It is submitted that earlier a complaint was received in this office against M/s Yash Grinders & Atta Chaki by Sh. Karnail Singh Saini, #24 main market Nangal from SDM Office Nangal regarding noise pollution being caused by operations of the Atta Chaki in residential area.
The complaint was verified by the officers of this office on 17.03.2025 and Sh. Yashpal Sandal Owner of atta chaki, was contacted during visit and it was observed that the industry has been established without obtaining 'CONSENT TO ESTABILISH' of the Board and is now operating without obtaining ‘CONSENT TO OPERATE' under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
Accordingly, the unit was issued SCN with an opportunity of personal hearing before the Environmental Engineer of the Board on 15.04.2025; however, the same was postponed to 25.04.2025 due to administrative reasons, wherein, it was decided as under:
1. The industry shall ensure the noise level within the prescribed limit.
2. AEE of this office shall carry out noise monitoring of the atta chakki after 10 days.
In compliance of the hearing decisions, the site of the unit was again visited by the AEE and JEE of this office on 15.09.2025 and noise monitoring was carried out. The unit was found violating under the provisions of the Air Act, 1981.
Thereafter, the unit was again issued SCN with an opportunity of personal hearing before EE of the Board on 01.10.2025, wherein, it was decided as under:
1. The industry shall apply for consent to operate from the Board.
2. The industry shall ensure the noise level within the prescribed limit.
3. AEE of this office shall visit the atta chaki after 15 days from issuance of this proceedings.
Now, the unit has applied for obtaining Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents for manufacturing of Wheat flour @ 2 TPD using raw material as Maize, Basen, Spices, Multigrain, Millet grinding @ 1.5 TPD under green category.
The industry has submitted the CA certificate as on 14.10.2025; wherein, the value of fixed assets of the industry is of Rs. 12.80 lakhs with the value of plant and machinery as Rs. 3.80 lakhs. The unit has deposited consent fee of Rs. 4000 /- under the Air Act, 1981 and the fee deposited by the unit is adequate upto 31.12.2026 after adjusting the penalty.
The industry has submitted the CA certificate, copy of lease deed issued by the Executive Engineer, Township Division, Nangal, state licence issued by Food Safety and Standards Authority of India License under FSS Act, 2006 for manufacturing of wheat products dated 03.01.2026 having validity upto 02.01.2027, Udyam Registration Certificate dated 08.11.2023 under category 10611 – Flour Milling, Electricity Bill issued by BBMB for shop established at #24, Main Market, Flour Mill.
The site of the unit was visited by the AEE of this office on 09.01.2026 and Sh. Vishal Sandhal, Proprietor was contacted and it was observed as under:
1. The unit is engaged in manufacturing of flour/atta and is situated in the commercial market of BBMB and the same was in operation during the visit.
2. The industry has installed 2 No. Grinding Machines with APCD as bag filter, 1 No. roller machine, 1 No. Dust Collector with bag filter.
3. The industry has provided rubber pads at machine bottoms in order to reduce noise as well as provide vibrational dampening.
4. The unit is not any kind of trade/domestic effluent in its premises. During visit, it was also observed that there is no provision of washrooms inside the shop.
5. Also, noise monitoring while operation of the unit was carried out at the gate of the industry and the limits were found within the prescribed standards for commercial zone i.e. below 65 dB.

6. The complainant house was visited. However, no one was present at home and lock was observed.
In view of above, it is recommended that ‘Consent to Operate’ under the provisions of the Air (Prevention & Control of Pollution) Act, 1981 for operation of Atta Chaki may be granted to the unit upto 31.12.2026 with special conditions and following additional conditions are as under:
1. The unit shall not generate any trade/domestic effluent in any circumstances, if the unit generates any kind of effluent in future, the same will be bound to obtain Consent to Operate under the provisions of the Water Act, 1974.
2. The unit shall ensure no nuisance/noise is created due to the operations of the atta chaki in its surroundings, if it is so, action will be initiated against the industry as per Environmental Norms.
