Kindly peruse the note of JEE dated 08.01.2026…………………
• The Project Promoter has applied for consent to establish (NOC) for development of Residential cum commercial colony 'Royal City' in an area of 13.45 acer with total no. of 210 residential plots, 22 EWS plots and 25 commercial plots …………………
• The PP has submitted license to develop an affordable residential Plotted colony having license no ADC-UD/CA-BTI-2025/07 dated 02.07.2025 on the name of M/s guru Kashi Estates and developers, Talwandi Sabo valid upto 08.08.2028. for net area @65098 Sq yard………
• The Project Proponent has submitted copy of approved site plan signed by Senior Town Planner, Bathinda Region, Department of Local Government, Punjab.………………………
• As per approved layout plan, total Saleable area is 30714 Sq. meter, by Considering FAR value at maximum @2.1 as per bye-laws, the maximum built-up area will be 64,500 sq. meter, which is less than 1,50,000 Sq Meter, hence doesn’t Comes under the purview of EIA notification, 2006……………..
• It is added that SEIAA Punjab vide letter no 205 dated 15.04.2019 has clarified that the projects with land area less than 50 ha but built-up area more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the EIA Notification2006 as amended from time to time. In this regard, the Board vide letter no. 10949 dated 09.05.2023 has sought a clarification from the Joint Director MoEF&CC, Chandigarh and reply of clarification is awaited…………..
• It is further added that total land area of project is less than 50 ha and built-up area is less than 1,50,000 sq.m. Hence, as per MOEF&CC notification dated 29.01.2025, the project is not covered under the ambit of EIA notification 2006 & its subsequent amendments……..
• As per feasibility report submitted by the project proponent, total waste water generation will be 340 KLD. The PP has proposed to install sewage treatment plant (STP) of capacity 408 KLD, which seems adequate…………
• As per proposal of the project proponent, 142 KLD treated effluent will be used in flushing, 12 KLD will be disposed in green area and remaining 186 KLD treated effluent will be discharged into MC sewer………
• The Project Proponent has submitted a copy of the NOC issued by the Executive Officer, Municipal Council, Talwandi Sabo vide letter no. 684 dated 18.07.2025 for the disposal of treated effluent into the Municipal Council sewer………………
• The Project Proponent has proposed that organic waste will be treated/disposed of in compost pits, whereas recyclable waste will be handed over to an authorized recycler…………..
• The site of project was visited by JEE of RO Bathinda on 25.12.2025 and it was observed as under:-
1. The site is located within Municipal limits of Municipal council, Talwandi Sabo………………….
2. The PP has completed construction of Boundary wall and construction work of roads and leveling of ground was in process during visit…………………
3. There is no MAH unit within the 250 mtrs from the boundary of the project. There is no brick kiln and cement plant within 300 m and no rice sheller, stone crusher, grinding unit or hot mix plant within 500 mtrs and no air polluting industry within 100 m from the proposed site………………….
• RO has reported that site is suitable for establishment of the residential colony and has recommended for grant of Consent to Establish (NOC)……………………..
Keeping in view of above & recommendations of RO, if approved, Consent to Establish (NOC) may be granted to the project proponent from pollution angle for a period of one year for development of Residential cum commercial colony ' Royal City’ in an area of 13.45 acer with total no. of 210 residential plots, 22 EWS plots and 25 commercial plots, subject to suitable conditions and following special conditions that:
1. The total built-up area of the project will not exceed 1,50,000 sq.m in any case. The project proponent shall be bound to obtain environmental clearance under EIA notification dated 14.09.2006 in case the built-up area of the project increases above 1,50,000 sq. meters.……. ………………..
2. The project proponent is bound to comply with the decisions of MOEF&CC w.r.t. clarification raised by the Board vide letter no. 10949 dated 09.05.2023………………………
3. The Punjab Pollution Control Board is not responsible for any lose if the project covered under the ambient of EIA notification, 2006…………………………
4. Consent to Establish (NOC) is being granted for the development of the residential colony in an area of 13.45 Acres in only those khasra numbers for which it has obtained permission from the concerned authority ,………………………….
5. The PP will develop the project as area development project and in no case the PP will develop the project as Building construction project by making construction on the individual plots without prior permission from the Board………..
6. The Project Proponent will not allow any shop owners to set-up any restaurant/ eateries/ food court in the project and shall be bound to make this condition as the part of the allotment letter/ sale deed to the owner of the individual plots……………
7. In case any individual shop owner proposes to establish any restaurant/ eateries/ food court Project Proponent shall be liable to amend the Project proposal and shall obtain revised permissions from the Board to install STP of adequate capacity………….
8. The project proponent will install the STP of adequate capacity as proposed, simultaneously with the commissioning of the project………….
9. The project proponent shall utilize maximum treated effluent inside the premises for flushing through double plumbing, construction work, roadside sprinkling etc, and only surplus treated effluent will be discharged into MC sewer leading to terminal STP after getting assessed spare capacity of STP from MC Talwandi Sabo/ PWSSB and after obtaining permission from the concerned authorities……………..
10. It is made clear to the project proponent that in case the STP provided by Municipal Council Talwandi Sabo do not have adequate treatment capacity, then the project proponent will make its own arrangement to utilize entire treated wastewater…………………
11. The project proponent shall not use fresh water in the green area/ plantation area and will make adequate arrangements to reuse the treated effluent for watering of green areas in the project premises……………
12. The project proponent shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it……….
13. It will be sole responsibility of the Project Promoter to provide adequate treatment and disposal of effluent at any stage………..
14. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016…….
15. The project proponent shall also develop the vermi-composting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies……..
16. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic………..
17. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises……….
18. This consent to establish is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required……………..
