It is submitted that earlier, the industry had obtained ‘Consent to Establish’ (NOC) under the Water (Prevention &Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/LDH3/2021/14978444 dated 27.01.2021 (Green Category) for setting up an industrial unit to manufacture HDPE Jars @ 23334 Nos/day.
Further, the industry has obtained Consent to Operate under the Water Act, 1974 vide no. CTOW/Fresh/LDH3/2022/18223157 dated 18.04.2022 valid upto 31.12.2025 and under the Air Act, 1981 vide no. CTOA/Fresh/LDH3/2022/18416175 dated 18.04.2022 valid upto 31.12.2025 for manufacturing HDPE JAR @ 22000 Kgs/day by using HDPE @ 3000 Kgs/day as raw material alongwith discharge of only domestic effluent @ 0.25 KLD onto land for plantation after passing through septic tnak, subject to certain conditions as mentioned therein.
Now, the industry has applied online for obtaining fresh ‘Consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of HDPE JAR @ 22000 Nos/day by using HDPE @ 3000 Kgs/day alongwith discharge only domestic effluent @ 0.25 KLD onto land for plantation after treatment through septic tank.
Earlier, the industry had deposited consent fee in the previous granted CTOs, which was adequate upto 31.05.2028.
Now, the industry has deposited Consent fee amounting to Rs. 32,000/- vide no. 120946692 dated 11.12.2025 under the Water Act, 1974 and Rs. 32,000/- Vide no. 473297335 dated 11.12.2025 under the Air Act, 1981, against the total value of fixed assets i.e. Rs. 44.98 lacs, as per CA certificate dated 03.12.2025, which is valid for 5 years, under the both acts.
Hence, the aggregated fee is adequate upto 31.05.2033, as the fee slab is same as in previous granted Consents.
The industry was visited by undersigned on 24.12.2025 and it was observed as under:-
1. The industry was in operation for manufacturing of HDPE JARs by using fresh granules as raw material.
2. The industry has provided 06 no. blow molding machines and the entire machinery is automatic & installed in a closed shed.
3. The industry is generating only domestic effluent @ 0.25 KLD and same was being discharged onto land for plantation after passing through septic tank.
4. The industry has developed adequate plantation along the boundary wall for discharge of domestic effluent after treated through septic tank.
5. The industry has installed 01 no. D.G set of capacity 250 KVA equipped with canopy and stack of adequate height.
6. The industry has submitted building plan duly approved by Joint Director of Factories, Department of Factories, SAS Nagar, Mohali dated 17.05.2021.
The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Keeping in view of the above, it is recommended that:
A) Fresh ‘Consent to Operate’ under the Water Act, 1974 may be granted to the industry for manufacturing of HDPE JAR @ 22000 Nos/day for period upto 31.12.2032 subject to suitable conditions along with following special conditions:
1. The industry shall strictly comply with all conditions of Notified Master Plan, Jagraon (2010-2031).
2. The industry shall shift from its present site if it falls under non confirming zone due to any changes in the Notified Master Plan, Jagraon (2010-2031).
