It is submitted that M/s Pawan Kumar Brick Kiln, Village Mansowal, Tehsil Garhshankar, District Hoshiarpur had earlier obtained Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide CTOW/Varied/HSP/2021/14848037, valid up to 30.09.2025, and Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 vide CTOA/Renewal/HSP/2021/14847980, valid up to 30.09.2025. .
.....Now, the unit has applied for Consent to Operate under the Water Act, 1974 and Air Act, 1981 through OCMMS. The unit has deposited consent fee of ₹12,600/- vide Receipt No. 619507164 dated 02.01.2026 towards Consent to Operate under the Air Act, 1981, along with ₹500/- towards application fee. The consent fee under the Water Act, 1974 was deposited earlier and already stands accounted for. Since the present application has been filed after a gap of more than four months from the expiry of earlier CTO (Water), penalty @ 25% of one-year consent fee is applicable as per Board policy. Therefore, the total fee deposited by the unit is adequate for a period of five years.
The applicant has submitted the following documents:
Completion certificate from CSIR-CBRI, Roorkee for Zig-Zag brick kiln, Plan and section vide Drawing No. TM-20/117, CA Certificate dated 27.12.2025, Copy of previous CTOs
Now, in reference to the present application, the brick kiln was visited by the undersigned on 08.01.2026, and the following observations were made:
1. The brick kiln was not in operation at the time of visit.
2. The kiln has adopted Induced Draft Zig-Zag firing technology and has submitted completion certificate issued by CSIR-CBRI, Roorkee, confirming installation of the said technology.
3. The unit is disposing domestic effluent onto land for plantation after passing through a septic tank.
4. The kiln is complying with the Code of Practices prescribed for brick kilns.
5. During the visit, it was observed that the mandatory display board as prescribed by CPCB/PPCB was not installed at a prominent place within the premises. The brick kiln owner was guided regarding the requirement and contents of the display board and has assured that the same shall be installed before commencement of operation.
6. The brick kiln owner was also apprised about the directions regarding mandatory use of 20% paddy straw pellets as fuel along with coal, as per directions issued under Section 5 of the Environment (Protection) Act, 1986, and he assured compliance before starting operation of the kiln.
It is pertinent to mention that the Punjab Pollution Control Board vide office order SEE (HQ-2)/2018/606 dated 18.12.2018 has allowed operation of brick kilns adopting Induced / High Draft Zig-Zag technology certified by approved agencies. The present unit falls under Category-I brick kiln.
In view of the above, it is recommended that Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted up to 10.01.2031 , with general and special conditions, including:
1. The consent shall be subject to the orders passed by the Hon’ble High Court / Hon’ble NGT / any other competent judicial authority.
2. The consent shall remain subject to performance evaluation of Zig-Zag technology adopted by the brick kiln.
3. The kiln owner shall ensure implementation of recommended operating practices as per feasibility report.
4. Pet coke shall not be used as fuel in the brick kiln.
5. Mandatory display board and use of 20% paddy straw pellets shall be ensured before commencement of operation.
