CTE/Ext/SAS/2018/7018004 dated 06/04/2018, valid upto 31.01.2019, for the development of project in an area measuring of 287.9 acres located in the revenue estate of village Salamatpur, Dhode Majra, Rasulpur, Saini Majra, Ghandauli and Bhagat Majra, Tehsil Kharar, SAS Nagar. Thereafter, the promoter company was granted extension in the validity of consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no.CTE/Ext/SAS/2019/9741223 dated 29.07.2019 which was valid upto 31.01.2020 for Public Building sites @ 14, Plots @ 1202, Commercial Area @ 10.62 acres, Group Housing Area @ 7.68 acres, EWS Area @ 15.89 acres, subject to certain terms and conditions mentioned therein. The project proponent was granted Environmental Clearance vide EC identification no. EC23B039PB146723 dated 28/12/2023 for expansion of Residential Mega Township project with an increase in the land area from 396.08 acres to 453.164 acre located at Village Salamatpur, Dhode Majra, Rasulpur, Saini Majra, Bhagat Majra, Sangala, Palheri and Ghandauli in Mullanpur Planning area, Tehsil kharar, District SAS Nagar, Punjab. CTE/Exp/PBIP/SAS/2023/2312923224 dated 28.12.2023 expired on 25.12.2024 for Expansion of Residential Township Project for increase in total project area from 287.9 Acres to 453.164 acres (with net planned area of 382.564 and with components as per the layout plan approved by the CTP, Punjab dated 27.12.2022), only, which was further extend upto 25.12.2025, subject to certain conditions and additional conditions that: 1. The validity of Consent to Establish/NOC earlier granted to the project vide no. CTE/Exp/PBIP/SAS/2023/2312923224 dated 28.12.2023, which was valid upto 25.12.2024 is hereby extended upto 25.12.2025, subject to all terms & conditions as mentioned in the original CTE/NOC granted to project. 2. This extension letter shall remain appended with the original Consent to Establish/NOC granted to the project under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Exp/PBIP/SAS/2023/2312923224 dated 28.12.2023, which was valid upto 25.12.2024. 3. The Project Proponent shall not give possession beyond 1050 plots till STP of 2 MLD capacity 1s made operational and alternate disposal arrangements in the form of 13.41 acres land is developed as per Karnal Technology as per khasra no. mentioned in the EC granted to it. The project proponent will maintain the same for Zero liquid discharge till the final outlet is connected with the GMADA sewer for disposal of excess treated wastewater. 4. The project proponent shall comply with the conditions of Environmental Clearance granted vide EC Identification no. EC23B039PB146723 dated 28.12.2023. The project proponent was also granted Consent to Operate (CTO) under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/PBIP/SAS/2025/2503112899 dated 03.06.2025 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/PBIP/SAS/2025/2503244141 dated 03.06.2025 both were expired on 31.12.2025 for operation & Occupancy of Residential Plots @ 170 Numbers, subject to certain terms and conditions mentioned therein. The site of the project was visited by the officer of this Regional Office on 14.05.2025 and contacted Sh. Lakhwinder Singh Supervisor. During the visit, it was observed as under: 1. There are a total of 2960 residential plots along both side of the road leading from Medi City leading to PR-4. Further, there is development in around 190 no. plots where construction have been carried out by individual plot owners. And about 25-30 houses are under construction. 2. As informed by the representative of the project, there is occupancy in around 170 no. plots. However, as per physical observations, the construction status in 4 no. pockets of the project seems that no. of houses already constructed are more than the no. quoted by the project proponent. 3. The project proponent has provided STP of capacity 200 KLD for treatment of domestic effluent generated by the project and the same was not in operation. Tube settler was found completely dry and sludge drying beds are also found empty. The STP final outlet flow meter was not operational. Further, the net generation as per the occupancy in around 190 houses is beyond the installed capacity of the STP. 4. The project proponent has developed area 1.75 acres land as per Karnal Technology for the disposal of treated domestic effluent. The plantation area also dry & not utilizing treated effluent in the plantation area and there was excessive wild growth in the plantation area. 5. Further, various parks were also observed to be dry from which it is clear that the project proponent is not utilizing the treated effluent and neither treating the entire quantum of effluent. 6. The project proponent has provided 2 no. borewells (1 no. Pocket C & 1 no. Greater Punjab) and reading was noted as 321288 m3 & 193892 m3. The project proponent is not maintaining record of the same. 7. The project proponent is utilizing fresh water to water the green areas through mobile tankers. 