It is submitted that the project proponent was granted Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 vide no. CTOW/Varied/SAS/2022/17807742 dated 08.03.2022, valid till 30.06.2026 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/SAS/2022/17807722 dated 05.02.2022, valid till 30.06.2025 for manufacturing of Kitchen Baskets @ 100 Numbers/Day, Hinges @ 500 Kgs/day, Tower Bolt @ 500 Kgs/day by using raw material Steel @ 0.8 MTD, Aluminum @ 0.5 MTD with certain & special conditions as under:
1. The industry shall not carry out electroplating process in premises of its unit.
2. The industry shall maintain proper record of trade effluent got lifted by the operator of CETP at Ludhiana and make the record available to the authorised visiting officer of the Board.
Thereafter, the industry was visited by the officer of the Board on 14.10.2024 and during visit it was found the industry was violating the provisions of the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thereafter, the industry was given personal hearing before the Senior Environmental Engineer of the Board on 14.11.2024 and during hearing it was decided as under:
1) The industry shall provide Air Pollution Control Device (APCD) with its buffing section within 15-days.
2) The industry shall ensure regular lifting of its trade effluent to CETP and shall maintain proper record w.r.t fresh water consumption/ generation of wastewater/ disposal to effluent to CETP.
3) The industry shall not discharge any of its trade effluent into any sewer/ nallah/ any unauthorized mode in any circumstance. In case, the industry again found violating, the strict action shall be taken against the industry without giving any further notice/ opportunity.
4) The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry to verify the environmental compliances and send it report with recommendations after 15-days.
5) Further action will be taken receipt of report of Environmental Engineer, PPCB, Regional Office, SAS Nagar.
Thereafter, to verify the hearing decision, the industry was visited by the officer of the Board on 26.09.2025 and during visit it was observed as under:
1) The industry was not in operation. The representative of the industry informed that the production of tower bolt, hinge and baskets is likely to be started in a period of 15-20 days.
2) The industry has installed the machinery for anodizing, coloring (dip) and heating in oven for the production of tower bolt. For the production of hinge buffing process is to be carried out. For production of baskets, copper, nickel and chrome plating process is to be done.
3) The industry has installed one borewell of abstraction of ground water, no water meter provided over it. The tap point of borewell is located in the electroplating area. The industry has not provided water meter on the line used for feeding raw water to process.
4) The industry has provided underground storage tank of unknown capacity for storage of trade effluent generated from the process. The same was found dry, indicating that the unit is not in operation.
5) The representative of the industry informed that they have executed agreement with M/s Bantech Water Private Limited, Chanalon for the lifting of wastewater generated by it. However, the industry is not maintaining the record of the wastewater generated and got lifted by the operator of the CETP, Chanalon.
6) The industry has provided grinder buffing machine at the first floor of the industry. However, no proper arrangement was provided for collection of dust emission generated during the process.
7) The industry has installed one DG set of unknown capacity at the roof top, with canopy and of adequate of stack height.
8) The industry has not valid consent to operate under the Air (Prevention & Control of Pollution) Act, 1981. The industry is required to obtain varied consent to operate under the Water (Prevention & control of Pollution) Act, 1974.
Thereafter, show cause notice for revocation/cancellation of ‘Consents to Operate’ granted under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 issued vide Board’s letter no. 5932 dated 13.11.2025 alongwith another opportunity of personal hearing before the Senior Environmental Engineer (P), on 26.11.2025. The representative of the industry attended the hearing and submitted written reply which was taken on record. He submitted that due to change in the partners of the firm the unit was not being operated and they are in process of submitting applications for obtaining fresh consents from the Board.
After hearing the representatives of the industry, officers of the Board, and material facts on the record, the SEE, ZP-1 of the Board decided that:-
1. The consents to operate obtained by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, be revoked/ cancelled with immediate effect.
2. The industry shall apply for obtaining consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with relevant documents regarding change in partnership and under the name of their authorized signatory, within 15 days.
