File Note: Discussed and in consideration of the report/ recommendations/ reply to observations sent by RO; if approved, the ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for establishment of a Residential colony in an area of 17.66 acres comprising of 375 no. affordable housing plots, EWS Plots @ 48 Numbers/day, Commercial shops @ 10 no. and Community Centre (Having 2596.35 sq. yard), be granted to the project proponent for one year, subject to suitable conditions and the following additional conditions that: 1) This NOC is valid for establishment of a Residential colony in an area of 17.66 acres comprising of 375 no. affordable housing plots, EWS Plots @ 48 Numbers/day, Commercial shops @ 10 no. and Community Centre (Having 2596.35 sq. yard). 2) The project proponent shall develop and construct the project strictly in accordance with the layout/building/site plan approved by the Local Govt. authorities dated 14.05.2025. In the event of any variation, modification, or deviation in the approved parameters including but not limited to built-up area, green area, layout configuration, or any other project component, the project proponent shall be required to obtain prior approval of the revised layout plan from the Competent Authority and thereafter apply afresh for a revised Consent to Establish (CTE) from the Board reflecting such changes. 3) The project proponent shall ensure that the total built up area of all individual projects/plots combined together & the total built up area of construction being carried out by it or any different builders/ individuals may not be greater than the threshold specified under category 8 of the schedule appended to the EIA notification 14/09/2006; otherwise the project shall attract the provisions of the EIA notification 14/09/2006 and the project proponent is required to obtain environmental clearance. 4) In case, it is established at any stage that the project is covered under the ambit of the EIA notification 14/09/2006 and the project proponent has initiated establishment of the project without obtaining requisite Environment Clearance from the competent authority, in such event of a failure to obtain clearance, the project proponent shall be held liable for appropriate action for the violation of the EIA notification dated 14/09/2006 and the "Consent to Establish (NOC) from pollution angle shall be deemed cancelled. In lieu of the same, the Board shall not be responsible for any financial liability arising due to cancellation of this CTE (NOC). 5) The project shall be bound to provide green belt towards the air polluting industries (M/s AV Industry) falling within the 100 mtr of the site as per notification no. 3/6/07-STE (4)/2274 dated 25.07.2008 as amended vide no. 3/6/07-STE (4)/3770 on 30.10.2009. 6) The promoter company shall install STP of capacity 800 KLD based on MBBR technology for the treatment of domestic effluent generated by the project premises, as proposed by it. 7) The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose (@ 316.965 KLD) in accordance with the Board's office order no. 315 dated 05.07.2018 and shall max. utilize the treated effluent in the Unorganised green area @ 2025.74 sqm & Organised green area @ 3,070.19 sq.m and remnant treated effluent will be disposed into the MC Sewer leading to the terminal STP of MC Derabassi in line with the permission obtained from the MC Authorities regarding the same, as proposed by it. 8) The project proponent will develop the project on its own risk & cost in regard to disposal arrangement The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if any. 9) The promoter shall also not allow any occupancy in the project till the time adequate arrangements for effluent treatment & disposal, solid waste handling de disposal are made as well as 'consents to operate under the Water Act, 1974 & the Air Act, 1981 are obtained. 10) The project proponent shall be granted "consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974, only after accessing the arrangements for disposal of treated effluent at that point of time. PPCB shall not be responsible for any loss (including financial) to the project proponent in this regard, howsoever. 11) The project proponent shall not cany out any activity/ construction at site which obstructs the natural drainage through the site, in wetland and water bodies and the natural drainage system should be maintained for ensuring unrestricted flow of water. 12) The project proponent shall restrict its water consumption, waste water generation and abide by the treatment proposal for wastewater and solid waste, as per the proposal given by it. 13) During construction phase, it shall ensure that the waste water being generated from the labour quarters/toilets shall be treated and disposed in environment friendly man manner. In this regard, the project proponent shall provide septic tanks for the treatment of wastewater generated from the labour hutments and the treated effluent supernatant from the septic tanks shall be utilized in green area/ plantation only. 14) The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 15) The project proponent shall obtain permission from the PWRDA for the abstraction of ground water. 16) The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month. 17) The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis. 18) The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity. 19) The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc. 20) The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 21) The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity to produce compost, which will be disposed of reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 22) The project proponent shall obtain permission from MC Derabassi regarding disposal of the inert solid waste onto any authorized or upcoming dumping/ SLF site site of MC Derabassi. In case, the permission for the same is denied or not allowed by the MC Derabassi at any stage; then this 'Consent to Establish' (NOC) from pollution angle shall be deemed cancelled and the Board shall not be responsible for any financial liability arising due to cancellation of this CTE (NOC). In such case, the project proponent shall apply for fresh 'Consent to Establish' (NOC) from pollution angle alongwith concrete proof for alternate modes of disposal of the inert solid waste. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement of the solid wastes. 23) The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 24) The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 25) The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form. 26) The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 27) The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 28) The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 29) The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris. 30) The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 31) The project proponent shall install mechanical composter for the treatment of solid waste being a bulk waste generator. 32) The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 33) The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time. 34) The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish.
