It is intimated that the industry is medium scale red category dyeing unit and was granted ‘Consent to Operate’ under the Water Act, 1974 and the Air Act, 1981vide no. CTOW/Renewal/LDH3/2024/25138292 dated 01.07.2024 & CTOA/Renewal/LDH3/2024/25143846 dated 11.07.2024, which were expired on 30.06.2025 for Dyeing Of Cloth @ 5200 Kgs/day, Printing Of Cloth @ 1500 Kgs/day and Finishing Of Cloth @ 14400 Kgs/day alongwith discharge of trade effluent @ 720 KLD & domestic effluent @ 09 KLD into conveyance system of CETP 50 MLD with operation of one boiler of capacity 04 TPH with Multi Cyclone Separator followed by Alkali Scrubber as APCD.
Earlier, the industry had submitted Bank Guarantee bearing no. 13930100000023 amounting to 1.00 lac as assurance that the industry shall comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 which was valid upto 04/09/2025 and BG bearing no. 13930100000026 amounting of Rs. 50,000/- as an assurance that the industry shall comply with the provisions of the Air (Prevention & Control of Pollution) Act, 1981, which was valid upto 21.06.2025
Previously, Complaint regarding black smoke was received in this office and continuous emission of greyish-colored smoke was observed from the stack of the industry. Thereafter, the industry was issued show cause notice for violations of provisions of the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before the Competent authority of the Board on 10.11.2025 in which it is decided that:-
1. The industry shall take following measures, within 15 days and to ensure that there is no black smoke from its stack:
a. The industry shall upgrade the treatment system and operate its APCD regularly and efficiently so as to achieve the prescribed standards as mandated by the MoEF & CC, Govt. of India vide notification dated 16.05.2023.
b. The industry shall provide energy meter with the APCD and maintain record of the same.
c. The industry shall provide mechanized feeding of fuel is carried out in all time to come.
d. The industry shall ensure that only authorized fuel is utilized in the boiler furnace. The industry shall make all the efforts to avoid wetting of fuel including proper storage/covers while storing in its premises.
e. The industry shall provide CCTV, facing towards camera towards chimney, fuel feeding points and fuel storage area with back up of at least 30 days. The CCTV camera shall be monitored regularly by the owner/responsible person of the industry through online mechanism
f. The industry shall make a comprehensive proposal for fly ash utilization in scientific manner and shall explore the possibilities for its reuse by the brick kilns owners, road filling by NHAI / PWD/other departments, cement industry and other establishments and submit the same to the Board, within one month.
g. The industry shall maintain daily record of fly ash disposal and submit the same in the Regional Office by every 5th of the month.
2. The industry shall, within 07 days, shall submit revised bank guarantee of Rs. 1 lakh as an assurance to comply with the above decisions.
3. The industry shall, within 07 days, deposit the Environmental Compensation of Rs. 50,000/-with the Regional Office-3, Ludhiana as per decision of the personal hearing afforded to the industry u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 on 29.03.2023.
4. The industry shall apply for obtaining consent of the Board under the Air (Prevention & Control of Pollution) Act, 1981, immediately.
5. It was made clear to the industry, in case, the industry is again found emitting black smoke. strict action including closure shall be initiated against the industry u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981
6. Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry to verify the contentions of the industry and process the consent application on merit.
Now, the industry has applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 for dyeing of cloth @ 5200 Kgs/day, printing of cloth @ 1500 Kgs/day and finishing of cloth @ 14400 Kgs/day with trade effluent @ 791.0 KLD and domestic effluent @ 9.0 KLD into CETP 50 MLD. The industry has already deposited Rs. 72,000/- vide R. No. 177188450 dated 04.01.2024 under Water (Prevention & Control of Pollution) Act, 1974, after deducting the NOC normalization and penality, fee is adequate upto 04.10.2026.
The industry has also submitted certificate from Company Secretaries stating that 24.552 KLD shares has been DEMAT and 1554.478 KLD are under process for DEMAT. The industry is having total shares of 1579.0 KLD.
The industry was visited by the AEE of this office on 01.01.2026 and it was observed that:-
1. The industry was in operation and engaged in the process of dyeing & washing of fabric, dyeing / washing of garments.
2. During the last visited conducted on 02/04/2024 the industry had installed 13 soft flow machines (2 of 600 Kg each, 4 of 450 Kg, 7 of 300 kg) having 34 chambers but now the industry has installed one more machine of 600 kg having 4 chambers forming total chambers to 38. However, the detail of the same has not been provided by the industry. The industry has installed 2 printing machines out of which one is in dismantled condition.
3. As per Guru Nanak Dev Engineering College (GNE) formula generation of effluent from 38 chambers is 760 KLD considering generation of 20 KLD per chamber and generation of effluent from 01 printing machines is 50 KLD. Hence the total generation of effluent is 760 + 50 = 810 KLD, which is beyond than the discharge applied by the industry i.e. 791 KLD. It is also mentioned that the industry has previously obtained consent for discharge of trade effluent @ 720 KLD & domestic effluent @ 09 KLD into conveyance system of CETP 50 MLD.
4. The industry has provided the flow meter at its final outlet leading to CETP, which is connected with the SCADA system.
5. The industry has installed one boiler of capacity 4 TPH equipped with cyclone followed by wet scrubber as APCD. Thus the industry has upgraded its APCD. However energy meter was not installed with the APCD and the industry representative informed that the same will be installed within 2-3 days.
6. The industry has also installed two thermopacs of capacity 2000U and 1500U. Rice Husk is used as fuel. Dust collector followed by alkali scrubber is provided as APCD with thermopacs.
7. Rice husk was being used as a fuel in the boiler section and mechanized system of fuel feeding was observed during visit. A shed has been provided for the storage of fuel.
8. The industry has provided CCTV, facing towards camera towards chimney, fuel feeding points and fuel storage area which were operational during visit.
9. The industry representative has informed that they are working at the issue of utilization fly ash in sustainable manner at the PDA level.
10. The industry has not submitted Environmental Compensation of Rs. 50,000/- as per decision of the personal hearing afforded to the industry u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 on 29.03.2023 and revised bank guarantee of Rs. 1 lakh as per the decisions of personal hearing dated 10.11.2025 afforded to the industry.
11. Previously, the industry was visited surprisingly by a team constituted by the Competent Authority of the Board on 24/09/2025 and a stack sample has also been taken and as per the results received from the Air laboratory all the parameters are PM=82(mg/Nm3) against the prescribed limit of PM=250 (mg/Nm3).
Keeping in view of above, it is recommended that Show cause notice for refusal of the ‘Consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 may be issued to the industry with an opportunity of personal hearing before the Competent Authority of the Board.
