File Note: The industry is a small-scale red category washing unit and was granted 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH3/2021/14530585 dated 11.02.2021 which were expired on 10.02.2022, for Washing of Denim Jeans @ 2000 Nos/day along with discharge of trade effluent @ 98 KLD into sewer after treatment through ETP & domestic effluent @ 02 KLD into sewer. Thereafter the industry was visited by the officer of the Board on 18.04.2025 and during visit it was observed as under: 1. The industry was in operation and was engaged in process of washing of jeans. 2. The industry has installed 05 machines of 180 kg, 01 machine of 120 kg & 02 new soft flow machines of 300 kg having 04 mouth. The industry has also installed 07 tumbler machines for jeans drying and effluent is also generated from these tumbler machines. 3. During visit, the industry was discharging effluent into sewer line of PDA connected with 50 MLD CETP, however, the industry has provided a brick lined pit near main gate and motor pump was installed in this pit to lift trade effluent. Outlet of this pump was in wall of the industry. Thus, there is possibility that the industry discharges untreated effluent through this pump either through mobile tankers or through flexible pipe into sewer line of MCL. 4. During visit, effluent samples from this pit were collected and sent to Zonal Lab for analysis. Colour of effluent was blue. 5. The industry has not maintained data on data board. As per record file, 165 KLD shares of the industry have been done DEMAT. SCADA data of the industry was checked and as per this data the industry has discharged more than its share capacity for 23 days in the month of Feb, 2025 & for 17 days in the month of March 2025 and is also discharging more than its share capacity in the month of April, 2025. The industry is discharging into 50 MLD CETP beyond its share capacity and has maintained an unauthorized outlet near main gate and is operating without valid Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974. As per record file, the industry has not submitted area classification report as per approved Master Plan, Ludhiana. Accordingly, the industry was given personal hearing before the Chairperson of the Board on 08.07.2025, wherein it was decided as under: 1. The industry shall apply for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for discharge of trade effluent @ 98 KLD and domestic effluent @ 2 KLD into conveyance system of CETP of 50 MLD capacity, within 07 days and the industry shall not generate/discharge effluent beyond above mentioned quantity. 2. The industry shall not operate any bye-pass arrangement for discharge of wastewater and the entire effluent of the industry shall be discharged only into the conveyance system of CETP of 50 MLD treatment capacity. 3. The industry shall submit a bank guarantee of Rs. 5 lacs as an assurance for decision no. 01 and 02 above, which will be en-cashed in case of non-compliance of commitment made in the Bank Guarantee, within 07 days. 4. The industry shall connect the discharge of industry having outlet into the CETP conveyance line with the SCADA system and shall maintain record w.r.t. the same. 5. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to the industry to not to operate the machinery beyond 98 KLD total discharge and the Environmental Engineer, Regional Office-3, Ludhiana shall immediately seal the excess machinery installed by the industry to ensure that the total trade effluent generation from the industry does not exceed beyond 98 KLD. 6. Environmental Engineer, Regional Office-3, Ludhiana shall also make surprise visit to the industry and submit the compliance report w.r.t. the bank guarantee imposed upon the industry, within one month. The point wise compliance of the above-mentioned proceedings is as under: 1. The industry has applied for obtaining varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 for discharge of trade effluent @ 98 KLD and domestic effluent @ 2 KLD into conveyance system of CETP of 50 MLD capacity. 2. During visit, it was found that the industry has filled the pit with concrete mixture and also removed the pump provided with it. 3. The industry has submitted a bank guarantee bearing no. 034GT02252440001 dated 01.09.2025, which valid upto 31.08.2027 of Rs. 05 lakh as an assurance for decision no. 01 and 02 above. 4. The industry has connected the discharge of industry having outlet into the CETP conveyance line with the SCADA system and has also started maintaining the record w.r.t. the same. 5. In compliance of the above said decision, the industry was visited on 06.08.2025 to seal the excess machinery beyond 98 KLD and during the visit two washing machines of capacity 180 kg each and one soft flow machine (02 chambers) of the industry has been sealed to constrain the discharge upto 98 KLD. The said report has also been sent vide e-note 29430963. 