the source of fresh water used for cooking of food and for domestic purpose. It has started maintaining the record of the same.
8. The representative of the establishment informed that the solid waste, food waste including plastic waste is being lifted by a Municipal Corporation, Patiala.
Further, it is pertinent to mention here that the total solid waste proposed to be generated from the establishment will be around 20-25 Kg/day, hence the establishment doesn't cum under the category of bulk waste generator as per solid waste Management Rules, 2016. Further, the establishment has proposed to use reusable cutlery and hence plastic waste generation is very minimum. Moreover, the establishment lifted by waste food and Non-biodegradable waste is being lifted by Municipal Corporation, Patiala.
In view of above mentioned facts, it is recommended that fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention and Control of Pollution) Act, 1981 may be granted upto 30.09.2028 for authorized recycler and discharge of domestic effluent @ 8 KLD onto land for plantation after passing through STP under orange category with suitable conditions and special conditions as per policy of the Board.