8. The project proponent has provided mechanical composter and the same was found not operational. From the above, it is clear that the project proponent is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. Accordingly, the project proponent was issued notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 vide Board's letter no. 3218 dated 21.07.2025 alongwith an opportunity to appear in person before the Chairperson of the Board on 06.08.2025. After hearing the representatives of the project promoter and officers of the Board and considering the material aspects of the case, the Chairperson of the Board decided as under: - 1. The project proponent shall submit a bank guarantee amounting to Rs. 10.0 lakhs, as an assurance to comply with the Environmental Laws at all times, within 07 days In Regional Office, SAS Nagar. 2. The project proponent shall apply for obtaining consent to operate under the Water Act, 1974, Air Act, 1981, within 10 days. 3. Environmental Engineer, Regional Office, SAS Nagar visit the site of the project after 15 days and shall verify the submissions/reply of the project proponent made by it during the hearing & verify the compliance of the above decisions by the project proponent and submit its report. In compliance of the above the project proponent has submitted bank guarantee amounting to Rs. 10.0 lakhs bearing no. 0058NDDG00034526 dated 24.10.2025 having validity upto 23-10-2026. Now, the project proponent has applied for extension in the validity of consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, with requisite documents and fees. The project proponent has deposited Rs. 4,75,000/- vide online UTR no. HDFCR52025120591573060 dated 05.12.2025 against the cost of the project of Rs. 1,264.62 Crores. The fee deposited by the project proponent is adequate for one year. The project proponent has submitted approved layout plan got approved by CTP, Punjab dated 27.12.2022. The promoter company has submitted the compliance report of the conditions of the previous granted consent to establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as six monthly compliance report of Environmental Clearance granted by the Competent Authority. As such, the site was visited by the undersigned of this office on 02.01.2026 and during visit it was observed that:- 1. There are around 200 no. plots where construction has been carried out by individual plot owners. 2. The number of houses already constructed are more than the number of number of houses for which consent had been granted earlier. 3. STP of 200 KLD capacity has been installed and was in operation during the visit. Earlier, the sampling of 200 KLD of STP was carried out by this office on 28.11.2025 and as per the analysis report, the parameters are within the prescribed limit, which is as under: pH 7.8, TSS mg/l – 22, COD mg/l – 48, BOD mg/l – 13, O&G mg/l - 6 4. Further, the STP of capacity 300 KLD has been newly installed by the project proponent and the same was also found in operation during the visit. Flow meter has been installed at its outlet of STP of capacity 300 KLD with reading meter noted as 6.7748 m3/hour. 5. As per the record maintained at site, around 60 KLD of effluent is being treated in 300 KLD and around 30-35 KLD effluent is being treated in 200 KLD STP. Around 90-100 KLD effluent is being treated in total. 6. Samples of 300 KLD STP have been collected and the same have been sent to Head Office PPCB Patiala for analysis. 7. The project proponent is now utilizing one borewell with water meter reading noted as 45.743 m3/hour. However, the second borewell is kept for reuse/ emergency purpose and the water meter installed on the stand-by borewell needs repair. 8. The project proponent has developed around 1.0 acre land under karnal technology for disposal of treated domestic effluent. However, the same was found stagnated in various pockets. (Picture attached) Further, the area under karnal technology is less than the 1.75 acres that was needed to be developed for karnal technology as per the last consent granted to it. 9. The project proponent has not installed flow meter after STP on borewell/ pipelines carrying treated effluent for gardening, outlet for back-flushing and discharge onto land for plantation. Thereafter, the water discharge in the various pockets/ use for flushing cannot be verified. 10. Mechanical composter of capacity 250 kg has been installed. However, no record or proof of its operation could be shown during the visit. The project proponent is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and also not complying with the consent granted to it by PBIP. In view of the above, it is recommended that extension in the validity of consent to establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused. *Competency: Hon’ble Chairperson of the Board