6. The industry has been visited by the undersigned on 11.09.2025. The detail of the visit have been mentioned in the paragraph mentioned below. Thereafter, the industry was granted varied consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH3/2025/29713752 dated 09/10/2025 valid upto 08/01/2026 for Washing of Knitted Fabric/ Cloth @ 10 MTPD, Washing of Denim Jeans @ 2000 Nos/day & washing of textile shirts etc @ 8000 Nos/day along with discharge of trade effluent @ 98 KLD & domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD after verification of the compliances. Now, the industry has applied for obtaining varied ‘Consent to Operate’ under the Water Act, 1974 through OCMMS for Washing of Knitted Fabric/ Cloth @ 10 MTPD, Washing of Denim Jeans @ 2000 Nos/day & washing of textile shirts etc @ 8000 Nos/day along with discharge of trade effluent @ 265 KLD & domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD. The industry has submitted CA certificate dated 08.07.2025, Share DEMAT certificate, Classification of area certificate, NOC from PDA to discharge effluent into CETP, Bank Guarantee of Rs. 05 Lakh, Machinery detail etc. The industry has deposited Rs. 42,000/- vide UTR. No. N135243038521086 dated 14.05.2024 & Rs. 22800/- vide UTR no. HDFCN52025091676109849 dated 16.09.2025 under Water Act 1974, which is adequate upto 31.03.2026 after deducting Rs. 43,200/- as penalty under said act. However, as per the last hearing given to the SPV on 06.05.2025 by the Competent Authority of the Board, it has been decided that no new NOC or NOC for expansion or varied consent to operate for increase in the discharge of trade effluent shall be granted to the member units connected with the CETP. The industry was visited by the undersigned on 08.01.2026 and contacted Sh. Sandeep Bawa it was observed as under: 1. The industry was in operation and was engaged in process of washing of jeans. 2. The industry has installed garment washing machines 05 of 180 kg, 01 of 120 kg & 02 soft flow machines of 300 kg having 04 mouth. The industry has also installed 07 tumbler machines for jeans drying. 3. During visit, it was observed that the seals were found intact on two washing machines of capacity 180 kg each and one soft flow machine 300 Kg (02 chambers). 4. As per GNE calculation effluent generation from garment washing machines 03 of 180 Kg is 45.2 KLD & 01 of 120 Kg is 10.08 KLD and from 01 soft flow of 300 Kg having 02 mouth is 20 X 02 = 40 KLD. Total effluent 45.2 KLD + 10.08 KLD + 40 KLD = 95.28 KLD for machines in operation. 5. The industry has maintained the record of the waste water disposal into 50 MLD CETP through SCADA system. The perusal of the record confirms that the industry has restricted its effluent to 98 KLD. 6. The industry has submitted DEMAT certificate dated 25.07.2025 of 265 KLD Shares. The industry has also submitted NOC from Punjab Dyers Association regarding discharging of effluent 265 KLD into conveyance system of CETP 50 MLD. 7. The industry has submitted the classification of area certificate issued by the ATP, Nagar Nigam, Ludhiana vide no. 227/ATP-B/D dated 19.08.2025 stating that the site of the industry falls in 'Industrial zone' as per Approved Master Plan, Ludhiana. From the above, it is evident that the industry is now complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the decisions of the personal hearing given to it before the Competent Authority. Keeping the above in view, it is recommended that: 1. Varied 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry upto 31.03.2026 for Washing of Knitted Fabric/ Cloth @ 10 MTPD, Washing of Denim Jeans @ 2000 Nos/day & washing of textile shirts etc @ 8000 Nos/day along with discharge of trade effluent @ 98 KLD & domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD subject to suitable conditions along with following special conditions: (i) The industry shall make the necessary arrangements to achieve the effluent standards as per the inlet designed parameters of the CETP. (ii) The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or dedicated conveyance system is overflowing. (iii) The industry shall maintain the record of flow meter installed at outlet leading to CETP. (iv) The industry shall discharge its trade & domestic effluent only into the conveyance system of CETP 50 MLD through single outlet. (v) The industry shall not install any new dyeing/ water polluting machinery without permission of the Board. 2. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to de-seal 02 washing machines of capacity 180 kg each and one soft flow machine 300 Kg (02 chambers), which are earlier sealed.
