File Note: It is submitted that the industry is small scale red category unit. Earlier, during inspection of electroplating units not lifting their Trade effluent, a new industry was identified whose acidic effluent was found to be overflowing from the sewer of an industry. Upon visiting the premises, the following observations were made: 1. The industry was in operation during visit and engaged in manufacturing of cycle parts along with pickling process. 2. The industry has installed 1 zindi machine, 6 power press and 1 diesel ammonia gas fired furnace without APCD. 3. The industry has not provided any storage facility for the generated trade effluent from its pickling process and is discharging it directly into the sewer. During the visit, the sewer was found overflowing and the effluent was spread onto the adjoining road. 4. The industry has not made an agreement with J B R for its trade effluent generated. 5. The industry is operating its unit without consent of the board. 6. The industry has not provided any commissioning certificate for its unit. As such the industry is not complying with the provision of Water Act, 1974 and Air Act, 1981. Accordingly, the Competent Authority of the Board has issued the Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 vide letter no. 6763-66 dated 28.11.2025 for closure of unit, disconnection of electricity, sealing of polluting machinery and DG set are issued to the industry. In compliance of above the PSPCL authorities was disconnected the electric supply of the industry vide TDCO no. 3/2003 dated 03.12.2025 and the water polluting machinery was sealed by the officer of this office. Now the industry has applied for fresh consent to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS for Manufacturing of Zindi @ 25 Kgs/day and Free Wheel Pawls @ 120 Numbers/day and for discharge of domestic effluent @ 0.8 KLD into sewer and trade effluent @ 0.08 KLD lifted by the M/s Keshav chemicals Marketing co, Ludhiana by installing one No. electric Rotary furnace. The industry has deposited CTO fee of amounting to Rs. 54000/- vide R.no. 654868130 dated 30.12.2025 under the Water Act, 1974 and Rs. 54000/- vide R.no. 357316317 dated 30.12.2025 under the Air Act, 1981, which is adequate upto 30.09.2028 (after deducting of NOC and late penalty fee) against the gross fixed assets of Rs. 48.02 Lacs and plant & machinery of Rs. 20.14 Lacs as per CA certificate dated 25.12.2025. The industry was visited by the officer of this office on 13.01.2026 and it was observed as under: - 1. The industry was not in operation during visit due to disconnection of electric supply. In this regard the industry has also submitted TDCO no. 3/2003 dated 03.12.2025 issued by the PSPCL authorities. 2. The industry is engaged in manufacturing of cycle parts along with pickling process. 3. The seals were found intact during the visit. 4. The industry has installed 1 Zindi machine, 4 power press, 02 no. Dhol and 01 no. electric rotary furnace. 5. The industry has provided a storage tank of capacity 2000 Ltr. for storage of its Trade Effluent. 6. The industry has provided water meter on the source of fresh water supply. The reading of the Water Meter was observed to be 0 as the industry was not in operation due to disconnection of electricity. 7. The industry has made an agreement with M/s Keshav chemicals Marketing co., Ludhiana @ 2000 ltr./month for lifting of trade effluent. 8. The industry has submitted approved site plan approved by the Competent Person. 9. The industry has submitted machinery bills as a proof of date of commissioning i.e., 19.03.2020. 10. The industry is now complying with the provisions of the Water Act, 1974 and Air Act, 1981. In view of above it is recommended as under:- 1. Electric connection of the industry may be restored temporarily i.e. upto six months. 2. Consent to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the industry for short term period i.e. upto six months with suitable conditions as per policy of the Board alongwith special conditions that:- 1. The industry shall install CCTV cameras with 30 days backup within 15 days, facing towards • entry gate of processing shed • flow meter provided on freshwater supply provided for processing activities • effluent storage tanks • any other suitable point deemed fit to ensure that whole of the water consumed is metered and whole of the trade effluent is lifted to CETP operator • The industry shall maintain in-house monitoring mechanism through mobile phone/ office Screen for visualizing the above CCTV cameras so as to ensure that no intentional or unintentional lapse happens and no untreated effluent is bye-passed 2. The industry shall maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. 3. The record shall be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally and action as deemed fit shall be taken in accordance with law. 4. The industry will be only disposing its trade effluent to CETP operator. 5. The industry will submit the record on monthly basis to Board. 6. The industry shall ensure that the lifting shall be made at least 2-3 times in a month. Competency to Grant Consent: SEE Competency to restore electric connection: Hon’ble Chairperson
