• It is submitted that the project proponent (PP) has applied for obtaining consent to establish (NOC) under the Water Act, 1974 & Air Act, 1981 for establishment of hotel-cum-Banquet Halls comprising of 38 rooms & 03 banquet halls through OCMMS on 08.12.2025 under small-scale orange category (without star hotel)…………………………
• The PP has submitted a copy of CLU issued by the Directorate of Town & Country Planning Punjab, Bathinda vide memo no. 1649-STP(B) HZBP-MKT dated 26.11.2025, for setting up of Standalone Project Hotel (The Dodge) for an area of 37 Kanals 7 Marlas (4.66875 acres) bearing khasra no. 75//19/2/2 (4-4), 20 (3-19), 21 (6-16), 22 (8-0), 23/1 (2-18), 23/2 (5-2), 24/1/1 (1-0), 24/1/2 (1-16), 24/2/1/1 (1-6), 24/2/1/2 (2-6). As per the report, the proposed site falls in the notified local planning area of Tehsil Malout. Therefore, the permission is hereby granted to use this area for the purpose of Standalone Project Hotel (The Dodge) as per the Government notification no. 12020/284/25-5Hg2/I/1218703/2025 dated 09.10.2025 as per recommendation of DTP, Sri Muktsar Sahib under suitable conditions…………………..
• The PP has got its building plan approved from Senior Town Planner, Bathinda vide letter no. 91 dated 07.01.2026………..
• The Project Proponent has proposed to construct 38 rooms (accommodating 76 persons, considering 2 persons per room), 03 banquet halls (with a total capacity of 500 persons) and employment of 50 staff members. As per the standard norms adopted by SEIAA/SEAC, freshwater requirement has been calculated as: 180 LPCD for hotel guests, 75 LPCD for banquet/event visitors, and 45 LPCD for staff members. Accordingly, at full occupancy (i.e., simultaneous functions in all banquet halls), the freshwater requirement for banquet halls including staff members works out to 39.75 KLD and wastewater generation to 31.8 KLD. Freshwater consumption for hotel rooms is 13.6 KLD and wastewater generation is 10.9 KLD. Thus, the total wastewater generated from the premises is 42.7 KLD………….
• The PP has submitted undertaking that the banquet halls shall not be used regularly. These banquet halls shall be used for occasional functions like kitty parties, birthday parties, engagement ceremonies, anniversary functions, small marriage functions etc. Hence, maximum occupancy will be 5 times in a month. Accordingly, wastewater generated per day from all 03 banquet halls during functions will be 31.8 KLD. Considering 5 functions per month, wastewater generation per month will be 159 KL (31.8 KLD×5 days). Hence average wastewater generation per day from banquet halls will be 5.3 KLD (159 KL ÷ 30 days = 5.3 KLD)…………….
• The average wastewater generation from the hotel section (assuming 100% occupancy during whole month) will be 10.9 KLD……….
• Hence, the average total wastewater generation from the premises will be 16.2 KLD (5.3 KLD from banquet halls and 10.9 KLD from the hotel section)………………
• The PP has proposed to install ETP-cum-STP of 20 KLD capacity to treat the effluent @ 16.2 KLD. The treated effluent @ 4.5 KLD shall be used for flushing purpose and remaining 11.7 KLD treated effluent shall be disposed off onto land for plantation in 0.5 acre land (Karnal Technology / green area)…………
• To verify the contents of the application, the site was visited by AEE, RO, Sri Muktsar Sahib on 12.12.2025 and it was observed as under:---
1. The site is located at Village Jandwala Charat Singh, H.B. No. 167, Tehsil Malout & District Sri Muktsar Sahib………………
2. The project proponent has not commenced any construction activity at site and no machinery has been installed or arrived at the premises…………….
3. The site is situated more than 100 meters away from the limits of any Municipal Council/Nagar Panchayat area, lal lakir/phirni of any village and any approved residential area or cluster of 15 pucca houses. However, there is one marriage palace and one biscuit manufacturing bakery within a radius of 100-meter from the site. There are no residential houses within this distance…………..
4. As per the feasibility report submitted by the applicant, proper arrangements for kitchen exhaust treatment, including ducting, hooding, exhaust fans, etc., shall be provided. Conventional fuels shall not be used for cooking. Adequate parking space has been provided within the premises to avoid traffic congestion……………..
