File Note: It is intimated that the project proponent has applied for obtaining ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, for establishment of a new Residential Flats 3BHK having 450 no., EWS Flats @45 nos and Shops @ 6 nos., in a total area of 18,797 sq. mtr. i.e. (4.64 acres), alongwith requisite documents and fees. The project proponent has deposited Rs. 126500/- vide R. no. 147334706 dated 21.07.2025 including application form fee, against the cost of the project of Rs. 98.20 Cr. (as per project report and application form). The NOC fees deposited by the project proponent is adequate for 02 years. Suitability of Site: The project proponent has submitted a copy of approved layout plan digital signed by Competent Authority Sh. Ashok Patharia dated 06.10.2025. Also, the project proponent has submitted a copy of License to develop a project/colony issued by Office To The Competent Authority (Under PAPRA Act,1995)- Cum Additional Deputy Commissioner (Urban Development), SAS Nagar vide letter no. LDC/CA-ADC(UD)/2025/46 dated 11.07.2025 for developing land into Residential Ground Housing Project and style of project name “Aeroland Heights” on an area of 23 Bigha 01 Biswa 15 Biswasi or (23087.5 sq yds or 4.77025 Acres) at Village Dyalpura, Zirakpur, Distt. SAS Nagar, having validity upto 10.07.2030, which confirms the compliance of project site to zoning regulation as per Master Plan. Environmental Clearance detail: The industry was granted Environmental Clearance vide no. EC24C3801PB5601048N dated 31.10.2025 for Group Housing Project namely “Aeroland Heights” in the total land area of 18,797 sqm and having built-up area of 68,788 sqm located at Village Dyalpura, Zirakpur, Distt. SAS Nagar, Punjab by M/s KS Developers. Water Pollution: The project proponent has proposed to develop for establishment of a new Residential Flats 3BHK having 450 no., EWS Flats @45 nos and Shops @ 6 nos., in a total area of 18,797 sq. mtr. i.e. (4.64 acres). The population estimation, wastewater calculation and water balance submitted by the project proponent is as under: The project proponent has submitted an affidavit for providing 2 acres of land owned by the project proponent itself for disposal of excess treated wastewater onto land for plantation as per Karnal Technology with the water loading of 97.5 KLD/acre, which is at a distance of around 500 m from site. The affidavit is reproduced as under: The project proponent has submitted a copy of Municipal Council, Zirakpur vide letter no. 553 dated 04.07.2025, which is reproduced as under: Air Pollution: The project proponent has proposed to install 03 nos. DG sets of capacity 125x2 KVA and 240 KVA, which are provided with canopies and adequate stack height. Visit: The site of the project was visited by undersigned on 07.01.2026 and during visit, it was observed that: 1. No building construction has yet been started at the site is empty plot. 2. The site falls in the residential zone and during visit, there is no air polluting industry within a radius of 100 mtr. from the proposed site of the project and there is no MAH industry within a radius of 250 mtr. from the proposed site of the project. 3. Thus, the site is suitable as per notification dated 25.07.2008 as amended on 30.10.2009. Recommendations: In view of above, if may approved, ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for one year with usual conditions & with following special conditions: 1. This NOC is valid for establishment of a new Residential Flats 3BHK having 450 no., EWS Flats @45 nos and Shops @ 6 nos., in a total area of 18,797 sq. mtr. i.e. (4.64 acres). 2. The project proponent shall be bound to lay pipeline for conveyance of treated wastewater to the site earmarked for Karnal Technology plantation. 3. The project proponent shall not allow any occupancy at its project, without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 4. In case, there is any change/alteration in the approved layout plans and the proposed layout plan submitted by the project proponent alongwith this application, this CTE shall be deemed to be cancelled and the project proponent shall obtain fresh ‘consent to establish’ from PPCB. 5. The project proponent shall comply with the conditions of the environmental clearance granted by SIEAA, Punjab under the EIA notification dated 2006, at all times. 6. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water. 7. The project proponent shall reuse treated wastewater for flushing purpose by providing dual plumbing system in the project and shall use only treated wastewater for the said purpose. The project proponent shall impose a condition in this regard in all the allotment letters/registries to be done in the project. 8. The project proponent shall use the treated effluent for onto land for plantation within its premises and shall use only treated wastewater for the said purpose in its project. 9. This consent is being issued to the project proponent on the basis of present scenario and the exact disposal arrangements shall be rechecked at the time of grant of ‘consent to operate’ by PPCB. 10. The project proponent shall be bound to provide adequate disposal arrangements for treated wastewater at its site, before giving occupancy at site. 11. The project proponent shall be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974, only after accessing the arrangements for disposal of treated effluent at that point of time. PPCB shall not be responsible for any loss to the project proponent in this regard, howsoever. 12. The project proponent shall utilize treated wastewater from nearby STP Zirakpur for the construction purpose. 13. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis. 14. The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 15. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem on the nearby residential area. 16. The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc. 17. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 18. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter 200 kg/day) to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 19. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 20. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 21. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form. 22. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 23. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 24. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 25. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris. 26. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 27. The promoter shall not allow any occupancy in the project till the time adequate arrangements for treatment & disposal of wastewater and solid waste are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained. 28. The promoter shall develop its residential complex as well as construct flats strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority. 29. The project proponent has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 30. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 31. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 32. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 33. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. *Competency- Worthy Chairperson of the Board, (Project cost above 50 cr.)