3. The industry shall not operate its unit without obtaining the valid consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
4. The Environmental Engineer, Regional Office, SAS Nagar shall ensure that a patch on auto-renewal of the industry be inserted through Computer Section, so that the industry cannot obtain auto-renewal of consent to operate without complying with the environmental laws.
5. Environmental Engineer, Regional Office, SAS Nagar shall process the consent applications to be applied by the industry on merits and carryout visit to the project & submit its report with conclusive recommendations within 15 days.
6. Further action shall be taken after receipt of report from the Regional Office, SAS Nagar.
The Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 was revoked and Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 was cancelled.
Now, the project proponent has applied fresh Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Kitchen Baskets @ 100 Numbers/Day, Hinges @ 500 Kgs/day, Tower Bolt @ 500 Kgs/day by using raw material Steel @ 0.8 MTD, Aluminum @ 0.5 MTD along with requisite documents.
The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 70.29 lakh. The project proponent has deposited Rs. 36,500/- vide R no. 498942009 dated 15.12.2025 under Water (Prevention & control of Pollution) Act, 1974 and Rs.36,000/- vide R no. 128420416 dated 15.12.2025 under Air (Prevention & Control of Pollution) Act, 1981. After deduction of late fee, NOC regularization the consent fee under both the acts is adequate till 31.12.2030.
The project proponent has submitted dissolution cum partnership deed executed on 01.09.2025 between Mr. Deepak Aggarwal, Mr. Madan Lal and Mrs. Sheela Rani.
The project proponent has submitted agreement with CETP Chanalon for lifting of trade effluent @ 3000 Ltr/Month generated from the industry which is executed on 26.05.2022.
Liquid Effluent
There is generation of trade effluent from the process of anodizing and platting i.e 0.12 KL/day and for the treatment and disposal of this trade effluent we have an agreement with M/s. Bantech water (Chanallon). They lift this trade effluent and treat the same at their treatment facility. We have already provided a tank for collection of this effluent. Hence, no effluent treatment plant is required at our end.
Domestic Effluent :
There will be domestic effluent being generated will be around 1.2 KL/day. The same will be discharged into PSIEC Sewer.
Air emissions
There is no air emissions from the process.
The project proponent has submitted rent agreement executed on 21.11.2025 between Mr. Deepak Aggarwal (Partner of the Firm) and M/s Morff International, which is valid till 30.09.2026.
The project proponent has submitted approved site plan from the Competent person approved under Factory Act.
The site was visited by undersigned on 08.01.2026 and during visit it was observed as under:
1. The industry was not in operation. The representative of the industry informed that the production of tower bolt, hinge and baskets will be started after obtaining Consent to operate.
2. The industry has installed the machinery for anodizing, coloring (dip) and heating in oven for the production of tower bolt. For the production of hinge buffing process is to be carried out. For production of baskets, copper, nickel and chrome plating process is to be done.
3. The industry has installed one borewell of abstraction of ground water. The tap point of borewell is located in the electroplating area. The industry has now provided water meter on the line used for feeding raw water to process.
4. The industry has provided underground storage tank of unknown capacity for storage of trade effluent generated from the process. The same was found dry, indicating that the unit is not in operation.
5. The industry has executed agreement with M/s Bantech Water Private Limited, Chanalon for the lifting of wastewater generated by it. The industry has informed that record of the wastewater generated and got lifted by the operator of the CETP, Chanalon will be maintained after the operation of the unit.
6. The industry has now shifted grinder buffing machine to closed room.
7. The industry has installed one DG set of unknown capacity at the roof top, with canopy and of adequate stack height.
8. Domestic effluent is discharged into the PSIEC sewer.
In view of above, it is recommended that the Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.12.2030 with suitable and special conditions as under:
1. The industry shall submit extended lease deed for the site of the unit before its expiry failing which Consent to operate granted under Water Act, 1974 and Air Act, 1981 be revoked/ cancelled without affording any opportunity.
2. The industry shall maintain proper record of trade effluent generated, stored and lifted by the operator of CETP at Chanalon and make the record available to the authorised visiting officer of the Board.