5. The potential source of air pollution is the proposed DG set of 180 KVA capacity. As per the applicable norms, the DG set shall be housed in an acoustic enclosure. The exhaust emission outlet shall be provided with a muffler and a stack of minimum height of 3.0 meters above the roof level of the building where the DG set is installed………………..
6. Further, as the hotel is located outside the Municipal Committee (MC) limits, as per the feasibility report, the project proponent shall furnish a written agreement/tie-up with authorized recyclers for the collection and recycling of non-biodegradable waste such as plastic, glass, bottles, etc……………
7. For the management of biodegradable waste, the project proponent has proposed the construction of two compost pits. Organic waste shall be treated through vermicomposting using earthworms, and the manure so generated shall be utilized within the premises for horticulture/green belt development. The biodegradable waste shall mainly include kitchen waste, paper and cardboard waste, vegetable peels, and other organic matter……………
• RO has reported that total built-up area of the project is 5,963.7 sq. m., which is less than 20,000 sq. m.; therefore, the project does not fall under the purview of the EIA Notification, 2006…………
• RO has reported that the site is suitable for establishment of such type of units. Further, the proposal submitted by the PP for the abatement of Water and Air pollution is adequate……………..
• RO has recommended for grant of NOC with suitable conditions…….
• RO has further reported that as per CPCB letter vide No. CP-18/1/2023-IPC-VI-HO-CPCB-HO dated 12.02.2025, regarding harmonization of classification of industrial sectors (Clause 4.3, Page 98), hotels/banquet halls having room facilities, including hotels up to 3-star category or those having more than 20 rooms but less than 100 rooms, fall under the Orange Category…………….
• RO has further reported that as per the Guidelines for Entrepreneurs for Compliance of Environmental Laws issued by the Board (Clause 6.3.7, Page 112), for non-star hotels, restaurants, inns, motels, and banquet halls, the competency lies with the Senior Environmental Engineer……
Keeping in view of above and recommendations of RO, if approved, the PP may be granted consent to establish (NOC) from pollution angle for one year, with following special conditions: -
1. The project proponent shall ensure that the total built-up area of the project remains below 20,000 sq. m. In case the built-up area exceeds 20,000 sq.m, the project proponent is bound to obtain Environmental Clearance as per the provisions of the EIA Notification dated 14.09.2006…….
2. Consent to Establish (NOC) is being granted for the establishment of hotel in an area of 37 Kanals 7 Marlas (4.66875 acres) in only those khasra numbers for which it has obtained CLU from Directorate of Town & Country Planning Punjab, Bathinda vide memo no. 1649-STP(B) HZBP-MKT dated 26.11.2025……………………….
3. The PP is bound to comply with all the terms and conditions mentioned in the CLU issued by Directorate of Town & Country Planning Punjab, Bathinda vide memo no. 1649-STP(B) HZBP-MKT dated 26.11.2025…………….
4. The project proponent shall comply with the zoning regulation of Master Plan as and when notified……………
5. The Punjab Pollution Control Board shall not be responsible for any loss (if any) incurred in case the site of the project comes under non-confirming zone of Master Plan to be prepared by the Department of Town & Country Planning Punjab……………
6. In case, any of the document submitted by the project proponent found forged or incorrect, the Consent to Establish shall be deemed cancelled and the Board shall not be responsible for any cost incurred by the project proponent in this regard...........
7. The project proponent shall get its building plan approved from the Competent Authority and shall submit to the Board, within 03 months……….
8. The project proponent shall not book more than 5 functions per month as proposed by the project proponent………….
9. The project proponent shall install STP of adequate capacity as proposed, before commissioning of the project………….
10. The project proponent shall develop plantation over an area of 0.5 acres within the project premises for the disposal and utilization of treated wastewater, as proposed, before the commissioning of the project………….
11. The project proponent shall utilize all treated effluent inside the premises for flushing through double plumbing, construction work, roadside sprinkling, plantation, parks etc……
12. The project proponent shall not use fresh water in the green area/ plantation area / flushing and shall make adequate arrangements for reuse of treated effluent for gardening / plantation / flushing……………
13. The project proponent shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it……….
14. The industry shall install water meter at fresh water supply and shall maintain its record on daily basis………….
15. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016…….
16. The project proponent shall also develop the vermi-composting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies……..
17. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic………..
18. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises……….
19. This consent to establish is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required……………..
