Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 09.01.2026 w.r.t. show cause notice for refusal of consent to operate under the Air Act, 1981 - M/s Punjabi Dyeing, 367, Industrial Area-A, Ludhiana.

The Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category scattered dyeing unit and was granted consent under the Air Act, 1981 dated 10/07/2025 valid up to 09/10/2025 for Dyeing/ Processing on job Basis @ 4000 Kgs/day by using Dyes & Chemicals @ 500 Kgs/day as raw material with special condition that the industry shall upgrade its air pollution control arrangements to comply with the revised emission standards notified by MoEF&CC on May 16, 2023, within 3-month consent period.
During the on-going drive in the area on 28.10.2025, the stack emission samples were collected and as per the analysis results, the conc. of parameter SPM is found to be 402 mg/Nm3 against 250 mg/Nm3 which shows that the results are beyond the prescribed limits.
The industry has now applied for obtaining consent to operate under the Air (Prevention & Control of Pollution) Act, 1981.
The industry was also visited by officer of the Board on 24.12.2025. During the visit, it was observed as under:
1. The industry was in operation and engaged in the process of dyeing.
2. The industry has installed 7 no. soft flow machines (3 No. - 300 kg, 3 No. - 400kg, 1 No.- 600 kg), 6 No. pole dryer and 1 No. hydro in the premises.
3. The industry has installed wood-based package boiler of capacity 4 TPH along with Cyclone separator as APCD.
4. The industry has also installed DG set of capacity 125 KVA with canopy.
5. The industry has failed to upgrade its APCD to achieve the revised emission standards prescribed by the ministry of MOEF & CC.
The industry was issued show cause notice for refusal of consent to operate under the Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 09.01.2026.
Sh. Varun Sharda, Partner from the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry has initiated corrective measures without any delay after the inspection of Board officers and as per the guidance provided by the visiting officer of the Board. They have placed an order for a 2-stage wet scrubber, which has already been received at the factory premises. The installation and commissioning work is in progress and shall be completed within 7 to 10 days. After installation and stabilization of the said Air Pollution Control Device (APCD), the emissions from unit shall be well within the revised emission standards prescribed by the MoEF&CC and shall fully comply with PPCB norms. The deviation observed during sampling was neither intentional nor regular in nature and occurred due to operational limitations of the existing control system. He further assured that such deviation shall not be repeated in future, and continuous monitoring and regular maintenance of the APCD shall be ensured to maintain consistent compliance. The industry has already applied for Consent to Operate under the Air Act. He requested to grant sometime for this upgradation.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The application for consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be refused.
2. The industry shall upgrade its Air Pollution Control Device (APCD), within 15 days, so as to achieve the revised emission standards as notified by MoEF&CC vide Notification No. GSR 373(E) dated 16.05.2023.
3. The industry shall operate the APCD regularly and efficiently so as to ensure no black smoke / emissions from chimney and achieve the emission standards prescribed by the Board at all the time.
4. The industry shall apply for consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 after upgradation of its Air Pollution Control Device (APCD).
5. The industry shall also take additional measures for better air pollution control that includes:
a) APCD shall be provided with the separate electric energy meter and daily record of energy consumed shall be maintained.
b) CCTV cameras shall be installed focusing towards the boiler stack and fuel feeding for self-monitoring of emissions and maintain 30 days footage as part of compliance records within one month. The CCTV cameras to be monitored regularly by the industry through in-house mechanism to be developed by the industry.
c) Mechanized fuel feeding system shall be provided and make operational, within 15 days.
d) Only authorized fuel for which consent has been granted is to be used.
e) Fuel should not be moistured or wet. For that, quality of fuel shall be monitored regularly and a covered shed should be provided for fuel storage, within 15 days.
f) The industry shall make proper and covered arrangements for scientific storage and handling of boiler ash to avoid its dispersion in the plantation area and prevent fugitive emissions.
6. The Environmental Engineer, Regional Office-1, Ludhiana shall visit the industry, collect emission samples, check the compliance of above hearing decisions and submit report alongwith recommendations in the matter, after one month
