File Note: It is submitted that the subject cited industry is a small scale red category unit. The industry was earlier granted consent to operate under Water Act, 1974 vide no. CTOW/Renewal/LDH2/2023/20816691 dated 01/02/2023 expired on 31/07/2023 and under Air Act, 1981 vide no. CTOA/Renewal/LDH2/2023/20816864 dated 31/01/2023 expired on 30/07/2023 subject to the certain conditions mentioned therein and electric connection of the industry was also restored for six months. Thereafter, the industry has again obtained consent to operate under Water Act, 1974 vide no. CTOW/Renewal/LDH2/2023/22959116 dated 28/08/2023 expired on 27/02/2024 and under Air Act, 1981 vide no. CTOA/Renewal/LDH2/2023/22958884 dated 18/08/2023 expired on 17/02/2024 and electric connection of the industry was also restored for six months i.e. upto 27.02.2024. Thereafter, the industry has obtained the consents to operate under Water Act, 1974 & Air Act, 1981 through the auto renewal facility of the Board on 03.09.2024 vide no. CTO/Renewal/LDH2/2024/26852680 dated 11.09.2024 valid upto 11.09.2025 & under Air Act, 1981 vide no. CTO/Renewal/LDH2/2024/26840631 dated 11.09.2024, both are valid upto 11/09/2025. Thereafter, the industry had applied for varied consent to operate under Water Act, 1974 alongwith requisite documents. Accordingly, the industry was visited by the AEE of this office on 04.10.2025. During the visit, it was observed that the effluent from the wet process section is being stored in an underground storage tank which was full to the brim and during visit the effluent was being discharged into public sewer using pipe and during visit the industry is using water from unmetered supply. Accordingly, the directions u/s 33-A of the Water Act, 1974 was issued to disconnect the electric supply available to the industry. Now, the industry has applied for varied consent to operate under Water Act, 1974 alongwith requisite documents. The industry has already deposited Rs. 33440/- vide e-R No. 714980093 dated 01.10.2025 (with NOC regularization fee and penalty fee) and Rs. 27540/- vide e-R No. 747204480 dated 01.10.2025 under Air Act, 1981 against the un-depreciated fixed assets of Rs. 60.12 Lacs as on 05.09.2025, which is adequate upto 30/06/2030 under Water Act, 1974, as per Board's Office Order dated 29/10/2018. The industry has also provided the TDCO number 94/103 dated 23.12.2025 issued by the PSPCL authority regarding disconnection of electric supply and also directed to this office to seal the water polluting machinery and D.G set installed by the industry, immediately. Accordingly, the industry was visited by the officer of this office on 29.12.2025 and was found closed from the main gate and again visited on 07.01.2026. During the visit, it was observed as under:- 1. The industry was not in operation during the visit due to disconnection of electric supply. 2. The water polluting machinery of the industry has been sealed during the visit as per direction issued to it. 3. The industry has not installed any D.G set in its premises, so sealing of D.G set could not be carried out. 4. The industry was engaged in electroplating process and the industry has signed agreement with M/s JBR Technology Pvt. Ltd., Ludhiana @ 10000 Ltr/M for the treatment & disposal of trade effluent generated. 5. The effluent from the wet process section is being stored in an underground storage tank which was 50% full during visit. 6. The industry has installed new water meter on pipeline leading to process area whose reading during visit was 000.51 KL. 7. Domestic effluent generated by the industry is discharged into sewer. 8. The industry has installed 3 No. Hammer with billet heater and 1 no. Shot blasting machine with inbuilt bag house and adequate stack height. 9. The industry has installed cameras facing towards wet process area, water meter, effluent storage tank. In the subject cited case, the industry has mentioned ground water extraction @ 1.0 KLD. Considering 25 working days per month, ground water extraction will be 25 KL/month, which is less than 300 KL/month. It is further submitted that vide office memorandum no. 428 dated 23.09.2025 among other decisions the Board has decided as under: “The Bank Guarantee be returned and /or permanent restoration be allowed on compliance of specified violation or submission of necessary document based on single site visit subject to decision of the Competent Authority.” Further, while processing the consent application (No. 27057285) of M/s Kalsi Sons Fabricators worthy Chairman of the Board has approved to impose environmental compensation amounting to Rs 1.0 Lakh to such small scale industries vide note dated 11.10.2024. As the industry has made compliance of earlier violations. In view of above, office memorandum, it is recommended that :- 1. The industry may be imposed environmental compensation amounting to Rs 1.0 Lakh being a small scale unit as approved by the Competent Authority in the case M/s Kalsi Sons Fabricators. 2. 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30/06/2030. 3. PSPCL authorities may be directed to restore the electric connection available with the industry, permanently after deposition of EC by the industry Competency: Chief Environmental Engineer
